On the basis of § 3 (1) Nos. 1, 3, 6, 11 and 15 of the Plant Protection Act, as amended by the Notice of 2 October 1975 (BGBl. I p. 2591, 1976 I p. 1059) is decreed in agreement with the Federal Minister for Youth, Family and Health with the approval of the Federal Council: Unofficial table of contents

§ 1

Authorized and owner of tobacco plants are obliged to give the competent authority the occurrence and suspicion of the occurrence of the blueprints disease or its pathogen, the blueprints (Peronospora tabacina Adam), stating of the location, the extent of the plant's population and the origin of the plants, without delay. § 2

Owners of tobacco plants and owners of tobacco are obliged to
1.
Immediately destroy tobacco seedlings which have been infested with the fungal fungus or are suspected of being infected with the bluetonry,
2.
on the order of the competent authority
a)
to destroy tobacco plants infected or suspected of infestation with the bluetonry mushroom,
b)
to destroy the remnates of tobacco plants after the harvesting of tobacco plants,
c)
to combat blue-and-white disease,
3.
To decontaminate the soil and the spaces intended for the cultivation of tobacco plants, unless they are free from the bluetongue fungus,
4.
To keep land on which the bluetonry mushroom has occurred, until the end of the following growing season of tobacco plants.

§ 3

The cultivation and holding of the cyan fungus, as well as the work with this harmful organism, are prohibited. Unofficial table of contents

§ 4

The competent authority may, in individual cases, grant exemptions from
1.
Section 2 (4) for non-infested parts of land,
2.
§ 3 for scientific investigations and experiments and for breeding projects
shall be approved in so far as this does not affect the control of the blue-cap fungus and does not create the risk of spreading this harmful organism. Unofficial table of contents

§ 5

Contrary to the provisions of Section 68 (1) (3) (a) of the Plant Protection Act, who intentionally or negligently acts
1.
Contrary to § 1, the notification shall not, not immediately, not properly or not fully reimbursed,
2.
Contrary to § 2 no. 1, tobacco seedlings are not destroyed immediately,
2a.
an enforceable arrangement in accordance with Section 2 (2),
3.
Contrary to Article 2 (3), the soil or a room is not decontaminated;
4.
Contrary to § 2, no. 4, a plot of land is not kept free of tobacco plants,
5.
Contrary to § 3 the bluetonry mushroom is bred or kept or works with it, or
6.
a fully-enforceable edition connected with a permit pursuant to § 4.

§ 6
