§ 1 Movement prohibition for protection against bluetongue

(1) The movement of susceptible animals from a restricted zone within the meaning of Article 2 (d) of Regulation (EC) No 1266/2007 of the Commission of 26 June 2007. October 2007 laying down detailed rules for the implementation of Council Directive 2000 /75/EC as regards the control, monitoring and monitoring of bluetongue, and the restrictions on movements of certain animals from the Bluetongue susceptible to susceptible species (OJ L 327, 30.4.2004, p. 37), which is in force in the current version, is prohibited. Without prejudice to the powers of the competent authorities referred to in Article 7 (1), the prohibition of the first sentence shall not apply, including in conjunction with paragraph 4, of Regulation (EC) No 1266/2007, in so far as the conditions are met:
1.
Article 8 (1) or (4), including in conjunction with paragraph 6, or
2.
Article 9 (1), including in conjunction with paragraph 2,
of Regulation (EC) No 1266/2007. The prohibition of the first sentence shall also not apply to the extent to which animals are susceptible:
1.
to
a)
a blocking zone within the meaning of Article 2 (d) of Regulation (EC) No 1266/2007,
b)
a control zone within the meaning of Article 8 (2) (b) of Council Directive 2000 /75/EC of 20 November 2000 laying down specific provisions for measures to combat and eradicate bluetongue (OJ L 327, 22.12.2000, p. 74), as amended, or
c)
a provisional free area within the meaning of the first subparagraph of Article 7 (2a) of Regulation (EC) No 1266/2007
in another Member State; and
2.
in case of
a)
Point 1 (a), the requirements of Article 7 (1), also in conjunction with paragraph 4, of Regulation (EC) No 1266/2007,
b)
point 1 (b), the requirements of Article 7 (2), including in conjunction with paragraph 4, Regulation (EC) No 1266/2007, or
c)
Point 1 (c), the requirements of the fourth subparagraph of Article 7 (2a), also in conjunction with paragraph 4, of Regulation (EC) No 1266/2007
are fulfilled.
(2) The transfer of embryos, semen and ova from a restricted zone within the meaning of Article 2 (d) of Regulation (EC) No 1266/2007 shall be prohibited. The prohibition in the first sentence shall not apply in so far as the conditions laid down in Article 8 (1), in each case also in conjunction with paragraph 6, of Regulation (EC) No 1266/2007, are fulfilled. § 2 Monitoring programmes, monitoring programmes

(1) The implementation of the programmes
1.
for the monitoring and monitoring of bluetongue within the meaning of Article 4 of Regulation (EC) No 1266/2007, in conjunction with points 1 and 2 of Annex I, which aim to establish possible introduction of the bluetongue virus,
2.
on the monitoring and monitoring of bluetongue within the meaning of Article 4 of Regulation (EC) No 1266/2007, in conjunction with points 1 and 3 of Annex I, which are aimed at the absence of certain serotypes of the bluetongue virus to demonstrate,
(2) The competent authority shall inform the Federal Ministry of Food and Agriculture on request concerning the results of the programmes referred to in paragraph 1. Unofficial table of contents

§ 4 vaccinations

(1) receptive animals may only be vaccinated against bluetongue
1.
in the case of the official declaration of the outbreak of bluetongue in accordance with Article 4 of the Regulation on protection against bluetongue,
2.
with inactivated vaccines and
3.
with vaccines used in the manufacture of which the serotype has been used, which was the reason for the official determination referred to in point 1.
The first sentence shall apply if the outbreak of bluetongue within a distance of less than 150 kilometres from the German border by the competent authority in the territory of a neighbouring Member State or of a third country of the Member State concerned or of the third country concerned. (2) The keeper of the animal shall, within seven days, have any vaccination against bluetongue to the competent authority or to a body designated by that competent authority. after the vaccination has been carried out,
1.
the registration number of its holding,
2.
of the date of vaccination; and
3.
of the vaccine used
. In addition, the competent authority shall inform the competent authority of the ear tag numbers of the animals vaccinated in accordance with the first sentence. Unofficial table of contents

§ 4a Wildlife investigation, further measures

(1) The competent authority may order investigations into the detection of bluetongue in susceptible wild ruminants. In the case of the arrangement referred to in the first sentence, hunting rights
1.
to take samples of wild ruminants on bluetongue after detailed instructions from the competent authority, and to submit to the investigative body designated by the competent authority, samples of bluetongue and
2.
inform the competent authority of the increased occurrence of diseased or dead wild ruminants, indicating the location of the site.
(2) The power of the competent authority to order further measures to combat bluetongue in accordance with Article 38 (11) in conjunction with Article 6 (1) (10) of the Animal Health Act, in so far as it is concerned with the control of the disease shall remain unaffected. § 5 Administrative Offences

Contrary to the provisions of Section 32 (2) (4) (a) of the Animal Health Act, who intentionally or negligently is acting in accordance with the provisions of the Animal Health Act
1.
, contrary to the first sentence of Article 1 (1), the animal spends
2.
, contrary to the first sentence of Article 1 (2), spends an embryo, a seed or an egg,
3.
Contrary to Article 4 (1), an animal is vaccinated,
4.
, contrary to § 4 (2) sentence 1, a communication does not make, not correct, not complete or not in good time, or
5.
an enforceable arrangement in accordance with § 4 (2) sentence 2.
