General provisions

§ 1 Scope and scope

(1) This Regulation regulates vehicles, floating installations and floating bodies in the Annex I 2) called the federal waterways
1.
the procedure for technical approval for traffic,
2.
the requirements for construction, equipment and Setup,
3.
the requirements for the crew,
4.
the requests to the Carriage of passengers.
Sentence 1 (3) shall not apply to the extent that the requirements for the crew are governed by the shipowners ' ordinance on the ship's semen.This Regulation shall apply to vehicles within the meaning of section 1.02 of Annex II.(3)
1.
the technical requirements
a)
according to Appendix II in the case of the Rhine,
b)
according to Annexes III to X and XII in the case of the other federal waterways listed in Annex
,
2.
the requirements for the number and qualification of persons with whom a vehicle, a floating facility or a floating body must be occupied (crew), according to
a)
Appendix X § 7.02 for small passenger ships,
b)
Appendix X § 10.02 (d) for Zeesboote and Taxiboote,
c)
Part II of the Schiffspersonalverordnung-Rhine for seagoing ships, provided that Chapter 20 of Annex II is complied with,
d)
Annex XI, Chapters 1 and 3 for the rest of the vehicles
expressly stated is intended to be something else.(4) By way of derogation from paragraph 3 (1) (b), Annex X, Parts 1 and 3, shall also apply on the Rhine.(5) On the Danube, this Regulation shall apply without prejudice to § 5 for vehicles which are located in a Danube State which is not a member of the European Union, only with regard to the requirements applicable to the crew; Annex XI, section 3.01 (3) and (3.02) shall not be applied.(6) In addition, this Regulation applies to all

(7) This regulation does not apply to seagoing ships, including seagoing boats and seagoing boats, the

a)

b)
in passenger ships not covered by all the Conventions referred to in point (a), a certificate of safety and safety standards for passenger ships, according to the Council Directive 98 /18/EC of 17. March 1998 on safety rules and standards for passenger ships (OJ L 196, 27.7.1998, p. EC No 1) or
c)

§ 3 Competent authorities

(1) The Technical inspection of vehicles for transport on waterways is the central office of the ship inspection commission/shipyards at the South-West Water and Shipping Directorate with the authorities responsible for their external positions Investigative commissions.(2) The Central Office of the Ship Investigation Commission/Shipond Office shall, in accordance with the rules laid down in Section 2.01 of Annex II, convene the members of the investigative commissions. For the subjects listed in Section 2.01 (2) (b) and (c) of Annex II, the Central Office of the Ship Investigation Commission/Shipeichamt shall convene the supervisory staff designated by the competent professional association. In the case of vehicles which are subject to the supervision in accordance with Section 17 (1) of the Seventh Book of the Social Code, these can also monitor compliance with the accident prevention regulations in the context of their investigative activities. In addition to the experts referred to in the first sentence, the Central Office of the Submission Commission/shipyard shall convene experts in special matters, in particular for electrical installations, liquefied gas installations, cranes or fire extinguishing systems, as Members.(3) Compliance with the requirements of Annex X, Section 10.02 to Zeesboote and Taxiboote may be demonstrated by attestation of an expert in the field recognised by the Central Authority of the ship inspection commission/ship's oke.(4) The Commission of Inquiry shall act by a majority of votes; in the event of a tie, an application shall be deemed to have been rejected. The experts for special subjects shall not have the right to vote for the registration of the vehicle; they shall decide only on their subject matter, but on the other hand alone.(5) The locations of the external offices of the Central Office of the Ship Investigation Commission/Shipeichamt are known by the Federal Ministry of Transport, Building and Urban Development in the traffic bulletin.(6) By way of derogation from Section 2.01 (2) (c) of Annex II, the holder of a ferry licence may participate in the investigation as an expert in the issuing of a ferry certificate.(7) Competent authority within the meaning of sections 2.11 and 5.03 no. 1 of Annex II shall be the locally competent water and navigation authority.(8) Competent authority within the meaning of Section 4a (4) sentence 1 is the Water and Shipping Office, which has issued the boat certificate in accordance with § 3 of the Inland Navigation Sportbootvermietungsverordnung (Inland Waterway).(9) The competent authority within the meaning of Section 18.01 (3) of Annex II shall be the local water and shipping authority.(10) Competent authority for the establishment, type-examination, recognition of recognised persons (regulators) and recognition of a foreign-regulated regulation of compasses and tax transfers within the meaning of Section 6.02 of Annex III is the Bundesamt für Seeschifffahrt und Hydrographie in Hamburg.(11) Competent authority

for the type testing and approval of navigation radar systems and turning indicators as defined in Annex II, Section 7.06, point 1, in conjunction with Annex M, Part I, Section 4 and Part II, Section 1.03,
2.
for the type-approval of navigation radar systems and turning indicators within the meaning of Annex XII, Article 4, Section 7.06, point 1 in conjunction with Annex IX, Part I, Section 4 and Part II, Section 1.03, and
3.
for the approval of AIS equipment in the sense of the Annex II, section 7.06, point 3.

§ 4 Principle

(1) Construction, equipment and equipment of a vehicle, a floating facility and a floating body shall comply with the requirements of this Regulation. This also applies with regard to the requirements for the crew, with the exception of the Rhine. If reference is made to regulations relating to the shipping industry, the corresponding provisions applicable to the respective waterway are meant in accordance with section 2 (1) (3).(2) A vehicle may participate in the traffic only if it has been technically approved for transport at the request of the owner or its authorised representative and meets the requirements of the technical approval. In the case of transport, it must also be technically permitted to carry out a floating floating installation or a continuous floating body, provided that it is a special transport which requires a special permit for shipping and in which the transport is carried out. Responsible water and shipping authorities for reasons of safety and lightness of traffic, in particular with regard to the strength of the construction, the driving and maneuvering properties and special features following the annexes, taking into account of the area of the driving area is considered necessary.(3) Where a technical authorisation for transport is not required, the owner or his authorised representative may request it. § 4a Carriage of passengers

(1) The paid or other business or commercial transportation of passengers (Passengers) may only be used with

a passenger ship as defined in Section 1.01 (18) of Annex II, or 18a,
2.
a ferry within the meaning of Annex X § 1.01, point 1,
3.
a cash flow in the sense of of Annex X, § 5.01,
4.
a small passenger ship as defined in Annex X § 7.01

Occasionally leading waterway sections to reach a driving area that may be covered by a charter certificate, or
c)
the sports boat can be traced back to its permanent berth if it is no longer allowed to continue with a charter certificate

on a sports boat of a water sports club or a sports boat school, provided that the promotion is for training purposes,
4.
if the total fee for each trip does not exceed the operating costs of this journey and the promotion is not business or working and only occasionally .
(4) By way of derogation from paragraph 1, the competent authority may, in order to avoid undue hardship at the request of the owner, on a case-by-case basis or for a certain period of time, in areas where there is no or only a small amount of Passenger shipping will allow passengers on a vehicle to be transported on the 31. § 5 Technical Approval

(1) The technical approval for the traffic will be made after a previous investigation by a Commission of Inquiry issued by the Central Office of the Ship Investigation Commission/Shipyards. The Central Office of the Ship Investigation Commission/Shipyards may, in whole or in part, refrain from carrying out the technical inspection in the case of a vehicle, a floating installation or a floating body, as far as possible from a valid vehicle. a certificate issued by a recognised classification society in accordance with Annex VII shows that the vehicle is wholly or partly in conformity with the technical requirements of Annex II or XII.(2) Technical approval for transport shall be granted for traffic

a ship test must be issued, the requirements of Annex II,
2.
a Community certificate must be issued, must comply with the requirements of the Annex XII
, unless otherwise specified or approved in this Regulation.(4) Signal lights, radar equipment, turn indicators, compasses and control transfer must comply with the requirements of Annex IX.(5) A ferry, a barge and a small passenger ship, in particular a taxi boat or a ceesboat, shall comply with the requirements of Annex X, unless otherwise specified or authorised in this Regulation.(6) A ferry will only be technically approved for traffic between certain landing points, taking into account local conditions, unless otherwise specified or approved in this Regulation.(7) A seagoing ship operating the waterways of the

Zone 3 and 4 must comply with the requirements of Annex II Chapter 20,
2.
Zone 1 and 2, must comply with the requirements of the ship safety law, the requirements of § 6 of the ship safety regulation, or comply with the requirements of Annex II, Chapter 20.
.(8) A vehicle, a floating installation and a floating body, the one or more of the waterways of zones 1 and 2, shall comply with the requirements of Annex III.(9) A vehicle, a floating installation and a floating body, which or the waterway of zone 3 is outside the Rhine and zone 4, shall comply only with the requirements of Annex IV.(10) In the case referred to in paragraph 8 or 9, the conformity with the relevant requirements shall be entered in the Community certificate or, in the case of a ship test, an additional Community certificate shall be drawn up.(11) A vehicle, a floating installation and a floating body shall be occupied by persons (crew) meeting the requirements of Annex II in conjunction with Annex XI, Chapters 1 and 3 or the Shipboard Ordinance-Rhine Part II.(12) Technical approval for the waterways of Zone 1 shall include the technical approval of the waterways of the other zones. The technical approval of the waterways of Zone 2 shall include the technical approval of the waterways of zones 3 and 4, the technical approval for the waterways of zone 3, which shall be approved for the waterways of zone 4.(13) A technical approval for transport is not required for
1.
Vehicles, floating installations and floating body
a)
the Bundeswehr,
b)
for exclusive use in the Port of Hamburg;
2.
ferries
a)
for use in civil and civil protection,
b)
on waterways other than the Rhine for use in the context of an agricultural holding, provided that they are not used in public transport and at the highest permissible level Depression has a water displacement of less than 15 m3 .

§ 6 Roadworthiness certificate

1) The technical approval of a vehicle, a floating installation or a floating body for transport shall be demonstrated by a certificate of travel certificate.(2) A vehicle, a floating installation or a floating body, which operates on the waterways referred to in Annex I, must carry the following valid travel certificate for the restricted zone:

on the Rhine
a)
a ship test issued in accordance with Article 22 of the Revised Rhine Navigation Act, in accordance with the model in Part II of Annex V (Schiffsattest) or
b)
one after the 30. (3) additional requirements for the operation of zones 1 and 2 and the facilities for driving zones 3 and 4 must be noted in the Community certificate or, in the case of ships for which a ship test has been issued, shall be subject to an additional Proof of Community certificate.(4) For a ferry, proof of admission to transport must be provided by a ferry certificate in accordance with the model set out in Annex V, Part V.(5) A travel certificate confirming the exclusive use of the facilities of Annex IV § § 3.02 and 3.03 entitles the holder to travel on all waterways in zone 4. § 7 Recognition of other travel certificates and type approvals

(1) The suitability for driving on the Waterways of zones 1 and 2 shall be replaced by a corresponding entry in the Community certificate or by an additional Community certificate in connection with a ship test carried out by a Member State of the European Community or by a Member State of the European Community. (3) The owner, the equipment supplier and the ship's guide shall ensure that

(3) Administrative dismise in the sense § 7 (1) of the Inland Navigation Task Act, who intentionally or negligently acts as a skipper, owner or supplier

contrary to § 16, paragraph 3, point 1, it does not ensure that a passenger is only transported with a vehicle named there,
2.
contrary to § 16, paragraph 3, point 2, it does not make sure that a portable fire extinguisher is at the prescribed locations,
3.
contrary to § 16, paragraph 3, point 3, it does not ensure that the cover of a fire extinguisher or a release device is marked by permanently installed fire extinguishing systems.
4.
contrary to § 16, paragraph 3, point 4, does not ensure that there is a fire-extinguishing cover available at the locations mentioned there,
5.
contrary to § 16, paragraph 3, point 5, it does not ensure that an escape route or emergency exit is marked or illuminated or equipped with a safety guidance system
6.
contrary to § 16 (3) (6), does not ensure that a part of a vehicle is secured or a symbol is attached,

contrary to § 16, paragraph 3, point 7, it does not ensure that a rescue remedy is housed or marked,

contrary to § 16, paragraph 3, point 8, it does not ensure that there is compliance with a provision on hydrants or fire pumps,
9.
contrary to § 16, paragraph 3, number 9, it does not make sure that a document is hung up there,
10.
contrary to § 16, paragraph 3, number 10, it does not make sure that there is an indication in each cabin,
11.
contrary to § 16, paragraph 3, number 11, not ensuring that the required crew is constantly on board,
12.
contrary to § 16, paragraph 3, point 12, it does not ensure that a certificate is on board or is available at any time, or
13.
contrary to § 16 paragraph 3, point 13, it does not ensure that a seagoing ship is provided with an outdoor swimming pool brand.
(4) Administrative Offers in the sense of § 7 (1) of the Inland waterway task law, who intentionally or negligently as owner or equipment supplier
1.
contrary to § 16, paragraph 1, sentence 1, point 1, not ensuring that a vehicle is not put into service without a vehicle registration certificate and that the vehicle is not certificate during the journey on board,

(5) Administrative offences within the meaning of § 7 Section 1 of the Inland Waterway Task Act is the person who, intentionally or negligently as a member of the crew, does not submit the Schifferdienstbuch or not in good time, contrary to § 16 (6) no. 2.

§ 19a Transitional rules

§ 20 Entry into force
