EU No 1), as amended by Directive 2006 /137/EC of 18 December 2006 (OJ L 378, 27.12.2006, p. EU No 261) and Directive 2008 /59/EC of 12 June 2008 (OJ L 327, 31.12.2008, p. EU No 31), as last amended by Directive 2008 /87/EC of 22 September 2008 (OJ L 166, 30.4.2008, p. EU No L 255 p. 5). The provisions of Directive 98 /34/EC have been complied with.

Chapter 1
General provisions

§ 1 Scope and scope of application

This Regulation shall apply to vehicles, floating installations and floating bodies referred to in Annex I to this Regulation. 2) Federal waterways
1.
the procedure for technical admission to transport,
2.
the requirements for construction, equipment and equipment;
3.
the requirements for the crew;
4.
the requirements for the carriage of passengers.
Sentence 1 (3) shall not apply to the extent to which the requirements for the crew are governed by the shipowners ' Ordinance-Rhine. (2) This Regulation shall apply to vehicles referred to in Annex II, § 1.02. (3)
1.
technical requirements
a)
in accordance with Annex II in the case of the Rhine,
b)
in accordance with Annexes III to X and XII in the case of the other waterways of the Federation, referred to in Annex I,
2.
the requirements for the number and qualification of persons with whom a vehicle, a floating facility or a floating body must be occupied (crew), according to
a)
Annex X, section 7.02 for small passenger ships,
b)
Annex X, section 10.02 (d) for ceesboats and taxibootes,
c)
Part II of the shipowners ' Regulation-Rhine for seagoing ships, provided that Chapter 20 of Annex II is complied with,
d)
Annex XI, Chapters 1 and 3, for the other vehicles,
(4) By way of derogation from paragraph 3 (1) (b), Annex X, Parts 1 and 3 shall also apply on the Rhine. (5) On the Danube, this Regulation shall apply without prejudice to § 5 for vehicles, which shall be subject to the following conditions: The State of the Danube, which is not a member of the European Union, is not a member of the European Union, except in respect of the requirements of the crew; Annex XI, Section 3.01 (3) and (3.02) shall not apply. (7) This Regulation shall not apply to seagoing ships, including seagoing boats and seagoing boats, which

c)
in the case of sports vehicles not covered by all the Conventions referred to in point (a), a certificate issued by the flag State.
(8) The regulations referred to in paragraph 3 (1) (a) shall enter into force on the Rhine river search order on the Bundeswasserstraße Rhine, which is decided by the Central Commission for the Navigation of the Rhine.

§ 2 Definitions

(1) For the purposes of this Regulation:
1.
Federal waterway waterways in accordance with Annex I,
2.
Safety certification Official proof of technical approval for transport in accordance with the relevant model in Annex V,
3.
Rules for the carriage of ships
a)
The Regulation on the Navigation of the Rhine and the Rhine
b)
Donauschifffahrtspolizeiverordnung,
c)
The Regulation on the Navigation of the Moselle,

Inland waterway order,
e)
Maritime Order,
f)
Ship order Emsmündung.
(2) Insofar as this Regulation refers to certain provisions, it shall:

§ 3 competent authorities

(1) The authority responsible for the technical inspection of vehicles for transport on waterways shall be the Central Office of the Vessel Inspection Commission/Shipyards at the South-West Water and Shipping Directorate with those at its external offices. (2) The Central Office of the Ship Investigation Commission/Shipeichamt convenes the members of the investigative commissions in accordance with the regulations provided for in Section 2.01 of Annex II. For the subjects listed in Section 2.01 (2) (b) and (c) of Annex II, the Central Office of the Ship Investigation Commission/Shipeichamt shall convene the supervisory staff designated by the competent professional association. 3.
for the approval of AIS equipment within the meaning of Annex II, Section 7.06, point 3

§ 4 Principle

(1) The construction, equipment and installation of a vehicle, a floating facility and a swimming pool shall comply with the requirements of this Regulation. Section 4a Transport of passengers

(1) The movement of persons (passengers) in terms of pay or other business or commercial activity may only be carried out with

a passenger ship as defined in Section 1.01 (18) or (18a) of Annex II,
2.
a ferry within the meaning of Annex X, Section 1.01 (1),
3.
a carcass as defined in Annex X, Section 5.01,
4.
a small passenger ship within the meaning of Annex X § 7.01

c)
the sports boat can be traced back to its permanent berth if it is no longer permitted to continue with a charter certificate,
3.
on a sports boat of a water sports club or a sports boat school, provided that the transport is intended for training purposes,
4.
if the total charge for the respective journey does not exceed the operating costs of this journey and the carriage is not carried out in business or in the labour market and only occasionally.

§ 5 Technical Approval

(1) The technical approval of the traffic is issued by a commission of inquiry carried out by the Central Office of the Ship Investigation Commission/Shipyards after the previous investigation. § 6 Driving suitability certificate

(1) The technical approval of a vehicle, a floating installation or a floating body for transport shall be demonstrated by a travel certificate. a ship test issued in accordance with Article 22 of the revised Rhine Navigation Act.
(3) Compliance with the additional requirements for driving zones 1 and 2, as well as the facilities for driving zones 3 and 4, shall be noted in the Community certificate or shall be applicable to ships for which a ship test has been issued, by means of an additional Community certificate. (4) For a ferry, proof of admission to transport must be provided by a ferry certificate in accordance with the model set out in Annex V, Part V. Section 7 Recognition of other travel certificates and type-approvals

§ 8 Legal orders on orders of temporary nature

2.
Attempts to ensure that the safety and lightness of shipping are not compromised.
(2) In the event of the adoption of the legal regulations referred to in paragraph 1,
1.
the federal waterway Rhine the water and shipping directorates Südwest and West together,
2.
the other federal waterways, the water and shipping directorate responsible for the respective federal waterways.
If, in the case of the first sentence, no. 2, there is a federal waterway within the area of responsibility of several water and shipping directorates, these water and shipping directorates shall be jointly responsible.

§ 9 Distribution procedure

§ 10 Granting, freezing and withdrawal of a certificate of travel

§ 13 Period of validity, extension

(1) The period of validity of a travel certificate shall be determined by the Central Office of the Ship Investigation Commission/Shipeichamt in accordance with Section 2.06 of Annex II. (2) By way of derogation from paragraph 1, the period of validity shall be valid for a period of time. Additional Community certificate or Community certificate for the entry of Zone 1 issued on the basis of a certificate referred to in Annex III, Section 10.05, for a maximum of three years. (3) The validity of the certificate may be valid on the basis of a further investigation under section 2.09 of Annex II shall be renewed. § 15 equivalence and deviations

Implementation

Section 16 Duties of the ship's guide, owner or supplier

(1) The owner and the equipment supplier shall ensure that:
1.
a vehicle, a floating installation or a floating body shall not be put into service without the certificates of travel prescribed in accordance with Article 6 and valid for the restricted zone, and the certificates shall be carried on board during the journey ,
2.
the equipment and equipment are on board and in a proper and functional condition, in accordance with the conditions laid down in the entries in the certificate of travel certificate;
3.
Each name change, every change of ownership, any new calibration of the vehicle and any change to the registration or home location of the Central Office of the ship inspection commission/shipyards, and the travel certificate for the the registration of the relevant amendment is submitted,
4.
the vehicle, the floating installation or the floating body after each measure in the sense of
a)

shall be presented without delay,
5.
the vehicle, the floating installation or the floating body shall be preserved in a condition corresponding to the construction, installation and equipment requirements;
6.
the following equipment and equipment on board are in place and functioning:
a)
the tax bodies referred to in Annex II (§ 6.01 to 6.08),
b)
the operating, display and monitoring equipment referred to in Annex II, sections 7.03, 7.04, 9.17, point 3 and 4, sentence 2 and 3, and section 10.03b nos. 3 and 5 (c) sentence 1,
c)
the consultation services referred to in Annex II, Section 7.08, sentences 1 to 3,
d)
alarm and warning systems, alarm systems and triggers referred to in Annex II (§ 7.09), 10.03b (6) (a) and 15.08 (3) and (4),
e)
the lenzing facilities referred to in Annex II, Section 8.08 (1) to (6) and (8) and Section 15.08 (5),
f)
the equipment required for the collection of oil-containing water and used oil as required in accordance with Annex II, Section 8.09 (2), sentence 1;
g)
the additional safety equipment for cabin ships referred to in Annex II, Section 15.12 (10) (b) and (c),
h)
the waste water collection tanks or on-board sewage treatment plants in accordance with Section 15.14 (1) of Annex II,
i)
the additional equipment for the journey on zones 1 and 2 in accordance with sections 6.01 and 6.02 (1), (2), (3) and (4) (1), (2), (3) and (4), (1), (§ 6.03), (6.04), (6.05), (6.06) or (§
7.
the documents referred to in Article 4a (4), sentence 6, Annex II, Section 8a.02 (3), sentence 4, or in Annex XII, Article 4 (8) (8) (2) (2), are on board,
8.
a vehicle, a floating installation or a float shall not be put into service without the number of the marks referred to in Annex II (8a.06) (1) or the marks referred to in Article 6 (1) of Directive 97 /68/EC referred to in are attached to units,
9.
the documents referred to in the first sentence of Article 9.01 (2) of Annex II are on board or are available at any time in the case of section 9.01 (2), second sentence,
10.
the electrical equipment on board is designed to be explosion-proof in accordance with the provisions of section 9.04 of Annex II,
11.
the accumulators on board are set up in accordance with the provisions of section 9.11 of Annex II,
12.
the operating instructions of the crane manufacturer prescribed in accordance with Annex II, Section 11.12, point 9, shall be on board,
13.
Heating, cooking and cooling equipment to the provisions of Section 13.01 No. 2 to 5 of Annex II and § § 13.02 to 13.07 and 14.01 No. 2, § § 14.02, 14.03 No. 1 sentence 1, No. 2 sentence 2, § § 14.04 to 14.07, 14.08 No. 1 sentence 1 or sentence 2, No. 2, No. 3 sentence 2, No. 4 or No. 5, § § 14.09 to 14.12, and the rules of conduct on the use of these facilities are complied with,
14.
Rescue funds in accordance with Section 10.05 (1) and (2), Section 15.09 (1) to (4), Annex III, § 6.05, 10.07 (1) (d) and (e), Annex X, Section 5.06 (1) and (2) sentence 1, § § 8.10, 9.09 or Annex XII, Article 4, Section 15.09, point 5, as well as in accordance with Annex II. 10.05 (3), 15.09 (9) or (XII), Article 4, Section 15.09 (9), are examined,
15.
a stretcher according to Annex II, section 15.09, point 11, is available;
16.
Lighting fixers of the emergency lighting according to Annex II, Section 15.10, No. 5.
By way of derogation from the first sentence of paragraph 3, the notification may be made by another competent authority of a Member State of the European Communities and the certificate of driving licence may be submitted there. (2) The owner and the equipment supplier shall not be allowed to: order or allow
1.
Liquefied gas installations according to section 14.01 (2) of Annex II are operated with a gas other than commercially available propane,
2.
the time of use of a vehicle as defined in accordance with the first sentence of Article 3.03 (2) of Annex XI is not complied with or the journey is not adjusted accordingly,
3.
a member of the crew is set up during his minimum rest period, contrary to Annex XI, section 3.04 (2), first sentence, and (4);
4.
a vehicle shall be put into service after a substantial modification or repair without prior special examination in accordance with Section 2.08 (1) of Annex II.
(3) The owner, the equipment supplier and the ship's guide shall ensure that:
1.
Passengers shall be transported only by vehicles in accordance with Article 4a (1), including in conjunction with the first sentence of paragraph 4,
2.
the portable fire extinguishers are located in the places prescribed in Annex II, Section 10.03 (1) and 1512 (1) (1) and (2),
3.
the cover of the fire-fighting equipment referred to in Annex II, section 10.03, point 6, and the release devices of fixed fire-extinguishing systems, as set out in section 10.03b (5) (c) of Annex II, is marked,
4.
there is a fire-extinguishing ceiling in each kitchen as well as in hairdressing salons and perfumeries in accordance with Section 15.12 (1) of Annex II, last sentence available,
5.
the escape routes and emergency exits in accordance with section 15.06 (6) (f) of Annex II are clearly marked and illuminated and are equipped with a suitable safety guidance system in accordance with Section 15.06 (7) of Annex II,
6.
in accordance with Section 15.06 (11) of Annex II, the parts of the vehicles which are not intended for passengers are secured against the entry of unauthorised persons and the symbols referred to therein are affixed,
7.
the prescribed rescue means are housed and marked in accordance with section 15.09, point 8 of Annex II;
8.
comply with the provisions of Annex II, Section 15.12, No. 4 and 8, Sentence 1, relating to hydrant and fire pumps,
9.
the safety role and the safety plan in accordance with section 15.13 (3) (b) of Annex II are clearly visible at appropriate places,
10.
in accordance with the provisions of Annex II, Section 15.13, No. 4, sentence 1 and 3, in each cabin, information relating to the behaviour of the passengers in the cases referred to therein, as well as information on the place of installation of the rescue equipment, shall be located,
11.
for the respective operating mode and time of use of the vehicle, the floating installation or the floating body referred to in Annex X § 8.16 and § 9.16, Annex XI, Section 3.05, points 1, 2, 3 and 4, § 3.06 points 1 to 6 and 7, § 3.07, § 3.08, number 1, 3 and 4 and § 3.09 is permanently on board during the journey,
12.
the certificates referred to in points (1), (2), (3) or (4) of Annex II are on board and are available at all times;
13.
the seagoing vessel shall be provided with the outdoor pool mark referred to in Annex II (20.01) No 2.
(4) The ship's guide shall only be permitted to carry a vehicle, a floating installation or a floating body if:
1.
the safety certificates for the vehicle, the floating installation or the floating body, which are prescribed in accordance with Article 6 and valid for the designated zone, are on board during the journey,
2.
the equipment and equipment are on board, in accordance with the conditions laid down in the registration certificate, and in a proper and operational condition;
3.
the vehicle, the floating installation or the floating body after a measure in the sense of
a)
of Annex II, Section 2.08 (1) or (8) (a) (4) (a), or (4) (a) sentence 1 of Annex XII to a special investigation,
b)
of Annex II, Section 8a.02, point 6, or of Annex XII, Section 8a.02 no. 6, to a special examination
has been presented,
4.
the vehicle, the floating facility or the float is in a condition corresponding to the construction, installation and equipment requirements;
5.
ensure that the entry marks attached in accordance with Section 4.04 (2) of Annex II or Annex XII are clearly visible,
6.
the following equipment and equipment on board are in place and functioning:
a)
the tax bodies referred to in Annex II (§ 6.01 to 6.08),
b)
the operating, display and monitoring equipment referred to in Annex II, sections 7.03, 7.04, 9.17, point 3 and 4, sentence 2 and 3, and section 10.03b nos. 3 and 5 (c) sentence 1,
c)
the consultation services referred to in Annex II, Section 7.08, sentences 1 to 3,
d)
alarm and warning systems, alarm systems and triggers referred to in Annex II (§ 7.09), 10.03b (6) (a) and 15.08 (3) and (4),
e)
the lenzing facilities referred to in Annex II, Section 8.08 (1) to (6) and (8) to (11) and Section 15.08 (5),
f)
the equipment required for the collection of oil-containing water and used oil as required in accordance with Annex II, Section 8.09 (2), sentence 1;
g)
the additional safety equipment for cabin ships referred to in Annex II, Section 15.12, No. 10,
h)
the waste water collection tanks or on-board sewage treatment plants in accordance with Section 15.14 (1) of Annex II,
i)
the additional equipment for the journey on zones 1 and 2 in accordance with sections 6.01 and 6.02 (1), (2), (3) and (4) sentence 1, § 6.03, 6.04, 6.05, 6.06 and 10.07,
7.
which are affixed to the units referred to in Annex II, Section 8a.06 (1) or to the marks required by Article 6 (1) of Directive 97 /68/EC,
8.
the documents referred to in Annex II, Section 9.01 (2), first sentence, and Article 11.12 (10) (a), shall be on board,
9.
the electrical equipment on board is designed to be explosion-proof in accordance with the provisions of section 9.04 of Annex II,
10.
the accumulators on board are set up in accordance with the provisions of section 9.11 of Annex II,
11.
The heating, cooking and cooling facilities are in accordance with the provisions of Section 13.01 No. 2 to 5 of Annex II and § § 13.02 to 13.07 and 14.01 No. 2, § § 14.02, 14.03 No. 1 sentence 1, No. 2 sentence 2, § § 14.04 to 14.07, 14.08 No. 1 sentence 1 or sentence 2, No. 2, 3 sentence 2, no. 4 or No. 5, § § 14.09 to 14.12, and if it ensures that the rules of conduct referred to therein are complied with through the use of these facilities,
12.
Rescue funds in accordance with Section 10.05 (1) and (2), Section 15.09 (1) to (4) and (11), Annex III, § 6.05, 10.07 (1) (d) and (e), Annex X, Section 5.06 (1) and (2) sentence 1, § § 8.10, 9.09 or Annex XII, Article 4, Section 15.09, points 5 and 11. ,
13.
the lighting fixers of the emergency lighting are identified in accordance with Section 15.10 (5) of Annex II.
(5) The skipper
1.
shall carry on board the document referred to in Article 4a (4), sentence 6, and shall, at the request of the persons authorized for inspection, hand over the document to the person authorised for inspection,
2.
, the tests of portable fire extinguishers referred to in Annex II, Section 10.03 (5) and permanently installed fire extinguishers as defined in Section 10.03a (6) and 10.03b (9) (b), cranes referred to in Annex II (11) (6) (1) and (3) and (7), and the To arrange for the testing of liquefied gas installations in accordance with the first, second and third sentences of Article 14.13 of Annex II,
3.
shall carry on board the inspection certificates or acceptance reports issued in each case in the case of point 2, as proof of proof on board,
4.
Has to ensure that portable fire extinguishers with CO2 as extinguishing agents in accordance with Section 10.03 (4) of Annex II are used only for extinguishing fires in kitchens and electrical installations,

has to ensure that a liquid gas system is installed on the vehicle

shall be operated only if the certificate required by Annex II, Section 14.15, No 1, is on board,
6.
must comply with the first sentence of the first sentence of Annex XI, section 3.03 (2), and to adjust the journey accordingly,
7.
shall not use any member of the crew during the minimum rest period referred to in Annex XI, section 3.04 (2), first sentence and (4),
8.
shall keep the invalid logbook referred to in Annex XI, section 3.04, point 3, sentence 5, six months after the last entry on board,
9.
in accordance with the provisions of Annex XI (3) (3) (1) to (4), the travel book shall be correct, complete and timely,
10.
Has to ensure that the entries referred to in Annex XI, Section 3.01 (3), first sentence, in conjunction with Section 3.06 (6) (a) of the shipowners ' Ordinance-Rhine, and in accordance with the instructions for the guidance of the ship's service book in Annex A2, Section B of the shipowners ' Ordinance-Rhein correctly, completely and immediately after the journey takes place.
(6) A member of the crew shall be required to:
1.
have a skipper service book in accordance with Section 3.01 (3) of Annex XI,
2.
submit in due time the Schifferdienstbuch in accordance with Section 3.01 (3) of Annex XI,
3.
demonstrate its ability on board in accordance with Section 3.01 (3) of Annex XI.

§ 17 Administrative Offences

(1) An administrative offence within the meaning of Section 7 (1) of the Inland Waterway Law Act is the person who intentionally or negligently is contrary to a enforceable obligation pursuant to § 10 paragraph 2. (2) Contrary in the sense of § 7 (1) of the Act Inland waterway task law, who intentionally or negligently acts as a ship's guide
1.
In accordance with Article 16 (4) (1) to (3), 5 to 12 or 13, a vehicle shall be provided;
2.
the document referred to in point 16 (5) (1) does not carry on board the document referred to therein or does not, or does not, or do not hand in the
3.
shall not, in accordance with Article 16 (5) (2), arrange for the examination referred to in that paragraph or
4.
, contrary to Article 16 (5) (3), a test certificate or an acceptance report shall not be carried on board, either correctly or not fully on board,
5.
Contrary to Article 16 (5) (4), it is not ensured that portable fire extinguishers are used only for extinguishers in the fire,
6.
Contrary to Article 16 (5) (5), it is not ensured that a liquefied gas system is operated only in the presence of the conditions specified therein,
7.
Contrary to Article 16 (5) (6), the period of use of a vehicle does not stop or does not cease to be used,
8.
Contrary to Article 16 (5) (7), a member of the crew shall be employed during the minimum rest period,
9.
, contrary to Article 16 (5) (8), it does not retain the travel book referred to therein, or not at least six months,
10.
, contrary to Article 16 (5) (9), a logbook does not lead, not properly or incompletely, or
11.
Contrary to § 16 (5) (10), registration in the "Schifferdienstbuch" shall not be carried out correctly, in full or in time.
(3) In the sense of § 7 (1) of the Inland Navigation Task Act, who intentionally or negligently acts as a ship's guide, owner or equipment supplier
1.
Contrary to Article 16 (3) (1), it does not ensure that a passenger is only transported with a vehicle named therein,
2.
Contrary to Article 16 (3) (2), it is not ensured that a portable fire extinguisher is located at the prescribed places,
3.
Contrary to Article 16 (3) (3), it does not ensure that the cover of a fire extinguishing device or a release device is marked by fixed fire-extinguishing systems,
4.
Contrary to Article 16 (3) (4), it is not ensured that there is a fire-extinguishing ceiling at the places mentioned therein,
5.
does not ensure that an escape route or emergency exit is marked or illuminated or is equipped with a safety guidance system, in accordance with point 5 of the third paragraph of Article 16;
6.
does not ensure that a part of a vehicle is secured or a symbol is attached, contrary to Article 16 (3) (6),
7.
Contrary to Article 16 (3) (7), it does not ensure that a rescue vehicle is housed or labelled,
8.
Contrary to Article 16 (3) (8), it does not ensure that a provision on hydrants or fire pumps is complied with,
9.
Contrary to Article 16 (3) (9), it does not ensure that a document mentioned therein is suspended,
10.
Contrary to Article 16 (3) (10), it does not ensure that the particulars referred to in paragraph 10 are in each cabin,
11.
Contrary to Article 16 (3) (11), it is not ensured that the required crew is on board permanently,
12.
does not ensure that there is a certificate on board or is available at any time, contrary to Article 16 (3) (12), or
13.
Contrary to Section 16 (3) (13), it is not ensured that a seagoing ship is provided with an outdoor swimming pool mark.
(4) Contrary to the provisions of Section 7 (1) of the Inland Navigation Task Act, who intentionally or negligently acts as an owner or an equipment supplier
1.
Contrary to Article 16 (1), first sentence, point 1, it is not ensured that a vehicle is not put into service without a certificate of driving licence, and that the certificate is on board during the journey,
2.
Contrary to Article 16 (1), first sentence, point 2, it does not ensure that there is a facility or an item of equipment on board there,
3.
Contrary to Article 16 (1), first sentence, point 3, it does not ensure that a change to the Commission of Inquiry is communicated to the Commission and that the certificate of travel certificate is submitted,
4.
Contrary to Article 16 (1), first sentence, point 4, it is not ensured that a vehicle, a floating installation or a floating body is presented for a special examination or a special examination,
5.
Contrary to Article 16 (1), first sentence, point 6, it does not ensure that there is a facility or an item of equipment on board there, or that it is functioning properly,
6.
Contrary to Article 16 (1), first sentence, point 7, the document does not ensure that the document referred to therein is on board,
7.
Contrary to Article 16 (1), first sentence, point 8, it is not ensured that a vehicle, a floating installation or a floating body is not put into service without the marks referred to therein,

Contrary to Article 16 (1), first sentence, point 9, the document does not ensure that the document referred to therein is on board or is available at any time,

Contrary to Article 16 (1), first sentence, point 10, it does not ensure that an electrical device is designed to be explosion-proof,
10.
Contrary to Article 16 (1), first sentence, point 11, it does not ensure that an accumulator is placed in the prescribed manner,
11.
Contrary to Article 16 (1), first sentence, point 12, it does not ensure that the above-mentioned operating instructions are on board,
12.
Contrary to Article 16 (1), sentence 1, point 13, it is not ensured that a heating, cooking or cooling device complies with the provisions referred to therein and that the rules of conduct referred to therein are complied with,
13.

(5) In the sense of § 7 (1) of the Inland Navigation Task Act, anyone who intentionally or negligently does not submit the Schifferdienstbuch as a member of the crew in accordance with § 16 (6) no. 2, or does not submit it in due time.

§ 18 Continuation of existing travel certificates

(1) The travel certificate shall be renewed after the expiry of its period of validity in accordance with the conditions laid down in § 13. (2) For the renewal of the travel certificates issued before 30 December 2008, the certificates shall be valid for the renewal of the travel certificate. Transitional provisions of Annex II and, where appropriate, Annexes III, IV, X and XII. (3) The transitional provisions of Annex II shall apply to the renewal of the travel certificates issued after 30 December 2008 and, where applicable, Annexes III, IV, X and XII, which have entered into force after the certificate has been issued. Section 19a Transitional arrangements

(1) Vehicles of another Member State of the European Union for which a Community certificate is to be issued shall be in accordance with Annex XII to this Regulation, as amended on 6 December 2008 (BGBl. 2450) until, for the first time after 1 January 2013, a Commission Directive on the basis of Article 20 of Directive 2006 /87/EC of the European Parliament and of the Council of 12 December 2006 on technical requirements for inland waterway vessels and repealing Council Directive 82/714/EEC (OJ L 196, 27.7.1992, p. 1), which was last amended by Directive 2009 /46/EC (OJ L 281, 23.11.2009, p. 14), has been amended and has been amended. In so far as Annex XII to this Regulation refers in the above-mentioned version to Annexes II, V, VI, VII, IX and XI to this Regulation, these Annexes shall also be applied in the version referred to in the first sentence. The Federal Ministry of Transport, Building and Urban Development shall announce the date of entry into force of the Commission Directive referred to in the first sentence of the first sentence of the Bundesgesetzblatt. (2) At the request of the owner or the supplier of an application referred to in paragraph 1 In accordance with this Regulation, the vehicle may be examined in accordance with the version in force as from 1 January 2013. Section 20 Entry into force

This Regulation shall enter into force on the date determined by the Introductory Regulation on the Inland Waterway Investigation Order. The Federal Ministry of Transport, Building and Urban Development announcates the date of its entry into force in the Federal Law Gazan and in the Official Journal of the Federal Republic of Germany.
