§ 2 Control of transfers

(1) As far as this Act changes the classification of offices, official allowances and official designations, the offices concerned are listed in the annex. (2) The Offices "Staff of Staff in the Federal Border Guard" and "Oberstabsmeister im Bundesgrenzschutz" ("The Offices of the Federal Border Guard") and the " Oberstabsmeister im Federal border protection " shall be the future of offices in the annex to the legal regulation pursuant to Article IX (4) (5) of the Second Law for the Unification and Reregulation of the Law of Remuneration in the Federal Government and the Länder of 1. October 1975 (Bundesgesetzbl. 2608). (3) The "Oberers in the Federal Border Guard" and "Oberabilities zur See im Bundesgrenzschutz" ("OberSkills in the Federal Border Guard"), which are transferred to the Office of Police Chief in the Federal Border Protection Act, receive a transfer allowance in this office after the Article IX § 11 of the Second Law for the Unification and Reregulation of the Law of Remuneration in the Federal Government and the Länder. § 3 Transitional provisions

(1) An entitlement to a service time premium, which is established pursuant to Section 77 (3) sentence 1 of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz) in the version in force until 30 June 1976 only after that date, shall not be affected by § 1 no. 2. (2) One pursuant to § 77 of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz) in the version valid until 30 June 1976 is to be repaid if the service relationship before the expiry of the period used for the calculation is based according to § § 2 and 9 of the German Federal Law on Service. Federal Police Officials Act in conjunction with Section 13 (1), Section 14 (1) and (2), § § 31, 32 (2), § § 33, 34 (1) no. 1 or 2, § 40 (2) or § 41 1 of the Federal Civil Service Act or by dismissal for the incapacity of police officers (Section 4 (1) of the Federal Police Officer Act), which the official has deliberately brought about. If the official has already completed a period of service which, in accordance with Section 77 (2) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz), would have been entitled to a lower service-time premium in the version in force until 30 June 1976, the amount shall be left to the official. which would have been granted to him as a service grant if he had declared, in accordance with Section 8 of the Federal Police Service Act, that he would be required to pay the service period which is decisive for the lower service period. In the amount resulting from the first and second sentences, the entitlement to the service time premium which has not yet been paid shall cease. (3) A procedure which is expected to terminate the payment of the service period shall be initiated before the payment of the service period premium. The payment of the service from one of the reasons set out in the first sentence of paragraph 2 shall be suspended until the conclusion of this procedure. (4) Insofar as the previous paragraphs refer to the provisions of the Federal Police Service Act (Bundespolictengesetz) , the version in force until 30 June 1976 shall prevail.
