§ 1 Legal form of the Foundation

Under the name "Otto-von-Bismarck-Stiftung" a legal foundation under public law is established in Aumühle-Friedrichsruh. The Foundation shall be established with the entry into force of this Act. Unofficial table of contents

§ 2 Purpose of the Foundation

(1) The purpose of the Foundation is to preserve the memory of the work of the statesman Otto von Bismarck, to collect and manage his remission and to evaluate the interests of the general public in culture and science, education and politics. (2) The implementation of this purpose shall in particular:
1.
Establishment and maintenance of a memorial site in Aumühle-Friedrichsruh; accessible to the public;
2.
Acquisition, maintenance and expansion of the Bismarck Library and the Bismarck Archive;
3.
Establishment and maintenance of a research and documentation centre in Aumühle-Friedrichsruh;
4.
Publication of archival holdings and scientific studies;
5.
Events in the sense of the purpose of the foundation.

§ 3 Foundation assets

(1) With the entry into force of this Act, the Foundation shall pass on:
1.
the immovable and movable property acquired by the Federal Republic of Germany for the independent Otto von Bismarck Foundation; and
2.
the rights arising from the archives and library stocks referred to in the loan contract of 14 November 1994 between Ferdinand von Bismarck and the Federal Republic of Germany.
(2) The Foundation is entitled to accept donations from third parties. (3) In order to fulfil the purpose of the foundation (§ 2 para. 1), the foundation receives an annual grant from the federal government in accordance with the respective federal budget. (4) Foundation assets and other income shall be used only in the sense of the purpose of the foundation. Unofficial table of contents

§ 4 Statute

The Foundation has a statute that is decided by the Board of Trustees by a majority of four fifths of its members and requires the approval of the Federal Government Commissioner for Affairs of Culture and the Media. The same shall apply to amendments to the Articles of Association. Unofficial table of contents

§ 6 Kuratorium

(1) The Board of Trustees consists of five members, who are appointed by the Federal President for a period of five years. Two members are proposed by the Federal Government and the heirs of Otto von Bismarcks; the fifth member will select the Federal President. A representative shall be ordered in the same way for each of the five members. Repeated order is permissible. (2) If a member of the board of trustees or his representative prematurely departs, an appointment of the successor may be effected only for the remainder of the time for which the member or the representative was appointed. (3) The Board of Trustees elects a chairperson and his deputy. (4) The Board of Trustees decides on all fundamental issues that are part of the Foundation's remit. § 7 Executive Board

(1) The Executive Board shall consist of three members. They are appointed by the Board of Trustees by a majority of four fifths of its members, including a board member on a proposal from the Federal Government Commissioner for Culture and the Media Affairs. The statutes may stipulate that the member proposed by the Federal Government Commissioner for Culture and the Media shall be the Chairman of the Board of Directors. (2) The Board of Executive Directors shall implement the decisions of the Board of Trustees and shall implement the Business of the Foundation. He represents the Foundation in court and out of court. § 8 Next and honorary activities

The members of the Board of Trustees and the Board of Management are acting on a voluntary basis, insofar as they are not acting on a side-by-side basis. Unofficial table of contents

§ 9 Supervision, budget, audit

(1) The Foundation is subject to the supervision of the Federal Government Commissioner for Cultural Affairs and the Media. In carrying out its tasks, the Foundation is supported by the Federal Archives (and the Prussian Cultural Heritage Foundation); the Federal Government Commissioner for Culture and the Media regulates the nature and extent of the tasks in consultation with the Federal Government. § 10 Employees

(1) The activities of the Foundation are usually carried out by employees (employees and workers). (2) The employees of the Foundation are the collective agreements and other provisions applicable to employees of the Federal Government. (3) The Foundation may be granted the right to have officials by means of a statutes. Unofficial table of contents

§ 11 Fees

The Foundation may charge fees for the use of foundation facilities in order to cover the administrative burden following the detailed provision of the Articles of Association. Unofficial table of contents

§ 12 Service Seal

Section 13 Entry into force

This Act shall enter into force on the day after the announcement.
