§ 1 General provisions

Type-approval, installation and function test provisions and a declaration of conformity as provided for in this Regulation are equivalent to:
1.
Type-approvals for the equipment referred to in § § 2 to 4 and 6,
2.
the requirements to be taken in the case of a type-approval of the installation and the function test in accordance with § 5,
3.
Declarations of Conformity according to § 7,
based on the requirements of a Directive of the European Community or of the European Union, as set out in the following provisions, or by the Regulations adopted by the Central Commission for the Navigation of the Rhine legislative act of another Member State of the European Union or of a Contracting State of the Revised Rhine Navigation Act of 17. § 2 equivalent type-approvals for engines in accordance with Chapter 8a of Annex II or Article 4, Chapter 8a of Annex XII

Type-approvals shall be deemed to be equivalent to type-approvals referred to in Annex II, Chapter 8a, or Annex XII, Article 4, Chapter 8a
1.
Directive 97 /68/EC of the European Parliament and of the Council of 16 December 1997 on the approximation of the laws of the Member States relating to the measures to be taken against the emission of gaseous and particulate pollutants from the Member States Internal combustion engines for non-road mobile machinery (OJ L 327, 1), as last amended by Directive 2011 /88/EU (OJ L 327, 27.12.2011, p. OJ L 305, 23.11.2011, p.
2.
Chapter 8a of Decision 2001-I-19 of the Central Commission for the Navigation of the Rhine-Provisions in the Rhine Navigation Ordination for the Restriction of exhaust emissions from diesel engines in the Rhine waterway of 11 May 2000 in conjunction with Decision 2001-I-21-Regulations on the limitation of exhaust emissions from diesel engines in the Rhine waterway-Long-term implementation of Stage II of 31 May 2001

Stage I shall be deemed to be equivalent to the period referred to in Section 8a.02 of Annex II, Section 24.02 and 24.06, in each case.

The category in question shall be deemed to be equivalent only to the period of validity mentioned in the Directive. With regard to the transitional provisions of Sections 24.02 and 24.06 of Annex II, in each case under § 8a.02, type-approvals shall be deemed to be equivalent only if the limit values of the respective stage are comparable to those of the applicable levels of the RheinSchUO.

§ 3 equivalent type-approvals for navigation radar systems in accordance with Annex II, Appendix M, Part I, or Annex IX, Part I

Type-approvals shall be deemed to be equivalent to type-approvals referred to in Annex II, Appendix M, Part I, or Annex IX, Part I,
1.
Annex IX, Part III, of Directive 2006 /87/EC of the European Parliament and of the Council of 12 December 2006 laying down technical requirements for inland waterway vessels and repealing Council Directive 82/714/EEC (OJ L 378, 27.12.2006, p. OJ L 389, 30.12.2006, p.1), or
2.
Annex M Part I of the Rhine Navigation Subsearch Regulations of Decision 2008-II-11 amending the Rhine Navigation tspolis Ordinance and the Rhine Navigation Ordinance with regard to the minimum requirements and the conditions for testing for Navigation radar systems and turning indicators in the navigation of the Rhine as well as their installation for adaptation to European directives on electromagnetic compatibility as well as relevant European and worldwide standards and the reorganization of the regulations of the Central Commission of 27 November 2008 and in accordance with Decision 1989-II-33 of Central Commission for the Navigation of the Rhine to the provisions relating to the minimum requirements and conditions for testing of navigation radar systems in the Rhine navigation system of 19 May 1989, exclusively for the provisions of Chapter 24 of Annex II to the Annex II and Article 6 (2) of Annex XII,

§ 4 equivalent type-approvals for turning indicators in accordance with Annex II, Appendix M, Part II or Annex IX, Part II

Type-approvals shall be deemed to be equivalent to type-approvals referred to in Annex II, Appendix M, Part II, or Annex IX, Part II.
1.
Annex IX, Part IV, of Directive 2006 /87/EC of the European Parliament and of the Council of 12 December 2006 laying down technical requirements for inland waterway vessels and repealing Council Directive 82/714/EEC (OJ L 378, 27.12.2006, p. OJ L 389, 30.12.2006, p.1), or
2.
Annex M, Part II of the Rhine Navigation Ordinance of Decision 2008-II-11 amending the Rhine Navigation Ordinance and the Rhine Navigation Ordinance with a view to the minimum requirements and the conditions for testing Navigation radar systems and turning indicators in the navigation of the Rhine as well as their installation for adaptation to European directives on electromagnetic compatibility as well as relevant European and worldwide standards and the reorganization of the regulations of the Central Commission of 27 November 2008 and in accordance with Decision 1989-II-34 of the Central Commission for the Navigation of the Rhine to the provisions relating to the minimum requirements and conditions for the inspection of the reversing indicator in the Rhine navigation of 19 May 1989, which shall apply exclusively to the provisions of Chapter 24 of Annex II and to the provisions of Chapter 24 of Annex II to the Convention. Article 6 (2) of Annex XII shall apply,

§ 5 equivalent provisions for the installation and function testing of navigation radar systems and turning indicators in accordance with Annex II, Annex M, Part III or Annex IX, Part III

The provisions relating to the implementation of the following shall be considered to be equivalent to the provisions for the installation and testing of navigation radar systems and turn indicators in accordance with Annex II, Annex M, Part III or Annex IX, Part III:
1.
Annex IX, Part IV, of Directive 2006 /87/EC of the European Parliament and of the Council of 12 December 2006 laying down technical requirements for inland waterway vessels and repealing Council Directive 82/714/EEC (OJ L 378, 27.12.2006, p. OJ L 389, 30.12.2006, p.1), or
2.
Annex M, Part III of the Rhine Navigation Ordinance of Decision 2008-II-11, amending the Rhine Navigation tspolis Ordinance and the Rhine Navigation Ordinance with a view to the minimum requirements and the conditions for testing Navigation radar systems and turning indicators in the navigation of the Rhine and their installation for adaptation to European directives on electromagnetic compatibility as well as relevant European and worldwide standards and the reorganisation of the regulations of the Central Commission of 27 November 2008 and Decision 1989-II-35 of the Central Commission for the Navigation of the Rhine with regard to the rules for the installation and functioning of navigation radar systems and reversing indicators in the Rhine navigation of 19 May 1989, exclusively for the purposes of the provisions of Annex II, Chapter 24 and Annex XII, Article 6 (2),

§ 6 equivalent type-approval of onboard treatment plants in accordance with the provisions of Annex II, Chapter 14a

As equivalent to type-approvals according to Annex II, Chapter 14a, type-approvals pursuant to Chapter 14a of Decision 2010-II-27 shall apply by way of arrangements of temporary nature to the table of contents, Chapter 14a, Section 15.14, point 1, section 24.02, point 2 Transitional provisions relating to § 14a.02 (2), Table 1 and 2, point 5, § 24.06 (5) Transitional provisions on § 14a.02 (2), Table 1 and 2, point 5, annexes Q, R and S of the Rhine Navigation Ordinance of 8 and 9 December 2010, in compliance with of the periods of validity. § 7 equivalent declarations of conformity in accordance with the provisions of Annex IX, Part I, section 5, paragraph 3

Conformance declarations shall be deemed to be equivalent to declarations of conformity in accordance with Annex IX, Part I, section 5 (3),
1.
Annex IX to Directive 2006 /87/EC of the European Parliament and of the Council of 12 December 2006 laying down technical requirements for inland waterway vessels and repealing Council Directive 82/714/EEC (OJ L 378, 27.12.2006, p. OJ L 389, 30.12.2006, p.1), or
2.
Directive 1999 /5/EC of the European Parliament and of the Council of 9 March 1999 on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity (OJ L 197, 21.7.1999, p. OJ L 91, 7.4.1999, p. 10),
3.
Annex M to the Rhine Navigation investigation order of the Decision 2008-II-11 amending the Rhine Navigation Ordinance Ordinance and the Rhine Navigation Ordinance with regard to the minimum requirements and test conditions for navigation radar systems and turning indicators in the navigation of the Rhine and its installation in order to adapt it to European directives on electromagnetic compatibility, as well as relevant European and global standards and to restructure the rules of the Central Commission of 27 November 2008.
