§ 1 Scope

(1) This law applies to the geodetic reference systems, reference networks and geotopographical reference data of the federal government and within the framework of the usage rights for the data of the official surveying system as well as geotopographical reference data from third parties. They are intended to provide the authorities of the federal and state governments as well as the economy, society and science in the required quality for those in the Geodata Access Act of 10 February 2009 (BGBl. 278) and usages regulated by this Act. (2) The Federal Government's geodata-holding bodies shall ensure that the qualitative and technical specifications for the geotopographical data collected or prepared by them are Reference data and associated metadata, as well as for geodetic reference systems and networks, shall be complied with, so as to ensure a simple exchange and wide use referred to in the second sentence of paragraph 1. § 2 Definitions

1.
Geotopographical reference data are those geodata that describe or map the geotopography application-neutral in a uniform geodetic reference system.
2.
Geodetic reference systems are coordinate systems that describe location, height and gravity information in space and time. They are implemented by geodetic reference networks.
3.
Geodata models are data models that describe the landscape according to uniform modeling regulations by geotopographical reference data in a neutral way. They are implemented through digital landscape models.
4.
Cartographic models are depictions with which geotopographic reference data are illustrated in an application-related cartographical form. They are implemented by maps in digital and analogue form. Representations of the geotopography are also generated by methods of remote sensing.

§ 3 Bundesamt für Kartographie und Geodäsie

(1) The Federal Office of Cartography and Geodesy is an independent federal authority in the division of the Federal Ministry of the Interior. (2) The Federal Office of Cartography and Geodesy has the order, geodetic reference systems and networks as well as collect, process and use geotopographical reference data of the Federal Government for use by federal authorities and for the fulfilment of Germany's Union law and international obligations, insofar as these do not fall within the competence of others Federal authorities are falling. In this connection, the availability of the geodetic reference systems and networks as well as the geotopographical reference data of Germany and of other Member States of the European Union shall be ensured. (3) The Federal Office shall, in particular, have the following Tasks:

2.
Provision and maintenance of the national superordinate geodetic reference networks, including the necessary technical and theoretical services for the collection and processing of the measurement data,
3.
participation in bilateral and multilateral work on the establishment and maintenance of global geodetic reference systems and networks, as well as the further development of the measurement and observation technology used,
4.
Coordination of the setup and expansion as well as the maintenance of the federal share of the spatial data infrastructure for Germany,
5.
Operation of a service center of the federal government, which coordinates the geodetic reference systems and networks as well as geotopographical reference data of the federal government, collects the need for geodata, it via a geoportal or by means of other needs-oriented technology and supports federal authorities in the standard-compliant development and use of their geodata services,
6.
Representation of technical interests of Germany at European and international level, including participation in the preparation of civil programmes and legislation, as well as in the methodological and technical preparation and Harmonisation of cartographic and geodetic products.

§ 4 Further geotopographical reference data leading positions of the federal government

Geotopographical reference data of the Federal Government are those federal authorities that collect, process and use geotopographical reference data of the Federal Government. The geotopographical reference data as well as geodetic reference systems and networks of the federal government, insofar as they do not fall within the competence of the Federal Office for Cartography and Geodesy, will be guided by the other geotopographical reference data Federal offices are collected, processed and used for use by federal authorities and in order to comply with Germany's European Union and international obligations. § 5 Exchange among authorities

(1) The geodata-holding authorities of the federal government shall grant themselves access to the geotopographical reference data available or prepared for the performance of their public tasks. (2) The geotopographical reference data shall be provided by the authorities responsible for the geotopographical reference data. The Federal Government does not require any consideration for the provision of geotopographical reference data of the Federal Government, insofar as its use is not of an economic nature for the purpose of carrying out public tasks. § 6 Technical guidelines of the Interministerial Committee for Geoinformation

(1) The geodata-holding authorities of the federal government which collect or compile geotopographical reference data shall comply with the qualitative and technical requirements of § 1 paragraph 2 according to the state of the art. Compliance with the state of the art is presumed if the Technical Guidelines of the Interministerial Committee for Geoinformation Engineering in the respective electronic Federal Gazette *) (2) The Interministerial Committee on Geoinformation is empowered to agree on technical directives
1.
specify the qualitative and technical specifications for the parent geodetic reference systems to be used in federal authorities, in particular:
a)
the applicable national, Union and international technical standards;
b)
the geodetic date and the type of coordinate mapping, as well as the description of coordinate transformations between different geodetic date definitions,
c)
quality requirements,
d)
the establishment, provision, care and point-density and spatial delimitation of the geodetic fixed-point field,
2.
to determine the qualitative and technical specifications for the geotopographical reference data to be used in federal authorities, which are described in a uniform geodetic reference system, in particular:
a)
geodata models,
b)
cartographic models,
c)
Remote sensing products within the meaning of section 2 (4) sentence 3;
d)
quality requirements,
e)
spatial demarcation and
f)
technical provision, and
3.
to determine the qualitative and technical specifications for optimal networking (interoperability) and to determine the geotopographical reference data of the federal government, either alone or in conjunction with other data, in relation to the Federal Geodata Services of the Federal Republic of Germany. electronic form.
The specifications of the qualitative and technical specifications are carried out in agreement with the surveying administrations of the Länder. In order to ensure that the standards applicable to European Union and international standards are met, further provisions can be made in consultation with the surveying administrations of the countries. (3) For the geodetic reference networks and the geotopographical reference data the type and periodicity of the historicization must be documented in the Directives. Section 7 Entry into force

This Act shall enter into force on 1 November 2012.
