§ 1 Prohibition of shipments of protection against bluetongue

(1) of susceptible animals from a restricted zone within the meaning of Article 2 (d) of Regulation (EC) No 1266/2007 of the Commission of 26 June 2007. October 2007 laying down detailed rules for the implementation of Council Directive 2000 /75/EC as regards the control, monitoring and monitoring of bluetongue, and the restrictions on movements of certain animals from the Bluetongue susceptible to susceptible species (OJ L 327, 30.4.2004, p. 37), which is in force in the current version, is prohibited. The prohibition of sentence 1 shall apply, without prejudice to the powers of the competent authorities referred to in Article 7 (1), even in conjunction with paragraph 4, of Regulation (EC) No 1266/2007, in so far as the conditions are
1.
of Article 8, paragraph 1 or 4, also in conjunction with paragraph 6, or
2.
of Article 9, paragraph 1, also in conjunction with paragraph 2,
of Regulation (EC) No 1266/2007. Furthermore, the prohibition of sentence 1 shall not apply where susceptible animals
1.
in
a)
Blocking zone within the meaning of Article 2 (d) of Regulation (EC) No 1266/2007,
b)
a control zone within the meaning of Article 8 (2) (b) of the Directive 2000 /75/EC of the Council of 20 November 2000, laying down specific provisions for measures to combat and eradicate bluetongue (OJ L 327, 28.12.2000, p. 74), as amended, or
c)
a provisional free area within the meaning of the first subparagraph of Article 7 (2a) of Regulation (EC) No 1631/12. 1266/2007
of another Member State, and
2.
in the case
a)
Point 1 (a), the requirements of Article 7 (1), also in conjunction with paragraph 4, of Regulation (EC) No 1266/2007,
b)
of point 1 (b) Requirements of Article 7 (2), including in conjunction with paragraph 4, Regulation (EC) No 1266/2007, or
c)
of point 1 (c), the requirements of Article 7 The fourth subparagraph of paragraph 2a, also in conjunction with paragraph 4, of Regulation (EC) No 1266/2007
.
(2) The movement of embryos, semen and ova from a restricted zone within the meaning of Article 2 (d) of Regulation (EC) No 1266/2007 is prohibited. The prohibition in the first sentence shall not apply in so far as the conditions laid down in Article 8 (1), in each case also in conjunction with paragraph 6, of Regulation (EC) No 1266/2007, are fulfilled. § 2 Monitoring programs, Observation programs

(1) The execution of the programs
1.
to monitor and monitor bluetongue within the meaning of Article 4 of Regulation (EC) No 1266/2007, in conjunction with points 1 and 2 of Annex I, which are based on the statement of possible introduction of the bluetongue virus,
2.
for monitoring and monitoring the bluetongue disease within the meaning of Article 4 of the Regulation (EC) No 1266/2007, in conjunction with points 1 and 3 of Annex I, which are designed to demonstrate the absence of certain serotypes of the bluetongue virus,
be the responsibility of the competent authority.2. The competent authority shall inform the Federal Ministry of Food and Agriculture on request concerning the results of the programmes referred to in paragraph 1. unofficial table of contents

§ 4 Vaccinations

(1) susceptible animals may only be vaccinated against bluetongue
1.
in the case of the official determination of the Bluetongue disease outbreaks in accordance with § 4 of the Regulation on protection against bluetongue,
2.
with inactivated vaccines and
3.
with vaccines used in the manufacture of which the serotype used for the official determination referred to in point 1 was used.
Sentence 1 shall apply accordingly if: Territory of a neighbouring Member State or of a third country of the outbreak of bluetongue within a distance of less than 150 kilometres from the German border by the competent authority of the Member State concerned or of the the third country concerned has been officially established.2. The keeper of animals shall, within seven days of the implementation of the vaccination, indicate to the competent authority or a body responsible for each vaccination against the bluetongue, specifying
1.
the registration number of its operation,
2.
the date of the vaccination, and
3.
of the vaccine used
. In addition, the competent authority shall inform the competent authority of the ear tag numbers of the animals vaccinated in accordance with the first sentence. Non-official table of contents

§ 4a Wildlife investigation, further action

(1) The competent authority can identify bluetongue in the case of susceptible wild ruminants, order studies. In the case of the arrangement according to the first sentence, the hunting rights authorized

after closer instruction of the competent authority shall have samples of wild ruminants issued for examination to be derived from bluetongue and to be assigned to the investigative body designated by the competent authority, and
2.

§ 5 Administrative Offences

Unlawful within the meaning of Section 32 (2) (4) (a) of the Animal Health Act who intentionally or negligently spends
1.
an animal against § 1, paragraph 1, sentence 1,
2.
contrary to § 1, paragraph 2, sentence 1, an embryo, seed or egg is spilled,
3.
contrary to § 4, paragraph 1 an animal vaccinates,
4.
contrary to § 4, paragraph 2, sentence 1, a communication does not make, not correct, not complete or not timely, or
5.
Contrary to a workable arrangement in accordance with § 4, paragraph 2, sentence 2.
