Chapter I
Special provisions for vehicles on waterways in zone 2-Binnen

§ 1.01 General

1.
Annex II or Annex XII shall be applied on waterways in zone 2, with the measures resulting from the following provisions.
2.
§ § 6.02 to 6.06 are to be fulfilled with regard to the required equipment.
3.
A compass according to § 6.02 is required only on the Kiel Fjord.
4.
A radar device according to § 6.03 is only available on:
a)
the Weser below the ports of the city of Bremen,
b)
Nord-Ostsee-Kanal,
c)
Kieler Förde,
d)
Trave below Stülper Huk,
e)
Unterwarnow and Breitling,
f)
Wolgaster port area
is required.

Section 1.02 Special provisions for passenger ships

By way of derogation from Chapter 15 of Annex II, for passenger ships on waterways in zone 2, the following provisions shall apply:
a)
In the case of passenger ships without a bulkhead deck, the safety margin shall be at least 0.80 m.
b)
Individual rescuing agents listed in Annex II, Section 15.09. No. 4 may be replaced by collective rescue means in accordance with Annex XII, Article 4 (15) (5) (5).

Part II
Waterways of Zone 2-Lake

Chapter 2
General

§ 2.01 General

1.
Annex II or Annex XII shall be applied on waterways of zone 2-See with the measures resulting from the following provisions.
2.
The provisions of Chapters 3 to 9 shall be fulfilled.
3.
§ 1.01 applies on the Ems below Emden to the port entrance of Delfzijl for cargo ships with closed cargo hatches, for tugboats and drawers.

§ 4.01 Security distance

1.
The safety distance shall be at least 0.45 m.
2.
The safety distance shall be at least 0.60 m for openings which are sealed with spray water and weatherproof or are provided with closure devices.
3.
For openings that are open, the safety distance must be at least 1.00 m.

§ 4.02 freeboard

1.
The freeboard for ships with a passing deck, without jumping and without superstructures is 0.30 m.
2.
In the case of ships with a jump and with superstructures, the freeboard can be adjusted in accordance with Section 4.02 (2) to (6) of Annex II:
a)
Where:
aa)
the constant in the formula for the freeboard in accordance with Section 4.02 (2) of Annex II, with a value of 300,
bb)
for the actual jump S at the front no greater than 2000 mm and
cc)
for the actual jump S in the rear no greater than 1000 mm
-
b)
The jump height at the ship's ends shall not include the height up to the end of the ship of sufficient on-buildings.
c)
For the calculations referred to in point (a), the effective length of the structure shall be calculated according to the following

3.
In the case of ships, the freeboard shall be at least 0.15 metres, taking into account the correction of the freeboard in accordance with point 2. In doing so, the following conditions must be met:
a)

at water-tight charge air, at least 0.60 m to the upper edge of the charge air waste,
bb)
at least 0,75 m for spray water and weatherproof charge air,
cc)
in the case of open charge air, at least 1.20 m.
b)
The average width of the gangbord shall not exceed 0,125 B.

Chapter 5
Closure state of the openings of the hull and of the superstructures

§ 5.01 Aufbauten

1.
All openings in the superstructures shall be provided with bulls of at least 0.15 m above the bulkhead deck.
2.
The height of the south can be lower if the doors and other openings can be sealed in a watertight manner and if the use is excluded during the journey.
3.
If the lids of entry hatches and manholes are not secured by means of screw connections, they must be firmly connected to the ship by hinges.

§ 5.02 Doors

All external doors which provide access to rooms under the deck shall be sealable at least in a spray water and weatherproof manner and must be of sufficient strength. Unofficial table of contents

§ 5.03 Window and Oberlichter

1.
Windows below the bulkhead deck must be waterproof and be provided with a sea shield.
2.
Windows and skylicks up to 0.15 m above the bulkhead deck must be waterproof.
3.
If the lower edge of windows and overlights is at least 0.15 m above the bulkhead deck, they must be at least spray water and weatherproof.
4.
Windows and Oberlichter shall be considered as:
a)
waterproof if they cannot be opened and that their design is at least in series B of the standard DIN ISO 1751, April 1993 edition;
b)
spray water-and weatherproof, if they can be opened and run as a round window at least of the C series of the standard DIN ISO 1751, April 1993 edition and as rectangular window at least of the F series of the standard DIN ISO 3903, edition 1 April 1993;
c)
open if their execution does not comply with the standards referred to in points (a) and (b).

§ 5.04 Cover of the cargo spaces

1.
The watertight cover of the cargo spaces shall comply with the following provisions:
a)
The strength and construction of the individual parts must be
aa)
a load caused by water from
q = 1,00-h [t/m²]
plus net weight of the lid, but not less than 0.15 t/m², plus the weight of the lid,
bb)
of a load of 0.075 t as a point load.

In this formula:
h-Distance of the deepest point of the hatch cover from the level of the maximum permissible depression [m].
In the case of tankers, at least the test pressure of the tanks shall be taken into account.
b)
Water-tight hatch covers must be sealed by screw closures or pre-drivers; this does not apply to coverings of the cargo spaces which are disguised by seeming seawater.
2.
The spray-water and weatherproof covering of the cargo spaces shall comply with the following provisions:
a)
The strength and construction of the individual parts shall be in accordance with the provisions of point 1 (a).
b)
There must be devices with which the Luk covers and their individual parts can be secured against lifting by wind or wave impact.
Spray water and weatherproof hatch covers do not need to be particularly sealed when the net weight of the lids and the shape of the hatch closure effects a sufficient sealing effect.
3.
Lader rooms without hatch covers and hatch covers which do not comply with the provisions of point 1 or 2 shall be deemed to be open.

Chapter 6
Equipment

Section 6.01 Anchor chains

By way of derogation from section 10.01 (10) of Annex II, each bucket chain shall be at least 60 m long. Unofficial table of contents

§ 6.02 Compass

1.
Vehicles with their own driving force must be equipped with a compass with analogue display or with a control transfer with analogue display.
2.
Vehicles in accordance with point 1 may instead use a digital display compass or a digital display compass, approved by the competent authority, when the latter is equipped with a radar device and a device for displaying the turning speed in accordance with § 6.03.
3.
The compass or control transfer shall be installed only if the design has been tested and approved in accordance with the provisions of the ship safety regulation. Compasses and control transfer must comply with the technical requirements set out in Annex IX, Part VII. Appropriate equipment listed in point A, No 10 of the Annex to the Ship Safety Act and approved in accordance with these requirements shall be deemed to be in conformity with those provisions.
4.
Magnet-based compasses and control transfer on magnet basis must be
a)
to be tested before installation by the competent authority or by a body recognised by it, this is not necessary for compasses or tax transfers authorised under the provisions of point (A) (10) of the Annex to the Maritime Safety Act ,
b)
be installed on board in accordance with the technical provisions referred to in Part VIII of Annex IX,
c)
shall be regulated by a person (regulator) recognised by the competent authority on the basis of a proof-of-the-art certificate, before putting into service and at the latest when the travel certificate is extended.
The regulator shall, at the same time, examine the proper installation in accordance with the first sentence of 1 It shall issue a certificate of orderly installation and regulation, which also indicates the date of the regulation. § 6.03 Radar

1.
Vehicles with their own driving force must be equipped with a radar device.
2.
The radar equipment shall be tested, approved and installed in accordance with Annex IX, Part III, V and VI, and shall be subject to a functional test.

Section 6.04 Transmission and reception facilities

Vehicles with their own driving force shall be equipped with a radio equipment for participation in inland waterway radio in accordance with the provisions of the Regional Agreement on Inland Waterway Radio. Unofficial table of contents

Section 6.05 Rescue equipment

1.
One third of the mandatory rescue rings must be in each case with a minimum of 30 m long, buoyant lees of 8 to 11 mm in diameter, and another third must each have a self-igniting, battery-powered, water-free, non-extinguishing Light shall be provided.
2.
In addition to Section 10.05 of Annex II, there must be a place for each person on board in a collective rescuer in accordance with Article 4, Section 15.09, point 5 of Annex XII.

§ 6.06 Other equipment

Other equipment must be on board:
a)
the equipment listed in Annex II, Section 10.02 (1) (a) and (d) to (f) and (2) and (3),
b)
on each vehicle, in addition, equipment and devices must be used to indicate the visibility prescribed in the Maritime Order and in the Regulation of 1972 on the International Rules for the Prevention of Collisions at Sea; and sound signals as well as to the name of the vehicles are available,
c)
on board vehicles with crew must also be provided with the nautical charts prescribed in section 13 (2) (a) of the ship's safety regulation.

Chapter 7
Special provisions for passenger ships

§ 7.01 General

For passenger ships on waterways of Zone 2-See, Chapters 3 and 4 and the provisions of § 6.05 do not apply. Unofficial table of contents

§ 7.02 Strength

By way of derogation from section 3.02 (1) (a) of Annex II, the hull must comply with the requirements of a recognised classification society for the zone 2-sea. A certificate issued by a recognised classification society certifying that the ship has been built or rebuilt in accordance with the construction rules applicable to the zone 2 sea is sufficient proof of this. § 7.03 Stability, safety distance and freeboard

1.
By way of derogation from the provisions of Annex II, Section 15.04 (1),
a)
the residual safety distance shall be at least 0,20 m, and
b)
in the case of ships without a bulkhead deck, the safety distance must be at least 1.00 m and the residual safety distance shall be at least 0.30 m
.
2.
By way of derogation from the provisions of Annex II, Section 15.04, No. 2,
a)
the remaining free board shall be at least 0,40 m and
b)
the freeboard must, however, at least 0,50 m
.
3.
By way of derogation from the provisions of Section 15.04 (3) of Annex II, the level of the largest reduction shall be determined in the light of the provisions of Nos. 1 and 2.

§ 7.04 Maximum number of passengers

The maximum number of passengers shall be determined in accordance with the provisions of Section 15.05 (2) (b) of Annex II, taking account of § 7.03. Unofficial table of contents

§ 7.05 Anchor

For passenger ships, the total mass P of the Buganker shall be calculated according to the following formula:

Section 7.06 Rescue equipment

By way of derogation from Section 15.09 (4) of Annex II, individual rescuing agents may be replaced by collective rescue funds in accordance with Article 4 (15) (5) (5) of Annex XII.

Special provisions for vehicles on zone 1 waterways

§ 10.01 General

1.
Appendix II or Annex XII shall be applied on waterways in zone 1, with the measures resulting from the following provisions.

The provisions of Chapters 2 to 6 and the provisions of § § 10.02 to 10.07 are to be fulfilled.

§ 10.02 Security distance

§ 10.03 Freibord

§ 10.04 closure condition

1.
By way of derogation from Annex II, Section 4.05 and Annex XII, Article 4, Section 4.05, the level of the largest reduction shall be determined on condition that the cargo spaces can be closed at least spray water and weathertight.
2.
It is not permissible to fix the maximum permitted rate of reduction for the journey with uncovered cargo spaces.

§ 10.05 Strength

A recognised classification society must certify that the vehicle has sufficient strength and an adequate freeboard and closure condition to travel on waterways in zone 1. The certificate to be presented must indicate the permissible driving conditions of the vehicles in accordance with § 10.06. Unofficial table of contents

§ 10.06 Permissible Travel Conditions

Depending on the construction, maintenance and equipment condition of the vehicle, its permissible driving conditions-in particular restrictions on journeys at a low level of wave height, to a certain period of time in the year, on journeys in daylight-will be subject to the or in the case of acceptable weather and weather conditions, or for journeys of limited duration. The permissible driving conditions shall be provided for in the Community certificate or in the additional Community certificate. Unofficial table of contents

§ 10.07 Additional Equipment

1.
In addition to the provisions of Chapter 6, vehicles with crew shall carry the following equipment on board:
a)
an electric daytime signal headlight,
b)
six red, officially approved parachute signals,
c)
a rescue signal board,
d)
Four rescue rings in accordance with § 10.05 of Annex II, of which two rescue rings must be provided with a minimum of 30 m long, buoyant lees of 8 to 11 mm in diameter, and two rescue rings must each have a self-igniting one, Battery-powered, water-non-extinguishing light,
e)
a life raft or a life raft referred to in Article 4 (4) (5) of Annex XII,
f)
a dinghy must be equipped with a lantern and a waterproof container with six red fires.
2.
In addition to the provisions of Chapter 6, towed vehicles with crew shall carry on board the equipment required under point 1 (b) to (f).

Section 10.08 Special provisions for passenger ships

1.
For passenger ships on waterways of Zone 1, Chapter 7 shall apply, taking into account the provisions in § § 10.05 to 10.07.
2.
A recognised classification society must certify that the vehicle has sufficient stability to travel on waterways in zone 1. The certificate to be presented must indicate the permissible driving conditions of the vehicles in accordance with § 10.06.

Part 4

Chapter 11
Transitional and special provisions

Section 11.01 Transitional provisions for vehicles already in operation and the validity of the previous additional Community certificates

1.
The following provisions shall apply to vehicles for which an additional Community certificate has been issued for the first time before 30 December 2008.
2.
For vehicles, it must be demonstrated that they comply with the technical requirements of the inland waterway investigation order on the day of issue of their Additional Community Certificate or any other type of transport authorisation.
3.
The additional Community certificates which have been issued before 30 December 2008 shall remain valid until the expiry date. Annex II, Section 2.09, point 2 shall remain unaffected.

§ 11.02 Deviations for vehicles already in operation

1.
Without prejudice to § § 11.03 and 11.04, vehicles which do not fully comply with the provisions of this Annex must comply with the provisions which have entered into force after the first grant of their Community certificate or of the other marketing authorisation in accordance with adapt to the transitional provisions set out in the table below.
2.
In the table below indicate:
-"N.E.U. ": This provision shall not apply to vehicles which are already in operation unless the parts concerned are replaced or converted, d. (c) The provision shall apply only to new buildings and to replacement or conversion of the parts or areas concerned. If existing parts are replaced by replacement parts with the same technique and type of power, this does not mean a replacement "E" within the meaning of these transitional provisions.
-"Grant or renewal of the Additional Community Certificate": The provision must be fulfilled in the case of the granting or the next renewal of the period of validity of the Community certificate, which follows on 30 December 2008. If the period of validity of the Community certificate ends between 30 December 2008 and one day before 30 December 2009, this provision shall not apply until 30 December 2009.

§ 11.03 Other derogations

In the event that the application of the provisions referred to in this Chapter is practically difficult to implement after the expiry of the transitional provisions, or where the costs are unacceptably high, the Commission of Inquiry may, on the basis of recommendations from the Committee, Derogations from these rules shall be permitted. Such deviations shall be entered in the additional Community certificate. Unofficial table of contents

Section 11.04 Transitional provision for vehicles referred to in Annex II, Chapters 15, 17 and 21 and in Article 5 of Annex XII

1.
For a vehicle referred to in Annex II, Chapters 15, 17 and 21 or in accordance with Article 5 of Annex XII, the additional Community certificate shall be issued following an investigation as referred to in Annex II, Section 2.09 Nos. 1, 3 and 4, which shall be subject to the applicable additional Community certificate, but not later than 30 December 2018, in order to determine whether the vehicle is in conformity with the technical requirements of Annex III.
2.
If the vehicle does not comply with the requirements of Chapters 1 to 10 of Annex III and the Commission of Inquiry is of the opinion that these inadequacies do not present a manifest danger, the vehicle may continue its operation until such time as: which have been replaced or modified as defective components or areas of the vehicle; thereafter, these components or areas shall comply with the requirements of this annex. The deficiencies noted shall be recorded in the Additional Community Certificate.
3.
A manifest danger shall in particular be deemed to exist where provisions relating to the strength of the construction, the driving or manoeuvring properties or special features of the vehicle of this Annex are affected. Permissible deviations shall not be recorded as inadequacies, which constitute a manifest danger. No manifest danger shall be deemed to exist if the vehicle complies with the provisions of the Inland Waterway Investigation Order, as amended on 30 December 2008.
4.
The replacement of existing components by identical parts or parts of equivalent technology and design during routine repair and maintenance work shall not be deemed to be a substitute within the meaning of point 2.
