§ 1 Scope

This Regulation lays down
1.
the mobile VHF radio service on waterways in zones 1 to 4 for ships ' radio stations;
2.
the acquisition of a VHF radio certificate for inland waterway radio (VHF radio certificate (UBI)).

§ 2 Definitions

For the purposes of this Regulation:
1.
Waterways of zones 1 to 4: the federal waterways according to Annex I of the Inland Waterway Ordination of 6 December 2008 (BGBl. 2450), as amended;
2.
Vehicles: inland waterway vessels, including small vehicles and ferries, as well as floating equipment, swimming bodies and sea-ships;
3.
Inland waterway radio: International mobile VHF radio service between land radio stations and ship stations or between ships ' radio stations on inland waterways, which includes the following transport routes:
a)
Ship ship,
b)
Nautical Information,
c)
Ship Port Authority,
d)
radio traffic on board,
e)
Public exchange of information;
4.
Radio equipment: ship radio station on board of a vehicle; it may consist of several radios;
5.
Regional Agreement: the Regional Agreement on Inland Waterway Radio of 6 April 2000 (BGBl. 1213);
6.
Manual inland waterway: the manual published by the Central Commission for the Navigation of the Rhine in Strasbourg and by the Danube Commission in Budapest in accordance with the Regional Agreement Resolution No 1 of the Regional Agreement, and Inland waterway radio, including the regional parts, in the current version made known by the Federal Ministry of Transport, Building and Urban Development;
7.
Land radio station: fixed radio station of the inland waterway;
8.
Ship's radio station: mobile radio station of the inland waterway which is on board a vehicle which is not permanently fixed.

Section 2
Operating rules

§ 3 Basic rules

(1) The radio service at a ship's radio station may only be carried out in accordance with the Regional Agreement and the inland waterway manual. (2) The VHF channels of the vessel ship, ship-port authority and Radio traffic on board may only be used if the output power of the transmitter is automatically limited to a value of between 0.5 Watt and 1 Watt. In the VHF channels in the Nautical Information traffic circle, the output power must be set to a value of between 6 watts and 25 watts. (3) All fixed and portable radio equipment must be provided via an automatic transmitter identification system in the Automatic Transmitter Identification System (ATIS). Unofficial table of contents

§ 4 Permission

Anyone who wishes to operate or supervise a ship's radio station on waterways in zones 1 to 4 shall require the authorisation of the competent authority in accordance with the provisions of this Regulation. It shall apply indefinitely. The competent authority is the authority of the water and shipping authority for traffic techniques at the water and shipping office Koblenz. (2) This permission is verified by a VHF radio certificate (UBI (Appendix 1)). (3) No permission is required the holder of a

officially approved VHF radio certificate (UBI (Appendix 2)),
2.
UKW radio communications for inland waterway broadcasting, issued by a contract administration of the Regional Agreement on the basis of this Agreement,
3.
the radio certificate recognised and valid by the competent authority,
4.
A radio certificate issued before the entry into force of this Regulation and entitled to participate in the inland waterway radio.

§ 5 Special duties

Only messages relating to the protection of human life, the voyage or the safety of vehicles may be transmitted in the ship-ship, nautical information and ship-port authority transport routes.

Section 3
Acquisition of permission; radio certificates

§ 6 Requirements for the acquisition of permission

§ 7 Examination requirements

(1) The applicant shall submit the application for admission to the examination and issue of the permit, with the following information, to the competent authority through the examination board:
1.

(2) The application shall be accompanied by:
1.
a copy of the valid passport or identity card,
2.
two identical passport pictures from more recent times.
(3) The applicant shall be admitted for examination if:
1.
the minimum age (§ 6), and
2.
the fees (§ 16) have been received.
By way of derogation from the first sentence of paragraph 1, an applicant may also be admitted to the examination three months before the minimum age has been reached. Unofficial table of contents

Section 8 Examination committees

(1) The competent authority shall set up audit committees and appoint their chairpersons, alternates and reviewers as required. It makes the locations of its examination committees known in the Official Journal. § 9 Examination

(1) In an examination, the applicant must prove, in accordance with the test programme (Appendix 3), that he/she is
1.
have sufficient knowledge of the rules governing participation in inland waterway radio and the operational and technical knowledge required for the proper operation of the radio system (theoretical part), and
2.
is capable of practical application (practical part).
(2) The Chairman of the Audit Committee or his deputy shall determine the date of the examination and shall convene the Examination Committee consisting of three examiners. The Examination Committee takes the examination. (3) The Chairman of the Examination Commission is in charge of the examination. It shall be carried out in accordance with the provisions of Appendix 4. The examination was only a unanimous decision of the Examination Committee. A transcript is to be recorded on the course of the examination. (4) If the applicant has demonstrated the competence to participate in the inland waterway radio and for the proper operation of the radio system, the applicant will be allowed by the Exhibition of an open-ended valid VHF radio certificate (UBI) according to the model of Appendix 1. § 10 Grant without examination

The competent authority shall, on presentation of one of the certificates referred to in Article 4 (3) (3) and (4) or a certificate recognised by the competent authority on a successful test to participate in the inland waterway radio system, give the Holder on request without further examination and issued a VHF radio certificate (UBI). § 11 Replacement of spare parts

If a VHF radio certificate (UBI) or a radio certificate pursuant to section 4 (3) no. 4 has become unusable, lost or otherwise lost, the competent authority shall, upon request, issue a replacement copy, which shall be marked as such. Section 12 Withdrawal

(1) The competent authority must withdraw a permit if the holder is proven to be
1.
has infringed provisions on inland waterway radio in a dangerous manner, or
2.
is no longer capable of properly participating in inland waterway radio, in particular having sufficient hearing or communication capability or visual acuity; the competent authority may, in cases of doubt, submit the proposal require specialist medical certificates.
(2) The competent authority may withdraw a permit if:
1.
the holder has been shown to have breached provisions relating to inland waterway radio in a rough manner,
2.
where the holder has found evidence that he is no longer in a position to properly participate in the inland waterway radio system.
In such cases, the competent authority may depart from the withdrawal if the person concerned again successfully submits an examination. This examination is limited to the knowledge and skills referred to in Appendix 3, which have been objectionable. (3) The permission shall be issued with the withdrawal. The VHF radio certificate (UBI) shall be delivered immediately to the competent authority, even if the withdrawal of the licence has been challenged and the immediate enforcement of the withdrawal has been ordered. (4) The competent authority may, (5) The competent authority shall immediately inform the water protection police of the countries of the withdrawal of the licence, provided that the holder of the VHF radio certificate is (UBI) has not fulfilled its obligation under paragraph 3. (6) Water protection police officers of the countries inform the competent authority of the facts known to them, which can justify a withdrawal. (7) Paragraphs 1 to 6 shall apply for certificates pursuant to § 4 (3) (4). (8) In the cases referred to in paragraph 1 and 2, the competent authority may prohibit the operation of a ship's radio station or a seefuncture on the waterways of zones 3 and 4, in accordance with Article 4 (3) (2) and (3). Section 13 Information

The competent authority may, for the purposes of the information given by the competent authority, collect the personal data stored from the list of the licences issued, as far as it is necessary to do so.
1.
Implementation of administrative tasks according to the Act of Inland Navigation Act or pursuant to this Act or the Law on the Law of the Sea, adopted by the Federal Government's Water and Shipping Administration, which water protection police in the countries and the regulatory authority for postal and telecommunications, and the audit committees,
2.
Prosecution of crimes related to shipping, in courts, public prosecutors, police departments of the Länder and the Federal Criminal Police Office as a law enforcement agency,
3.
Prosecution of administrative offences in the field of shipping to courts, public prosecutors, water and maritime administration services of the federal government and police forces of the Länder

§ 14 Official VHF Radio Certificate (UBI)

The officially approved UKW speech certificate (UBI) is based on the model of Appendix 2 of examination committees of the German Motoryachting Association (Deutscher Motoryachtverband e. V. and the Deutscher Segler-Verband e. V.). § § 6, 7 para. 2, 3 sentence 2, § 8 para. 2, § 9 para. 1 to 3, 5 to 7 and in accordance with § 7 para. 1, § 9 para. 4, § § 11 to 13 apply. The competent authority may prohibit the issuing of the officially recognised VHF radio certificate (UBI) to the above authorities if the facts justify the assumption that they, their examination committees or their examiners are repeated or grossly Have infringed the provisions of sentence 2.

§ 15 Administrative Offences

Contrary to the provisions of Section 7 (1) of the Act on Inland Waterways, those who intentionally or negligently act in the same way
1.
, contrary to § 3 para. 2 sentence 1 or 2, use a FM channel,
2.
, without permission pursuant to § 4 (1), a ship's radio station or a seefuncture service,
3.
, contrary to § 5 other messages,
4.
Contrary to § 11 sentence 2 or contrary to § 12 (3) sentence 2, in connection with § 14 sentence 2, a certificate is not delivered or not delivered in time, or
5.
Contrary to a fully-enforceable prohibition pursuant to § 12 para. 8 sentence 1, a ship's radio station or a seefuncture service is served.

Section 18 Entry into force, external force

Rules for the course of the examination

1.
Upon request, the applicant must show himself/herself by presenting the valid identity card or passport before the examination begins.
2.
If the applicant resigns for reasons other than compelling health reasons during the examination, the examination shall be deemed not to pass.
3.
Unauthorized aids, such as Books, calculators, etc. or foreign assistance may not be used during the examination. In the case of a deception test, the test shall be deemed not to pass; this shall also apply to test parts which have already been successfully carried out. Prior to the start of the examination, the Chairperson shall inform the candidates of the consequences of a deception attempt.

Evidence of sufficient knowledge of the rules governing participation in inland waterway radio as well as the operational and technical knowledge required for the proper operation of the radio system by means of a written examination Answering a questionnaire, whereby at least 80 per cent of the possible score is reached muss.The processing time for a questionnaire from the questionnaire, which is made known in the traffic leaf, is 60 minutes.
