§ 1 Occupational Diseases

Occupational diseases are the diseases referred to in Appendix 1, which have been insured as a result of an activity based on insurance cover in accordance with § 2, 3 or 6 of the Seventh Book of Social Law. Unofficial table of contents

§ 2 Extended insurance cover in companies of the maritime sector

§ 3 Measures to combat occupational diseases, transitional benefit

(1) If there is a risk of an occupational disease being created, resurrected or worsened for insured persons, the accident insurance institutions shall counteract this risk by all appropriate means. However, if the risk is not to be eliminated, the accident insurance institutions shall have the effect of ensuring that the insured persons shall refrain from the activities which are at risk. The authorities responsible for medical employment protection should be given the opportunity to submit their comments. § 4 Participation of the authorities responsible for medical employment protection

(1) The bodies responsible for medical employment protection shall have an effect on the detection of occupational diseases and diseases which are to be recognised in accordance with Article 9 (2) of the Seventh Book of the Social Code, such as occupational diseases, in accordance with the conditions laid down by the 2 to 4. (2) The accident insurance institutions shall inform the authorities responsible for medical occupational safety in writing without delay of the initiation of a detention procedure; the transmission of information shall also apply to the transmission of information. the ad according to § 193 (2) and (7) or § 202 of the Seventh Book of the Social Code. § 5 Fees

§ 6 Reaction

(1) Leiden insured on 1 January 2015 in an illness according to number 1319, 2113, 2114 or 5103 of Appendix 1, the disease shall be recognized upon application as an occupational disease if it has occurred before that day. (2) Leiden insured on 1 July 2009 the disease referred to in point 2112, 4114 or 4115 of Appendix 1 shall be recognised on application as an occupational disease if the insurance case has occurred after 30 September 2002. If insured persons are insured on 1 July 2009 in an illness according to point 4113 of Appendix 1, they shall be recognised as an occupational disease upon application if the insured person has entered into force after 30 November 1997. If insured persons insured on 1 July 2009 suffer from a disease under point 1318 of Appendix 1, the disease must be recognised as an occupational disease upon application if the insurance case has occurred before that date. (3) An insured person is to be insured on the first day of the disease. In the case of an illness referred to in point 4112 of Annex 1, the disease shall be recognised as an occupational disease upon application if the insured person has entered into force after 30 November 1997. The first sentence shall also apply to a disease in accordance with point 2106 of Appendix 1 if it cannot be recognised as an occupational disease already in accordance with the provisions of point 2106 of Appendix 1 in the version entered into force on 1 December 1997. (4) An insured person shall be responsible for the disease. 1 December 1997 on a disease under point 1316, 1317, 4104 (throat cancer) or 4111 of Appendix 1, it shall be recognised on application as an occupational disease if the insurance case has occurred after 31 December 1992. By way of derogation from the first sentence, a disease in accordance with point 4111 of Appendix 1 shall also be recognised as an occupational disease if the disease has already occurred before 1 January 1993 and is known to an accident insurance institution until 31 December 2009 (5) If an insured person suffered from a disease on 1 January 1993, which was only due to the Second Regulation amending the Occupational Diseases Regulation of 18 December 1992 (BGBl. 2343), the disease must be recognised as an occupational disease upon application if the insurance case occurred after 31 March 1988. (6) If an insured person had suffered from a disease on 1 April 1988, which is only due to the Regulation amending the Occupational Diseases Regulation of 22 March 1988 (BGBl. 400) may be recognised as an occupational disease, the disease must be recognised upon application as an occupational disease if the insurance case has occurred after 31 December 1976. (7) Binding decisions and final decisions shall be taken by the Recognition as an occupational disease in accordance with paragraphs 1 to 6 shall not be accepted. Benefits shall be provided retroactively for a maximum period of up to four years; the period shall be expected from the beginning of the year in which the application has been made.
