Chapter 1
General

§ 1.01 General

The crew, which must be on board during the journey, is determined in accordance with Chapter 3 or by the shipyard Ordinance-Rhine and shall be carried out by the Central Office of the ship-examination commission/Shipond in a Certificate of travel certificate or the certificate of the crew referred to in Annex V. The entries in several of these documents are admissible. They must be valid for the respective waterways, and must be carried on board.

Chapter 2
Equipment of the ships with regard to the crew for the journey on the Rhine

Section 2.01 Equipment of the ships with regard to the crew

1.
Without prejudice to the other provisions of this Regulation and in application of Article 3.14 of the shipowners ' Ordinance-Rhine, motorships, drawers, thrust and passenger ships to be operated with the minimum crew shall be subject to one of the following: meet the following equipment standards:
1.1
Default S1
a)
The drive systems must be set up in such a way that the changing of the driving speed and the reversal of the propeller thrust direction can take place from the control position. The auxiliary machinery required for driving must be capable of being switched on and off by the control station, unless this is done automatically or these machines are running uninterrupted during each journey.
b)
In the danger areas
aa)
the temperature of the cooling water of the main engines,
bb)
of the pressure of the lubricating oil of the main engines and the gears,
cc)
of the oil and air pressure of the reversing system of the main engines, the reversing gear or the propeller,
dd)
the filling level of the bilges of the main machinery space
Monitoring shall be ensured by means of equipment which, in the event of malfunction, trigger acoustic and optical alarm signals in the control house. The acoustic alarm signals can be combined in a sound device. They may be deleted as soon as the fault is detected. The optical alarm signals must not be extinguised until the functional disturbances associated with them have been eliminated.
c)
The fuel supply and the cooling of the main engines must be carried out automatically.
d)
The control device must also be able to be handled by a person without a special effort, even if the maximum permissible reduction is permitted.
e)
The visibility and sound marks required by the Rhine Navigation Ordinance of 1 December 1993 for the journey must be able to be issued by the tax base.
f)
If there is no direct communication from the control station to the forship, to the roller coaster, to the apartments and to the machinery spaces, there is a need to provide voice connections. The speech connection can be replaced by an optical and acoustic signalling system to the machine spaces.
g)

i)
Cranks and similar rotating operating parts of hoists may not require a force of more than 160 N for their operation.
k)
The towing winches entered in the ship test must be motorised.
l)
The Lenz and deck washing pumps must be motorized.
m)
The essential operating devices and monitoring instruments must be ergonomically arranged.
n)
The facilities required in accordance with Section 6.01 (1) of Annex II must be able to be remotely operated from the tax base.
1.2
Default S2
a)
for individually moving motor ships:
Standard S1 as well as an additional equipment with a bow blasting system which can be operated from the control stand;
b)
for motor ships which continue to move coupled vehicles:
Standard S1 as well as an additional equipment with a bow blasting system which can be operated from the control stand;
c)
for motor ships that move a thrust assembly consisting of the motor vessel itself and a vehicle in front of it:
Standard S1 as well as an additional equipment with hydraulically or electrically driven clutch winches. However, this equipment shall not be required if the vehicle is equipped with a bow blasting installation at the top of the pusher belt, which is operable from the control stand of the moving motor ship;
d)
for drawers, which move a thrust dressing:
Standard S1 as well as an additional equipment with hydraulically or electrically driven clutch winches. However, this equipment shall not be required if a vehicle is equipped with a bow blasting installation at the top of the pusher belt, which is operable from the control stand of the pushing boat;
e)
for passenger ships:
Standard S1 as well as an additional equipment with a bow blasting system which can be operated from the control stand. However, this equipment is not necessary if the propulsion system and the control device of the passenger ship ensure equivalent maneuvering characteristics.
2.
The compliance or non-compliance with the requirements referred to in point 1.1 or 1.2 shall be noted by the Commission of Inquiry in the ship test in point 47.

Chapter 3
Crew rules for waterways in zones 1 to 4

§ 3.01 General

1.
The crew, which must be on board during the journey, with the exception of the journey on the Rhine, is determined in accordance with § § 3.02 to 3.12 and will be sent from the Central Office of the ship investigation commission/ship's oak office into a Certificate of travel certificate or the certificate of the crew referred to in Annex V. The ship's guide, owner or equipment supplier may, in place of the crew, select the crew in accordance with this chapter, according to the Schiffspersonalverordnung-Rhein. In this case, all provisions of the Schiffspersonalverordnung-Rhine must be complied with with the following exceptions:
a)
To the extent that travel times are mandatory on the Rhine, driving times in inland waterway transport are sufficient.
b)
To the extent that a crew member has to have a Rhine patent, a corresponding driving licence of Classes A to C or a similar Schifferpatent pursuant to § 5 of the Internal Schifferpatentverordnung of 15 December 1997 (BGBl. I p. 3066).
2.
For passenger ships which are used for the carriage of not more than twelve passengers, and for ferries, the ship shall be valid for the journey on the Rhine § 3.19 of the shipowners ' alverordnung-Rhine.
3.
§ § 3.03 to 3.07 shall apply to the crew in accordance with § § 3.02 to 3.12 with the exception of § 3.06 (1) sentence 2 of the Ship's Sperson Ordinance. By way of derogation from § 3.05 (1) of the shipowners ' Ordinance-Rhine
a)
holders of a certificate issued before 1 January 1998 and valid up to that date shall continue to use the data provided for the purpose of this service,
b)
"Schifferdienstbücher", which correspond to Resolution No 56 of the United Nations Economic Commission for Europe (UNECE), are recognized for holders of foreign vehicles from other countries, provided that the respective home state is the resolution adopted by UNECE,
c)
The Federal Ministry of Transport, Building and Urban Development may recognise the use of the "Schifferdienstbücher" ("Schifferdienstbücher") for holders of other countries on foreign vehicles if they certify an equivalent qualification for the respective function; this is true only if reciprocity is guaranteed; the Federal Ministry of Transport, Building and Urban Development is aware of this in the traffic sheet.
4.
Crew members must be in a position to carry out their duties on board under conditions that preclude fatigue.
5.
When the circumstances so require, each crew member may also be classified in the course of the operation of the watercraft for work outside the scope of his/her normal duties.
6.
If the care is always on board living children under ten years of age, it cannot be a member of the crew.
7.
Expectant mothers and women who have recently given birth can not be a member of the crew for a period of at least 14 weeks. This must be at least six weeks before and at least eight weeks after the date of arrival.

Section 3.02 Definitions

1.
In this chapter is
a)
Tax Man

a member of the cover crew who has been driving at least two years as a sailor or a sailor motor keeper in the inland waterway;
b)
Matrosen-Motorwart

a member of the crew member who has a basic knowledge of motor dogs and a driving time of at least one year as a sailor and at least one year on a watercraft with a propulsion engine in inland waterway or sea shipping;
c)
Matrose

a member of the cover team who has either passed the final test for inland waterway schiffer or who has completed 14 years of age. for at least three years in the cover crew of a sea or inland waterway, of which at least six months have been spent on inland waters; journey times as completed by 20. Life-year shall be counted twice on the three-year driving time, but not on the six-month driving time on inland waters;
d)
Shipboy

a member of the cover team, who is at least 15 years old, is no longer subject to full-time compulsory education and has been shown to be in a proper vocational training relationship;
e)
Machine

a member of the machine personnel who is at least 18 years of age and who has the knowledge required to operate the machinery;
f)
Heizer

a member of the machine staff, who is at least 18 years of age;
g)
Flößer

a person who is at least 18 years of age and who is travelling with a raft;
h)
Ferry Aid

a member of the ferry crew, who is at least 17 years of age and after completion of 14 years of age. for a period of at least two years, has either been active in the ferry service or has been a member of a sea or inland waterway vessel;
i)
Ferry Young

a member of the ferry crew, who is at least 15 years of age.
2.
The skipper shall carry on board the evidence that a ship boy belonging to the crew is in an orderly vocational training relationship on board and the competent national of the water and navigation directorate, the water and the water, and The vessel or the water protection police shall be handed out for inspection at the request of the vessel. § 3.03 Operating forms

1.

If the crew changes during the journey, the number of hours during which the crew is on board, unless the crew continues on another watercraft, shall be the determining factor. In the case of a changing crew, the owner or supplier shall have the proof of the working time of the individual crew member, by means of a special amortisation, outside the journey book, which shall be at least six months after the date of the last registration. is to be kept.

Section 3.04 Service and rest periods

1.
No member of the prescribed crew may serve more than 16 consecutive hours of service during the journey.
2.
Subject to the special provisions of point 4, at least 8 hours of uninterrupted rest period shall be within 24 hours beginning at the end of each rest period. If a member of the prescribed crew has performed work during loading or unloading, his service period shall be reduced during the journey within the same 24 hours by the time during which it has been worked. The work shall also cover the period in which a member of the prescribed crew has to be available for the purpose of taking up the journey or loading or unloading. In exceptional cases resulting from loading or unloading, it is sufficient to comply with the rule of sentence 1 if, within a period of 48 hours, the end of an uninterrupted rest period of 8 hours begins to run, 16 hours of rest, of which 8 hours have to be uninterrupted. Deviating regulations of a labour-law type, in particular tariff restrictions on a twelve-or fourteen-hour driving time, remain unaffected.
3.
On any watercraft, except on a public service watercraft, a sabot line without crew, a sports car and a floating device, the ship's guide shall have a travel guide. It is to be entered on a daily basis in the travel book:
a)
the operating mode,
b)
the crew and
c)
for each crew member, the service period during the journey.
It is immediately to be entered in the travel book:
a)
The place and time of the daily start and the daily end of the journey,
b)
for each crew member, the working hours referred to in the second sentence of the second and third sentences,
c)
Changes during the ride.
Each travel book whose pages are numbered must be provided with a serial number. The travel book shall be kept on board six months after the last entry.
4.
In the case of operating forms B, C and D (§ 3.03 No. 2), the conditions laid down in the first sentence of paragraph 2 shall be deemed to have been fulfilled if the crew required for these forms of operation in accordance with § § 3.05 to 3.10 is on board from the beginning of the journey. In such cases, proof of service during the journey referred to in point 3 shall be required only for the skipper, and not for the other crew members. The working hours referred to in the second sentence of paragraph 2 and 3 shall always be entered for each crew member.
5.
In operational form A, the rest period referred to in the first sentence of paragraph 2 shall be between 20 and 6 o'clock. In the operating mode B, the rest period shall include the time between 22 and 5 o'clock. In the operating form C, the rest period shall include the time between 23 and 3 o'clock.

§ 3.05 Occupation of the vehicles without a drive machine

1.
If on a watercraft without its own engine, with the exception of a ferry,
a)
the control device can also be handled by a person without any particular effort, even where a person has a maximum permissible reduction,
b)
With a length of more than 40 m, there is an intercom system between the control stand and the foreship,
c)
With more than 350 t load capacity, the Lenz and deck washing pumps are motorized,
d)
With more than 350 t load capacity the winch, on vehicles with more than 750 t load capacity also the Heckankerwinde is motorized,
e)
With more than 1 000 t of carrying capacity, the shanks are shiftable or shiftable, or equivalent devices, such as B. Sliding-Lukendächer, are present,

If one or more of the conditions referred to in paragraph 1 are not met, the crew shall be increased in all forms of operation by a ship's young for the stages 1 to 4 and a sailor for the level 5.
3.
In stage 2, the ship's young must have a driving time of at least 2 years and must be at least 17 years of age.
4.
In stages 1 to 3, the sailors must be at least 18 years old, unless they have passed the final exam for inland waterways.
5.
On the Elbe below the upper border of the Port of Hamburg (Elbe-km 607,50) with its tributaries, on the Trave, the Eider and the Kiel Fjord to Laboe need thrusters and lighters, with the exception of tank lighter, up to 330 t load capacity in the Operating form A must be occupied only with the ship's guide.
6.
On routes up to 20 km, for the carriage of goods with a load bearing capacity of up to 150 tonnes, in the form of a commuting form A, the following facilities shall be considered which are not to be entered in the certificate of the ship:
a)
It is sufficient to fill the ship with the skipper;
b)
in each case two annexes behind the tractor, each of which is coupled in the longitudinal direction, is sufficient for the occupation with a common guide;
c)
Annexes coupled to the tractor shall not require any crew.
On request, it shall be permitted, in operating form A, to ensure that the goods towed with a load bearing capacity up to 500 tonnes, which operate between the railway bridge in Bremen and the ports of the centre of the ports and which do not already fall within the scope of the first sentence, shall not be covered by the of a ship's guide.
7.
On request, the Central Office of the Submission Commission/Shipyards may allow the carriage of goods with a load capacity of up to 330 t on routes up to 20 km in the form of a commuting form A in the commuting mode only with the skipper. This authorisation shall be carried on board.

Section 3.06 Occupation of motor vessels and tankers

1.
If on a goods motor ship or a tanker ship

the machinery is so arranged that the regular maintenance work during the journey can be interrupted at any time,
h)
With more than 350 t load capacity, the Lenz and deck washing pumps are motorized,
i)
With more than 350 t load capacity the winch of the river, on a ship with a length of over 86 m also the Heckankerwinde is motorized,
j)
Stages 3 and 4 are motorised and handled by a person,
k)

On a Stage 1 ship with more than 300 tonnes load capacity and on Stage 4 vehicles, the ship's young must have a driving time of at least 2 years and must be at least 17 years of age.
3.
On a ship with a power output of more than 589 kW (800 hp), a sailor is to be replaced by a sailor's motor keeper.
4.
On a ship with a power output of up to 589 kW (800 hp), a crew member shall be familiar with the operation and supervision of the engines and another crew member shall be able to serve the engine to such an extent that it is to be used and can be removed.
5.
If one or more of the conditions referred to in paragraph 1 are not met, the crew shall be increased in all forms of operation by a ship's boy for steps 1 to 3, and for steps 4 and 5 for a sailor.
6.
Provided that the engine is used only for the purpose of minor changes in location in ports and in loading or unloading areas or in order to increase the capacity of the vehicle in the trawl, the ship shall be considered to be a ship with regard to the crew Drive machine. The restriction of use shall be entered in the certificate of the ship.
7.
If a goods motor ship or a tanker ship drags more than one vehicle, it increases the crews in all stages and forms of operation
a)
2 or 3 towed vehicles around a ship's boy,
b)
in 4 or more towed vehicles around a sailor.
However, if a goods motor ship or a tanker ship in the descent does not carry more than two empty vehicles without their own driving force, which are coupled to each other in the longitudinal direction, the crew does not increase. If a goods motor ship or a tank motor ship drags on a single towed train, its crew does not increase.
8.
For the journey on the Elbe and its tributaries, the Central Office of the Shipbuilding Commission/Shipyards may, upon request, allow a ship with a load capacity of up to 120 t of the ship ' s boy to be omitted if the ship is in the operating form A
a)
the ship's guide is mentally and physically capable of carrying out the multi-responsibility and
b)
the ship
aa)
just by day,
bb)
no explosions or fire-dangerous goods, and
cc)
Traffic from the Port of Hamburg down to the line Freiburg-Störmündung.

Section 3.07 Occupation of tug boats

1.
If on a towing boat, with the exception of a bow towing boat,
a)
propulsion systems can be operated from the control station,
b)
for the monitoring of the drive system in the danger areas
aa)
the temperature of the cooling water and the pressure of the lubricating oil of main engines and gearboxes, as well as
bb)
of the oil or air pressure of the drive or screw control system
alarm devices are triggered at the control level,
c)
the equipment referred to in paragraph 2 shall be alert, either by sound or by visual warning, and shall be designed to be effective during the operation of the propulsion systems and, in all circumstances, to draw the attention of the ship ' s guide;
d)
the winches for handling the towed strands and the anchors with more than 300 kg of normal weight are motorised,
e)
the trawling winds can be served by a person,

2.
When on a bow towing boat
a)
the driving machine can be operated from the control station,
b)
the alarm equipment used to monitor the propulsion system can be operated by the control station, the machine control station and the deck for all danger zones,
c)
all equipment referred to in paragraph 2 can be given an alarm by means of sound and visual signs, and shall be designed to be effective during the operation of the propulsion system and, in all circumstances, to draw the attention of the ruder worker,
d)
the winches for handling the towed strands and the anchors are motorized with more than 300 kg of normal weight, and
e)
the trawl winches can be operated by a person from the tax base or from the deck,
the crew

If one or more of the conditions set out in the first sentence are not fulfilled, the crew shall be increased by a sailor; instead of the sailor's motor wait, a machine must be on board in this case.

Section 3.08 Occupation of passenger ships

1.
When on a passenger ship
a)
the control device can also be handled by a person without any particular effort, even where a person has a maximum permissible reduction,
b)
View and sound signals can be given during the journey from the tax base,
c)
Stages 3 to 7 of the following table provide an intercom between the control level and the front vessel and a loudspeaker system with which the carrier may give instructions to the passengers,
d)
propulsion systems can be operated from the control station,
e)
for the monitoring of the drive systems in the danger areas
aa)
the temperature of the cooling water and the pressure of the lubricating oil of main engines and gearboxes, as well as
bb)
of the oil or air pressure of the drive or screw control system
alarm devices are triggered at the control level,
f)
the equipment referred to in paragraph 5 shall be alert, either by means of sound or visual warning, and shall be designed to be effective during the operation of the propulsion systems and, in all circumstances, to draw the attention of the ship ' s guide;
g)
the machinery is so arranged that the regular maintenance work during the journey can be interrupted at any time,
h)
the Lenz and deck washing pumps are motorized,
i)
the bouncy of the vehicles listed in the table below in stages 4 to 7 is motorised,
j)
Anchor winches are present,

§ 3.10 Derogations

1.

§ 3.12 Additional provisions

1.

10.
Operating conditions

The equipment or parts of the equipment shall operate satisfactorily under the conditions set out below:

- Humidity: up to 85% relative humidity
- Electrical protection: IP 54 according to IEC recommendation 529
- Oil resistance: as far as they are available for installation in the machinery space

B. Installation of tachographs on board

In the case of the installation of tachographs on board, the following conditions shall be complied with:

The tachograph may be installed by a specialist company, which is recognised by the competent authority.
2.
The tachograph shall be installed in the wheelhouse or in another easily accessible place.
3.
It must be visually recognizable whether the device is in operation. The device must be continuously supplied with electrical energy via a fail-safe circuit with its own protection and must be connected directly to this power supply.
4.
The statement about the ship's movement, that is, whether the ship is "in motion" or has the "travel set", is derived from the movement of the propulsion system. The corresponding signal has to be derived from the rotation of the screw, the screw shaft or the drive assembly. In the case of other types of drives, an equivalent solution is to be created.
5.
The technical equipment for the detection of the ship's movement must be installed in an extremely reliable way and can be secured against unauthorized interventions. For this purpose, the transmission line (including the signal transmitter and device input) for the signals from the drive system to the device must be secured by suitable measures and the line interruption is to be monitored. 6.
The recognised specialist company, which has carried out or supervised the installation, carries out a function test after the installation has been completed. The certificate must contain at least the following information:

The validity of the certificate shall be 5 years.

The certificate attests to the fact that it is an approved device, which has been installed by a recognised specialist company and has been checked for its proper function.
7.
The ship's management is to be signed by the recognised specialist company in the operation of the device and a user manual is to be handed out on board for remaining. This is to be noted in the certificate of installation.
