Waterways of Zone 3

Chapter 1
Special provisions for vehicles on zone 3 waterways

§ 1.01 General

Annex II or Annex XII shall be applied on waterways in Zone 3, other than the Rhine waterway, or the measures resulting from the following provisions. Unofficial table of contents

§ 1.02 Anchor equipment

For anchors, two thirds of the total weight calculated in accordance with Section 10.01 of Annex II is sufficient. Unofficial table of contents

§ 1.03 Speed

1.
Vehicles and associations must reach a speed against water of at least 10 km/h. This does not apply to drawers when they drive alone.
2.
In the case of reverse travel, a speed against water of at least 5 km/h has to be achieved.

§ 1.04 Free view

By way of derogation from the provisions of Article 4 (7) (2) (2) (2) of Annex XII, the shadows shall not exceed 250 m before the bow of the empty vessel, with half the stocks and without ballast for the rudder's commuter.

§ 3.01 General

Annex II or Annex XII shall be applied on waterways in zone 4, with the measures resulting from the following provisions. Unofficial table of contents

§ 3.02 Security distance

The safety distance for doors and other openings as the hatches of the cargo spaces can,
a)
as far as they can be sealed with spray water and weatherproof, to 0.15 m,
b)
as far as they cannot be sealed with spray water and weatherproof, are reduced to 0.20 m.

§ 3.03 freeboard

The freeboard shall be at least 0.00 m, provided that the safety margin according to § 3.02 is complied with. Unofficial table of contents

Chapter 5
Transitional and special provisions

Section 5.01 Transitional provisions for vehicles already in operation and validity of the previous travel certificates

1.
The following provisions shall apply to vehicles for which a certificate of driving licence with facilities similar to that of this Annex was issued for the first time before 30 December 2008.
2.
For vehicles, it must be demonstrated that they comply with the technical requirements of the inland waterway investigation order on the day of issue of their travel certificate or of the other type of transport authorisation.
3.
The travel certificates issued prior to 30 December 2008 shall remain valid until the expiry date. Annex II, Section 2.09, point 2 shall remain unaffected.

Section 5.02 Deviations for vehicles already in operation

1.
Without prejudice to § § 5.03 and 5.04, vehicles which do not fully comply with the requirements of this Annex must comply with the provisions which have entered into force after the first issue of their travel certificate or the other marketing authorisation. are adjusted in accordance with the transitional provisions set out in the table below.
2.

This provision shall not apply to vehicles which are already in operation unless the parts concerned are replaced or converted, d. (c) The provision shall apply only to new buildings and to replacement or conversion of the parts or areas concerned. If existing parts are replaced by replacement parts with the same technique and type of power, this does not mean a replacement "E" within the meaning of these transitional provisions.

"Grant or renewal of the certificate of travel certificate":

The provision must be fulfilled in the case of the granting or the next renewal of the validity period of the travel certificate, which follows on 30 December 2008. If the period of validity of the travel certificate ends between 30 December 2008 and one day before 30 December 2009, this provision shall not apply until 30 December 2009.

§ 5.03 Other derogations

In the event that the application of the provisions referred to in this Chapter is practically difficult to implement after the expiry of the transitional provisions, or where the costs are unacceptably high, the Commission of Inquiry may, on the basis of recommendations from the Committee, Derogations from these rules shall be permitted. Section 5.04 Transitional provision for vehicles referred to in Annex II, Chapters 15, 17 and 21 and in Article 5 of Annex XII

1.
For a vehicle referred to in Annex II, Chapters 15, 17 and 21 or in accordance with Article 5 of Annex XII, the certificate shall be issued following an examination in accordance with Section 2.09 (1), (3) and (4) of Annex II, which shall be subject to the expiry of the applicable rules. The certificate shall be issued at the latest by 30 December 2018 at the latest in order to determine whether the vehicle complies with the technical requirements set out in Annex IV.

If the vehicle does not comply with the requirements of Chapters 1 to 4 and if the Commission of Inquiry considers that these inadequacies do not present a manifest danger, the vehicle may continue its operation until such time as the vehicle is considered to be in danger of being incapable of being used as a vehicle. have been replaced or modified in parts or areas of the vehicle which have not been adequately identified; thereafter, these components or areas shall comply with the requirements of this annex. The deficiencies noted shall be recorded in the travel certificate.
3.
A manifest danger shall in particular be deemed to exist where provisions relating to the strength of the construction, the driving or manoeuvring properties or special features of the vehicle of this Annex are affected. Permissible deviations shall not be recorded as inadequacies, which constitute a manifest danger. No manifest danger shall be deemed to exist if the vehicle complies with the provisions of the Inland Waterway Investigation Order, as amended on 30 December 2008.
4.
The replacement of existing components by identical parts or parts of equivalent technology and design during routine repair and maintenance work shall not be deemed to be a substitute within the meaning of point 2.
