§ 1 Scope

This regulation goverls
1.
the mobile VHF radio station on waterways of zones 1 to 4;
2.
the acquisition of a VHF radio station for inland waterway radio (VHF radio certificate (UBI)).

§ 2 definitions

For the purposes of this regulation,
1.
Waterways of zones 1 to 4 :the federal waterways according to Appendix I of the Inland Waterways Search Order of 6. December 2008 (BGBl. 2450), as amended;
2.
Vehicles: inland waterway vessels including small vehicles and ferries, as well as floating equipment, floating bodies and Seagoing ships;
3.
Inland waterway radio: International mobile VHF radio service between land radio stations and ship stations or between ships ' radio stations Inland waterway routes, which includes the following transport routes:
a)
ship ship,
b)
Nautical Information,
c)
ship-port authority,
d)
radio traffic on board,
e)
public message exchange;
4.
Funkanlage: Ship radio station on board of a vehicle; it can be made up of several radios;
5.
Regional Agreement: the Regional Agreement on Inland Waterway Radio of 6. April 2000 (BGBl. II p. 1213);
6.
inland waterway transport handbook: the jointly by the Central Commission for the Navigation of the Rhine in Strasbourg and the Danube Commission in Budapest, according to -the Regional Agreement's Resolution No 1 and the handbook on inland waterway radio, including the regional parts, issued by the Federal Ministry of Transport, Building and Urban Development, current version;
7.
Landfunkstelle: stationary radio station of the inland waterway radio;
8.
ship radio stelle:mobile radio station of the inland waterway radio, which is on board a vehicle that is not permanently established.

§ 3 Basic rules

(1) The radio service at a ship's radio station may only be carried out in accordance with the Regional Agreement and the Manual for Inland Waterways.(2) The VHF channels of the ship's ship, ship-port authority and radio traffic on board may only be used if the output power of the transmitter is automatically limited to a value of between 0.5 Watt and 1 Watt. In the VHF channels in the Nautical Information traffic circle, the output power must be set to a value of between 6 watts and 25 watts.(3) All fixed and portable radio equipment must be equipped with an Automatic Transmitter Identification System (ATIS) system. § 4 Permission

(1) Anyone who wants to serve or supervise a ship's radio station on waterways of zones 1 to 4 requires a permit issued by the competent authority in accordance with this Regulation. It shall apply indefinitely. The competent authority is the department of water and shipping management for traffic techniques at the Koblenz water and shipping office.(2) This permission is demonstrated by a VHF radio certificate (UBI (Appendix 1)).(3) No permission is required for the holder of a

officially approved VHF radio event (UBI) 2)),

UKW speech radio certificate issued by a contracting authority of the Regional Agreement on the basis of this Agreement for the Inland waterway radio,

radio certificate recognized and valid by the competent authority,

The radio certificate issued before the entry into force of this Regulation and entitled to participate in the inland waterway radio.

§ 5 Special duties

In the transport trips ship-ship, nautical information and ship-port authority may only be sent messages that refer to the protection of human life, the journey or the safety of vehicles.

§ 6 Requirements for obtaining permission

§ 7 Examination requirements

§ 8 Examination committees

(1) The competent authority sets up audit committees and appoints their chairperson, Substitutes and reviewers as required. § 9 Review

(1) The applicant has to prove in an audit in accordance with the examination program (Appendix 3) that he
1.
about sufficient knowledge of the rules governing participation in inland waterway radio as well as the operational and technical knowledge required for the proper operation of the radio system (theoretical part) and
2.
for its practical
chairperson of the examination committee or his deputy determines the date of the examination and appoises the examination board, which consists of three examiners. The Examination Committee takes the examination. (3) The Chairman of the Examination Commission is in charge of the examination. It shall be carried out in accordance with the provisions of Appendix 4. The examination was only a unanimous decision of the Examination Committee. A record is to be recorded on the course of the examination.(4) If the applicant has demonstrated the competence to participate in the inland waterway radio and for the proper operation of the radio equipment, the applicant shall be authorised by the issuing of an indefinite valid UKW speech radio (UBI) in accordance with the model of Appendix 1.(5) If the applicant does not have part of the examination, he or she may repeat that part of the examination at the earliest after two weeks and no later than six months.(6) holders of a

Long Range Certificate (LRC)),

Short Range Certificate (SRC)

§ 10 Grant without examination

On presentation of one of the certificates referred to in § 4 (3) (3) and (4), or a certificate recognised by the competent authority for a successful test to be carried out in the field of inland waterway radio shall be granted by the competent authority to the holder, on request, without re-examination, and shall issue a certificate UKW speech radio certificate (UBI). § 11 Replacement of spare parts

Is a VHF radio certificate (UBI) or a radio certificate pursuant to § 4 para. 3 no. 4 unusable , the competent authority shall, at the request of the competent authority, issue a replacement copy, which shall be marked as such. § 12 Withdrawal

(1) The competent authority must revoke a permit if the holder is proven to be
1.
has violated provisions on inland waterway radio in a dangerous way or
2.
is no longer capable of properly participating in inland waterway radio, in particular, no longer sufficient hearing or communication capability or adequate visual acuity; the competent authority may, in cases of doubt, require the submission of professional medical certificates.
(2) The competent authority may withdraw a permit if
1.
the owner has been proven to be grossly violating provisions on inland waterway radio
2.
where the holder has found evidence that he is no longer able to participate in the inland waterway radio
In such cases, the competent authority may depart from the withdrawal if the person concerned again successfully submits an examination. This examination shall be limited to the knowledge and skills referred to in Annex 3 which have been objectionable.(3) The permission shall be issued with the withdrawal. The VHF radio certificate (UBI) shall be delivered immediately to the competent authority, even if the withdrawal of the licence has been challenged and the immediate enforcement of the withdrawal has been ordered.(4) The competent authority may, in the event of withdrawal, bind the re-issue of the permit to conditions and conditions.(5) The competent authority shall immediately inform the water protection police of the countries of the withdrawal of the licence, provided that the holder of the VHF radio certificate (UBI) has not fulfilled its obligation under paragraph 3.(6) The water protection police of the Member States shall inform the competent authority of the facts which are known to them and which may justify withdrawal.(7) Paragraphs 1 to 6 shall apply mutatily to certificates in accordance with section 4 (3) no. 4.(8) In the cases referred to in paragraphs 1 and 2, the competent authority may prohibit the operation of a ship ' s radio station or a seefuncture on the waterways of zones 3 and 4 in accordance with Article 4 (3) (2) and (3) of this Regulation. § 13 Information

of administrative tasks according to the Act of Inland Navigation or under this Act or of the Law on the Law of the Sea to the services of the Federal Waterways and Shipping Administration, the water protection police of the Countries and the regulatory authority for postal and telecommunications as well as audit committees,
2.
Persecution of criminal offences related to shipping , in courts, public prosecutors, police departments of the federal states and the Federal Criminal Police Office as law enforcement agency,
3.
Persecution of In the event of an administrative offence in the field of shipping to courts, public prosecutors, water and maritime administration services of the Federal Government and the police force of the Länder

§ 14 Official UKW speech radio certificate (UBI)

The officially approved UKW speech radio certificate (UBI) shall be issued in accordance with the Model of Appendix 2 of examination committees of the German Motoryachting Association e. V. and the Deutscher Segler-Verband e. V.). § § 6, 7 para. 2, 3 sentence 2, § 8 para. 2, § 9 para. 1 to 3, 5 to 7 and in accordance with § 7 para. 1, § 9 para. 4, § § 11 to 13 apply. The competent authority may prohibit the issuing of the officially recognised VHF radio certificate (UBI) to the above authorities if the facts justify the assumption that they, their examination committees or their examiners are repeated or grossly Have infringed the provisions of sentence 2.

§ 15 Administrative Offences
