Article 1
General

1.
In the case of vehicles applying for a Community certificate, Annex II, except for the provisions referred to in paragraph 2, shall be subject to the measures resulting from the following provisions:

Article 2
Definitions

1.
By way of derogation from Annex II, the following definitions shall apply:

Section 1.01 of Annex II shall apply with the proviso that:
a)
Points 62 and 82 shall be applied in the following text:
62.
"draught" ("T") the vertical distance from the lowest point of the hull at the bottom edge of the ground floor to the level of the greatest reduction of the hull in m without taking into account a keel or other fixed annexes;
82.
"recognised classification society" means a classification society which has been recognised in accordance with the criteria and the procedure laid down in Annex VII to Directive 2006 /87/EC; the list of recognised classification societies shall contain Annex VII.
b)
to apply the following ship-related term: "draught above all" ("TOA") the vertical distance from the lowest point of the hull at the bottom edge of the ground floor to the level of the largest reduction of the hull in m, including a keel or other fixed appendices.

Article 3
Transitional Derogations

1.
Annex II, Section 24.02, point 2, shall apply with the proviso that the following transitional provisions shall apply in connection with Section 7.02 of Annex II in conjunction with Article 4:

Article 4
Differing minimum requirements for Annex II for waterways in zones 1 to 4

Section 1.03 Community certificate

Vehicles in accordance with § 1.02 (1) and (2) must have a Community certificate issued by a competent authority of one of the Member States within the scope of Directive 2006 /87/EC. Unofficial table of contents

§ 1.06 Order of temporary nature

Temporary arrangements may be adopted in accordance with the procedure referred to in Article 19 (2) of Directive 2006 /87/EC when it appears necessary to adapt to the technical development of inland waterway transport, in urgent cases To allow for derogations from the provisions of this Directive prior to the expected modification of the Directive or to allow any attempts to be made. § 1.07 Service Instructions

In order to facilitate and standardise the application of this Regulation, binding administrative provisions may be adopted in accordance with the procedure for the investigation referred to in Article 19 (2) of Directive 2006 /87/EC. Unofficial table of contents

§ 4.04 Einsenkungsmarken

1.
The level of the largest reduction shall be determined in such a way as to comply with the rules on the minimum freeboard and the minimum safety margin. For safety reasons, the Commission of Inquiry may set a greater safety margin or a freeboard. The level of the greatest sinking shall be fixed at least for zone 3.
2.
The level of the largest depression is marked by easily visible and inexorable countersunk marks.
3.
Classification marks for zone 3 shall consist of a rectangle of 300 mm length and 40 mm height, the base line of which is horizontal and coincides with the level of the approved largest depression. Such a rectangle must be contained in other types of countersunk marks.
4.
Ships must have at least three pairs of countermarks, one pair of which must be placed at about 1/2 L and the other two approximately to 1/6 L behind the bow and in front of the rear. By way of derogation
a)
in the case of ships with L less than 40 m, two pairs of marks, to be fitted on a 1/4 L behind the bow and in front of the rear;
b)
in the case of ships which are not intended for the carriage of goods, a pair of marks, which shall be affixed approximately to 1/2 L.
5.
The entry marks or information which have become invalidated as a result of a new investigation must be removed or marked as invalid under the supervision of the Commission of Inquiry. Insignificant entry marks may only be replaced under the supervision of a commission of inquiry.
6.
Where the vessel has been calibrated in accordance with the 1966 Convention relating to the calibration of inland waterway vessels, and the calibration marks are at the same level as those prescribed in this Directive, these calibration marks shall also be considered as: Countermarks; an appropriate note shall be entered in the Community certificate.
7.
For ships operating on inland waterways in zones other than Zone 3, the front and rear pairs of countermarks referred to in point 4 shall be supplemented by a vertical line, an additional line or a further line for the other zones. Zones several additional lines of the sinking with a length of 150 mm, which shall be attached or attached in relation to the countersunk mark for zone 3 after the bow of the ship. § 4.05 Maximum permissible countersinking of the ships, whose cargo spaces are not always closed to spray water and weathertight

§ 7.02 Free view

1.
From the control level, there must be sufficient free view on all sides.
2.
The shadows in front of the bow of the empty ship with half the stocks and without ballast shall not exceed 250 m or 2 ship lengths for the rudder commuters up to the water surface, whichever is the lower. Optical and electronic aids for shortening the viewing shadow must not be taken into account during the investigation. Only suitable electronic aids may be used for further shortening of the visual shadow.
3.
The free field of view of the place where the rowing worker is usually located must be at least 240 ° of the horizon. This has to be a field of view of at least 140 ° within the front semicircle. In the usual viewing axis of the rowing worker, no window posts, supports or superstructures may be located. If an open field of view of 240 ° or more does not guarantee sufficient free visibility to the rear, the Commission of Inquiry may require additional measures, in particular the installation of suitable optical or electronic devices. Aid. The height of the lower edge of the side windows must be as small as possible and the height of the upper edge of the side windows and the windows on the rear side must be as large as possible. In determining whether the requirements of this Article are fulfilled in the free view of the tax house, it must be assumed that the eye level of the rowing worker is 1650 mm above the deck at the control level.
4.
The upper edge of the bugs-side control house windows must be high enough to provide a person at the control level with an eye height of 1 800 mm in free view, which still reaches at least 10 degrees over the horizontal plane on an equal footing.
5.
The clear view through the front windows must be guaranteed by appropriate means in any weather conditions.
6.
Window panes used in control houses must be made of safety glass and have a minimum light transmission of 75%. In order to avoid reflexes, the front command back windows must be reflex-free or be used in such a way that reflexes are effectively excluded. This requirement is met when the windows are inclined towards the vertical plane and are placed at the top by at least 10 degrees and at most 25 degrees.

§ 7.05 Signal lights, light signs and sound signs

1.
.In this Annex,
a)
Signal lights: Topplichter, side lights, rear lights, lights visible from all sides, blue sparkle lights, yellow fast strong sparkellights for fast ships and blue lights for the transport of dangerous goods;
b)
Light sign: the lights belonging to the sound signs and the blue board.
2.
For the control of the signal lights, current lamps or equivalent devices such as alarm lamps must be installed in the wheelhouse, provided that this control is not directly possible from the control house.
3.
In the case of radar one-man control benches, the signal lights and the light signals must be installed at the control level for the control of the signal lights and the light signals. The switches of the signal lights must be integrated into the reporting lights or be located in the immediate vicinity of the reporting lights and must be clearly assigned to the latter. The arrangement and colour of the signalling lights of the signal lights and the light signs must correspond to the actual position and colour of the switched signal lights and light signs. The failure of a signal light or a light signal must cause the extinguishing of the corresponding message light or be signalled in some other way by the corresponding reporting light.
4.
In the case of radar one-man control stands, the sound signals must be given by foot switches. This does not apply to the "Bleib-weg-Signal" according to the provisions of § 2 (1) (3) of this Regulation in accordance with the shipping-law provisions.
5.
Signal lights must meet the requirements of Part I of Annex IX.

Chapter 8a
Regulations for the installation of type-tested engines in vehicles

Section 8a.01 Definitions

For the purposes of this provision:
1.
"competent authority" means the Central Office of the Vessel Investigation Commission/Shipyards at the South-West Water and Shipping Directorate;
2.
"engine" means a motor which operates on the principle of compression ignition (diesel engine);
3.
"vehicle drive motor" means a motor which is installed as a main or auxiliary drive in a vehicle;
4.
"vehicle auxiliary engine" means a motor which is not used as a vehicle drive motor for the special applications in machinery on board a vehicle;
5.
"replacement engine" means a used engine which is to replace a motor in operation and which is of the same type as the engine to be replaced, has the same number of cylinders and the power and speed of which are not more than 10% of the engine to be replaced;
6.
"Type-approval" means the decision taken pursuant to § 3 of the Inland Waterway Exhaust Emission Regulation of 20 August 2005 (BGBl. 2487), as amended by the relevant version, confirms that a motor type, engine family or group of engines with regard to the level of emission of gaseous and particulate pollutants from the engine comply with the technical requirements of the Inland Waterway Exhaust Emission Regulation;
7.
"installation test" means the procedure whereby the competent authority ensures that the engine installed in a vehicle, even after any changes and/or adjustments made since the granting of the type-approval, has been made with regard to the level of the engine Emission of gaseous and particulate pollutants shall satisfy the technical requirements of this Regulation and the requirements of the Inland Waterway Exhaust Emission Regulation;
8.
"intermediate examination" means the procedure by which the competent authority ensures that the engine operated in a vehicle, even after any changes and/or adjustments made since the installation has been carried out, shall be subject to the level of the emission of gaseous and particulate pollutants shall comply with the technical requirements of this Regulation and the provisions of the inland waterway exhaust emission regulation;
9.
"special examination" means the procedure by which the competent authority ensures that the engine operated in a vehicle is also subject to any significant change in the level of the emission of gaseous and air pollutants Particulate matter satisfies the technical requirements of this regulation and the requirements of the inland waterway exhaust emission regulation;
10.
"engine group" means a summary of engines defined by a manufacturer in accordance with Annex 1, Part I and approved by the competent authority in accordance with Article 3 of the Inland Waterway Exhaust Emission Regulation, and the characteristics similar to those of the design as regards the level of emission of gaseous and particulate pollutants, and comply with the requirements of this Regulation and the requirements of the Inland Waterway Emission Regulation, with the following: Setting or modification of individual engines after type testing in shall be permitted;
11.
"engine parameter protocol" means the document according to Annex 8, Part II, in which all parameters, including components (components) and engine settings, which are the level of the emission of gaseous pollutants and particulate pollutants of the engine influence, including their changes, recorded;
12.
"Guidance of the engine manufacturer to control the exhaust gas-relevant components and engine parameters" the document produced for the purpose of carrying out the installation, intermediate or special tests. In this manual, which shall be drawn up by the engine manufacturer and approved by the competent authority, the components and settings and parameters relevant to the exhaust gas shall be specified, the use of which shall be used and the compliance with which shall be carried out by the continuous fulfilment of the emission limit values; it must contain at least the following:
a)
an indication of the engine type, specifying the nominal power and rated speed;
b)
List of components and engine parameters relevant to exhaust gas;
c)
Unique characteristics for the identification of the approved exhaust-gas-relevant components (e.g. (b) component numbers on the components);
d)
Indication of the exhaust gas-relevant engine parameters, such as adjustment ranges of the injection time, the permissible cooling water temperature, the maximum exhaust gas back pressure;
in the case of engines with exhaust-gas aftertreatment systems, this guidance must also include a part on the basis of which control of the proper functioning of these systems can be carried out;
13.
"Directive" Directive 97 /68/EC of the European Parliament and of the Council of 16 December 1997 on the approximation of the laws of the Member States relating to measures to combat the emission of gaseous and particulate pollutants Particulate matter of internal combustion engines for non-road mobile machinery (OJ L 327, EC No OJ L 059 of 27 February 1998) as last amended by Directive 2004 /26/EC of 21 April 2004 (OJ L 059, 27.2.2004, p. EU L 146 of 30 April 2004, corrected OJ L 327, 28.4.2004, p. EU L 225 of 25 June 2004), implemented by the Inland Waterway Exhaust Emission Regulation of 20 August 2005 BGBl. I p. 2487.
14.
"Rheinschiffsuntersuchungsordnung (RheinSchUO)" (Rheinschiffsuntersuchungsordnung (RheinSchUO)) " the Rhine ship examination regulations adopted by the Central Commission for the Navigation of the Rhine, which pursuant to § 1 (8) in conjunction with Annex II of this Regulation on the Rhine in the Federal Waterway in Force is set.

§ 8a.02 Basic Rule

The following general provisions shall apply to all engines:
1.
The provisions shall apply to all engines with a rated power (PN) of 19 kW or more fitted in vehicles or in machinery on board. Without prejudice to the provisions of point 2 and paragraph 3, Article 7a (1) and (5) of the Directive shall also apply to limit values and type-approval for motor vehicle engines with a nominal output of more than 37 kW. Excluded from this are:
a)
Vehicle propulsion and vehicle auxiliary engines of the following categories in accordance with section 4.1.2.4 of Annex I to the Directive:
aa)
Auxiliary vehicle engines with a constant speed and with a nominal output greater than 19 kW and less than 37 kW, which shall be up to 31 December 2006;
bb)
V1: 1 to V1:3, which shall be up to 31 December 2006;
cc)
V1: 4 and V2: 1 to V2:5, which will be up to 31 December 2008;
b)
engines complying with the limits laid down in stage I of Annex XIV to the Directive and until 30 June 2007;
c)
Replacement engines, which until 31 December 2011
were installed in vehicles or machines on board. In addition, replacement engines must have been installed in vehicles which were in operation until 31 December 2007.
2.
The engines shall not exceed the emission limit values laid down in the Directive for carbon monoxide (CO), hydrocarbons (HC), nitrogen oxides (NOx) and particulate matter (PT).
3.
Compliance with the emission limit values for an engine type, engine group or engine family shall be verified by type-approval granted in accordance with paragraph 3. A copy of the type-approval certificate and the engine parameter protocol shall be carried on board.
4.
The following shall apply to the carrying out of the installation tests:
a)
After the engine has been installed on board, but before it is put into service, an installation test will be carried out. This test, which is part of the initial investigation of the vehicle or of a special investigation resulting from the installation of the engine in question, shall either lead to the entry of the engine into the passenger certificate or to the driver's certificate to be issued for the first time. Modification of the existing travel certificate.
b)
The competent authority may waive the installation test referred to in point (a) if an engine with a PN rated power of less than 130 kW is replaced by a motor with the same type-approval. The condition is that the owner of the vehicle or his authorised representative shall replace the engine with a copy of the type-approval certificate and the identification number of the newly installed engine of the competent authority. shall be communicated. c)

Intermediate tests of the engine must be carried out as part of the post-examination.
6.
After any substantial modification of an engine which affects the emission of gaseous pollutants and particulate pollutants in the engine, a special test must always be carried out.
7.
The type-approval numbers and the identification numbers of all engines installed on board a vehicle, which are subject to the requirements of this provision, shall be indicated by the competent authority in the travel certificate.
8.
The competent authority may use a technical service to carry out tasks in accordance with this provision.

§ 8a.03 Type approvals

1.
The following type-approvals are to be recognised, provided that the engine application is covered by the type-approval:
a)
Type-approvals according to the Directive;
b)
Type-approvals according to Chapter 8a of the Rhine Navigation Ordination;
c)
Type-approvals which are recognised as equivalent in accordance with Annex XII to the Directive or under Article 8a.07 of the Rhine Navigation Ordination.
2.
The assignment of the engine application to the test in accordance with type-approval procedures shall be made on the basis of the following table.

§ 8a.04 Special motor applications

1.
Engines intended for use in the on-board operation for more than one engine application shall be treated as follows:
a)
Auxiliary vehicle engines which drive machinery which may be assigned to both engine applications III and IV of the table referred to in paragraph 3 shall have type-approval for each corresponding application in accordance with this table.
b)
Motor vehicle main engines driving additional machinery shall have only the type-approval required for each type of main drive in accordance with the table referred to in paragraph 3, provided that the main application of the engine of the vehicle propulsion system is. If the proportion of the secondary application is more than 30%, the engine must also have a secondary application type-approval in addition to the type-approval of the main propulsion application.
2.
Bow jet propulsion,
a)
directly or via a generator with variable speed and load, the table referred to in paragraph 3 may be assigned to engine applications I and IV;
b)
Driven by a constant speed generator, the table referred to in paragraph 3 can be assigned to engine applications II, III and IV.
3.
The engines must be installed with the power approved by the type-approval, which must be indicated on the engine with the type marking. However, they do not necessarily have to drive units or machines of the same power consumption. Performance may be reduced by external actions to the performance necessary for the application.

§ 8a.05 Installation, interim and special tests

1.
The competent authority shall, on the occasion of the installation verification referred to in paragraph 2 (4), examine the current state of the engine in respect of the engine parameter protocol, in the case of interim tests referred to in paragraph 2 (5) and in the case of special tests referred to in paragraph 2 (6). Specified components, settings and parameters on the basis of the control instructions given by the manufacturer. If it comes to the conclusion that the engine does not match the type-approved engine type, type-approved engine family, or type-approved engine group, it may be
a)
require that the conformity of the engine be restored, that the type-approval be amended in accordance with the provisions to be observed in accordance with paragraph 3; or
b)
Order a measurement of actual emissions.
If the conformity of the engine is not restored, or if the type-approval is not amended accordingly, or if the measurements show that the emissions do not comply with the limit values, the competent authority shall refuse to issue a Certificate of driving licence or accepts the technical approval for transport and requires the return of the already issued travel certificate or declares it invalid.
2.
In the case of engines with exhaust gas aftertreatment system, the function of the exhaust gas aftertreatment system must be checked in the context of the installation, intermediate or special testing.
3.
The installation of the engine in vehicles may be carried out only in accordance with the conditions of use and the conditions laid down in the type-approval, which have been laid down in connection with the scope of the type-approval. In addition, the intake underpressure and the exhaust gas back pressure must not exceed the values specified for the approved engine.
4.
In the case of engines belonging to a motor family, the installation on board of such engines shall not include any adjustment or modification which might affect the emissions of the exhaust gas and particulate matter or which may be outside the range of adjustment envisaged are to be carried out.
5.
In the case of engines belonging to a group of engines, adjustments or modifications which may be allowed in accordance with the type test may be carried out on board or on board.
6.
If adjustment changes or modifications have been made to the engine after the type-approval, these are to be noted in the engine parameter log.
7.
The competent authority may reduce the scope of the installation or intermediate test for a motor for which type-approval has been granted. § 8a.06 Technical Services

1.
The technical services must comply with the European standard on the general requirements for the competence of testing and calibration laboratories (DIN EN ISO/IEC 17025: 2000) in compliance with the following conditions:
a)
Motor manufacturers cannot be recognised as technical services.
b)
For the purposes of this provision, a technical service may, with the agreement of the competent authority, use facilities outside its own testing authority.
2.
Technical services must demonstrate, at the request of the competent authority, that they are recognised within the European Union for activities under this provision. Services in third countries may only be designated as a recognised technical service within the framework of a bilateral or multilateral agreement between the European Union and the third country.

§ 10.03 Portable fire extinguisher

1.
A portable fire extinguisher must be available in accordance with the European Standard EN 3:1996 in the following places:
a)
in the tax house;
b)
in the vicinity of each entrance from deck to living room;
c)
in the vicinity of each entry to non-residential premises where heating, cooking or cooling facilities are located which consume solid or liquid fuels or liquefied petroleum gas;
d)
at each entrance to machinery and boiler rooms;
e)
at appropriate places in the sub-deck of machinery and boiler rooms, such that the path to a fire extinguisher is not more than ten metres from any point of the room.

§ 15.09 Rescue equipment

1.
In addition to the rescue rings referred to in § 10.05 (1), suitable rescue rings must be provided on each side of the deck at a maximum distance of 20 m on each of the non-closed parts of the decks intended for passengers. Rescue rings shall be deemed to be suitable if they comply with the following provisions:

, or to the 1974 International Convention for the Safety of Life at Sea (SOLAS 1974), Chapter III, Rule 7.1, and the International Rescue Agent (LSA) Code, paragraph 2.1.
One half of all mandatory rescue rings must be provided with a minimum of 30 m long, floatable lees of 8 to 11 mm in diameter. The other half of the prescribed rescue rings must be provided with a self-igniting, battery-powered and water-non-extinguishing light.
2.
In addition to the rescue rings referred to in point 1, individual rescuers shall be available for all members of the on-board personnel in accordance with § 10.05 Nr 2. The members of the on-board personnel who do not carry out any tasks in accordance with the safety role shall also be permitted to use solid or semi-automatic inflatable lifejackets in accordance with the standards referred to in § 10.05 (2).
3.
Passenger ships shall be equipped with appropriate facilities enabling persons to transfer safely from board to water, to the shore or on board of another vehicle.
4.
In addition to the rescue funds referred to in paragraphs 1 and 2, the maximum number of passengers must be 100% of the maximum number of individual rescuers in accordance with § 10.05 No. 2, with solid or semi-automatic inflatable lifejackets also being provided in accordance with the the standards referred to in Article 10.05 (2).
5.
Collection rescue equipment is a vessel according to Article 10.04 as well as rescue rafts. Life rafts must be
a)
have a label indicating the intended use and the number of persons for which they are appropriate,
b)
provide sufficient space for the number of persons allowed to sit in the seats,
c)
have a lift in fresh water of at least 750 N per person,
d)
may be provided with a rope connected to the passenger ship in order to avoid the removal of the rope,
e)
are made of suitable materials and are resistant to oil and oil products and to temperatures of up to 50 ° C,
f)
take and maintain a stable floating position and have suitable holding devices for the specified number of persons,
g)
Retroringly orange or permanently attached retro-radiating, visible surfaces of at least 100 cm 2 .
h)
be able to be released from their place of installation quickly and safely by a person, or be able to float freely, and
i)
shall be provided with appropriate equipment from the evacuation areas in accordance with section 15.06, point 8, in the life rafts if the vertical distance between the deck of the evacuation surfaces and the area of the largest depression is greater than 1 m.
6.
Additional collection devices are equipment that enable the buoyant movement of several people in the water. You must:
a)
have a label indicating the intended use and the number of persons for whom they are appropriate;
b)
have a lift in the fresh water of at least 100 N per person;
c)
are made of suitable materials and are resistant to oil and oil products and to temperatures of up to 50 °C;
d)
take and maintain a stable floating position and have suitable holding devices for the specified number of persons;
e)
Retroringly orange or permanently attached retro-radiating, visible surfaces of at least 100 cm 2 and have
f)
be allowed to be overboard quickly and safely by a person or be freely swimmable.
7.
Inflatable collective rescuers must also:
a)
consist of at least two separate air chambers;
b)
can be inflated automatically or by hand-release in the case of water supply, and
c)
in the case of each occurring load, even if only half of the air chambers are inflated, maintain and maintain a stable floating position.
8.
The rescue equipment must be placed on board in such a way that it can be easily and safely reached if necessary. Hidden storage places must be clearly marked.
9.
The rescue equipment must be tested in accordance with the manufacturer's instructions.
10.

§ 17.03 Other provisions

1.
A general alarm system must be present on floating devices on which persons are present during the operation. The alarm signal must be clearly different from other signals and produce a sound pressure level in all the apartments and at all workplaces, which is at least 5 dB (A) higher than the local maximum noise level. The alarm system must be able to be triggered in the tax house and at the most important operating points.
2.
Work equipment must have sufficient strength for its load and must comply with the provisions of the Machinery Ordinance of 12 May 1993 (BGBl I 1993, p. 704), as last amended by Article 1 of the Ordinance of 18 June 2008 (BGBl. I p. 1060).
3.
The stability and strength of the work equipment and, where appropriate, the fastenings thereof shall be such that they may withstand stresses arising from the expected heel, trim and movements of the floating device.
4.
If loads are lifted by means of lifting devices, the maximum permissible load resulting from stability and strength must be placed on a panel on the deck and clearly visible at the operating points. If the lifting capacity can be increased by the coupling of additional floating bodies, the values must be given with and without additional flotation bodies.

§ 22a.05 Additional requirements

1.
Vehicles with L of more than 110 m
a)
Have a multi-screw drive with at least two independent drive machines of the same power and a bow blasting system which can be operated by the control house and which is also effective in the case of an unladen vehicle, or via a Single-screw drive and a bow blasting system which can be operated and supplied with its own energy supply and which can be operated by the control house and which is also effective in the case of an unladen vehicle and which, in the event of failure of the main drive, moves from its own power to the vehicle. ,
b)
have a navigation radar system with a turning indicator in accordance with § 7.06 No. 1;
c)
have a permanently installed system of lenzing in accordance with § 8.08;
d)
comply with the requirements laid down in Chapter 2, Section 2.09, point 1.1 of Annex XI.
2.
In the case of vehicles, other than passenger ships, with L of more than 110 m, in addition to the number 1
a)
can be separated in the case of an accident without the use of heavy equipment in the middle third of the vehicle, the separated parts of the ship having to remain floating after the separation,
b)
have a certificate of a recognised classification society with regard to the swimming capacity, the trimming position and the stability of the separate parts of the ship, which must also contain a statement as to the state of charge from which the ship is loaded the ability of the two parts to float is no longer available, in which case the certificate must be carried on board,
c)
are constructed as double-hull vessels according to the ADNR, in which case the ADNR numbers 9.1.0.91 to 9.1.0.95 for motorships, the ADNR numbers 9.3.2.11.7 and 9.3.2.13 to 9.3.2.15 are to be used for tankers,
d)
have a multi-screw drive as defined in point 1 (a), first half-sentence, to be entered in the Community certificate under point 52 that they comply with all the requirements of points (a) to (d).
3.
In the case of a passenger ship with an L of more than 110 m, in addition to the number 1
a)
be built or converted under the supervision of a recognised classification society for the highest class, which must be confirmed by a certificate issued by the classification society, where the current class is not required;
b)
either a double bottom with a height of at least 600 mm and a bulkhead division ensuring that the ship does not plunge below the margin line in the event of flooding of any two adjacent watertight compartments and that the vessel is not submerged in the vessel. a residual safety distance of 100 mm shall be available, or a double floor with a height of at least 600 mm and a double hull with a distance between the side wall of the ship and the longitudinal bulkhead of at least 800 mm;
c)

§ 24.08 Transitional provisions on § 2.18

In the case of vehicles which, after 31 March 2007, were in possession of a valid ship's test in accordance with the Convention on the Navigation of the Rhine, the uniform European ship number already allocated shall be used when a Community certificate is issued. and, if necessary, by default of the digit "0" to be completed.

Section 1 Application of Annex II

§ 2 Exceptions for certain sailing passenger ships

1.
The following provisions shall not apply to sailing passenger ships whose LWL does not exceed 45 m and whose maximum number of passengers is no longer than LWL in whole metres:
a)
Annex II, Section 3.03, point 7, provided that anchors are not driven in plumes;
b)
Annex II, Section 10.02 (2) (d), in respect of length;
c)
Annex II, Section 15.08, point 3, point (a);
d)
Annex II, Section 15.15, point 9 (a).
2.
By way of derogation from point 1, the number of passengers may be increased to 1.5 times the LWL in whole metres if the control and the deck equipment allow this.

§ 3 Stability requirements for ships under sailing

1.
For the calculation of the wrenching moment in accordance with Section 15.03 (3) of Annex II, the weight of the ship's weight shall be determined by taking into account the sails which have been lightened.
2.
Taking into account all the loading cases referred to in Section 15.03 (2) of Annex II, and using a standard control system, the wrecking moment caused by wind pressure shall not be so high that a wrecking angle of 20 ° is exceeded. Where:
a)
for the invoice, a constant wind pressure of 0.07 kN/m 2 shall be applied,

the residual safety distance shall be at least 100 mm, and

§ 4 Requirements for shipbuilding and mechanical engineering

1.
By way of derogation from Section 6.01 (3) of Annex II and Section 9.01 (3) of Annex II, the equipment must be designed for permanent inclinations of the ship up to 20 °.
2.
By way of derogation from Section 15.06 (5) (a) of Annex II and Section 15.06 (9) (b) of Annex II, the Commission of Inquiry into Sailing Passenger Ships, whose length does not exceed 25 m, may, in the case of connecting corridors and staircases, have a smaller clear width than that of Allow 800 mm. However, the measure of 600 mm must not be undershot.
3.
By way of derogation from Section 15.06 (10) (a) of Annex II, the Commission of Inquiry may, in special cases, permit removable railings in the areas where it is necessary for the management of the sailing.
4.
For the purposes of Section 15.07 of Annex II, the sails shall be considered as a main propulsion system.
5.
By way of derogation from Section 15.15 (7) (c) of Annex II, the height of the lower edge of the door shall be reduced to 200 mm above the floor of the passenger compartment. In this case, the door must automatically close after opening and lock.
6.
If the screw can be turned empty during the sailing trip, endangered drive parts are to be protected from damage.

§ 5 Takelage in general

1.
The parts of the rigging are to be arranged in such a way as to avoid an inadmissible sabreer.
2.
Where other materials are used as wood or an exceptional mode of operation, this type of construction must ensure a safety equivalent to the dimensions and strengths laid down in this Chapter. For proof of strength,
a)
a strength calculation shall be drawn up, or
b)
the sufficient strength has been confirmed by a recognised classification society, or
c)
the dimensioning takes place according to a recognized set of rules (e.g. B. Middendorf; Kusk-Jensen).
The evidence must be submitted to the Commission of Inquiry.

§ 6 Masts and round timber in general

1.
All round woods must be made of material of good quality.
2.
Wood for masts must meet the following requirements:
a)
free of Astconcentrations;
b)
free of splint within the prescribed dimensions;
c)
as long as possible;
d)
grew as much as possible.
3.
If the quality level "clear and better" is used as the timber type Pitchpine or Oregonpine, the diameters in the tables of § § 7 to 12 can be reduced by 5%.
4.
If no wood with round cross-section is used for masts, shrubs, crews, trees and bow sprouts, they must have an equivalent strength.
5.
Mast foundations, mast coats, fastenings on the deck, on wrangles or steven must be constructed in such a way that the forces exerted thereon are derived or taken over from other parts connected thereto.

Ropes are preferably equivalent to the rope type 6 × 7 FE in the strength class 1 550 N/mm 2 . The constructions 6 × 36 SE or 6 × 19 FE can be used for the same strength class. 1.

The following provisions shall apply:
a)
for vehicles for which a Community certificate has been issued for the first time before 30 December 2008, and
b)
for vehicles which have been granted a different marketing authorisation before 30 December 2008,
that don't turn on the Rhine.
2.
Vehicles must be shown to comply with the technical requirements of the Inland Waterway Investigation Order on the date of the entry into force of the Community certificate or the other type of transport authorisation on the day of issue of their Community certificate or of the other type of transport authorisation. -have complied with the Regulation.
3.
The Community certificates which have been issued before 30 December 2008 shall remain valid until the date of expiry of the expiry date. Annex II, Section 2.09, No 2 shall remain unaffected.

§ 2 derogations for vehicles already in operation

1.
Without prejudice to § § 3 and 4, vehicles which do not fully comply with the provisions of this Regulation shall comply with the provisions which have been entered into after the first grant of their Community certificate or another type of transport authorisation in accordance with the provisions of be adjusted in accordance with the provisions of Annex II to this Annex.

§ 4 Other derogations

In so far as the application of the provisions referred to in this Article is practically difficult to execute after the expiry of the transitional provisions or which causes unacceptably high costs, the Commission of Inquiry may, on a case-by-case basis, on the basis of Recommendations made by the Committee in accordance with the procedure referred to in Article 19 (2) of Directive 2006 /87/EC allow derogations from those provisions. For a vehicle referred to in Chapters 15, 17 and 21 of Annex II, or in accordance with Article 5 of this Annex, the Community product shall be issued after an examination in accordance with section 2.09 (1), (3) and (4) of Annex II which shall be carried out after the expiry of the ship &apos; s certificate, but at the latest shall be carried out by 30 December 2018 in order to determine whether the vehicle complies with the technical requirements of Annex II in the version of this Annex.

If the vehicle does not comply with the requirements of Chapters 3 to 23 of Annex II with the measures resulting from this Annex, and if the Commission of Inquiry is of the opinion that these inadequacies do not present a manifest danger, the Commission may: The vehicle shall continue to operate until such time as the components or areas of the vehicle shown as inadequate have been replaced or modified in accordance with the requirements of this Regulation. The deficiencies noted are to be noted in the Community certificate under point 52.
3.
A manifest danger shall in particular be deemed to exist where provisions relating to the strength of the construction, the driving or manoeuvring properties or special features of the vehicle of this Annex are affected. Permissible deviations shall not be recorded as inadequacies, which constitute a manifest danger. No manifest danger shall be deemed to exist if, at the time of the last examination, the vehicle has complied with the provisions of the inland waterway search order of the version in force at that date.
4.
The replacement of existing components by identical parts or parts of equivalent technology and design during routine repair and maintenance work shall not be deemed to be a substitute within the meaning of point 2.

These effects must also be taken into account in order to ensure that only engines with similar exhaust emission characteristics are associated with a particular engine group.
1.2
A group of engines shall be defined by other subsequent basic characteristics, in addition to those referred to in Annex I, Section 6 of the Directive, for motor families:
1.2.1
drilling and lifting dimensions;
1.2.2
Methods and design characteristics of the recharging and exhaust systems:
-
constant pressure,
-
pulsating system;
1.2.3
the design characteristics of the combustion chamber, which affect exhaust gas and particulate emissions;
1.2.4
Design characteristics of the fuel injection system, the piston and the injection cam, which can determine the basic characteristics that affect exhaust gas and particulate emissions, and
1.2.5
maximum rated power per cylinder at the maximum rated speed. The maximum range of power reduction within the engine group must be declared by the manufacturer and approved by the competent authority.
1.3
Engines may only be considered as belonging to a motor group if the characteristics referred to in section 1.2 are identical for all relevant engines. However, the competent authority may accept a designation as a motor group if only one of these characteristics does not apply to all engines of an intended engine group. To this end, the engine manufacturer must demonstrate in the information folder that, despite the deviation of one of these characteristics, the exhaust gas and particulate emissions of all engines within the engine group continue to comply with the limit values in accordance with Section 8a (2) no. 2.
1.4
The competent authority may allow the following settings and modifications to engines of a motor group:
1.4.1
Settings for adjustment to the on-board conditions:

Injection timing to compensate for different fuel characteristics,
-
Injection timing for the optimization of the maximum cylinder pressure,
-
different fuel supply to the individual cylinders;
1.4.2
Modifications for engine optimisation for the purpose of use:
-
Turbochargers,
-
Injection pump components:
-
Plunspecifications,
-
Discharge valve specifications,
-
injection nozzles,
-
Cam profiles:
-
Inlet/outlet valve,
-
Injection cam,
-
Combustion space.
1.4.3
Any changes that go beyond the aforementioned settings and modifications shall require a specific justification by the manufacturer and the consent of the competent authority.
1.5
The competent authority shall submit all the documents deemed necessary for the authorisation of the settings and modifications referred to in Section 1.4. The competent authority may also require the repetition of individual or all parts of the type test, the installation or the intermediate testing of the engine.

The engine parameters must be checked and the test results to be documented. The documentation shall be made on separate sheets, which shall be numbered separately, signed by the examiner and attached to this protocol.
0.3 Audit
The exam is based on the instructions (1) of the manufacturer to carry out the control of the components, the adjustable features and the engine parameters. In justified individual cases, the auditor can, according to his own assessment, look at the control of certain engine parameters.
