§ 1 Legal Form, Name

In the division of the Federal Ministry for Consumer Protection, Food and Agriculture (Federal Ministry), a "Federal Institute for Risk Assessment" (Bundesinstitut) as a federal law-capable institution under public law is published. set up. Unofficial table of contents

§ 2 Activities

(1) The Federal Institute shall act, without prejudice to existing responsibilities of other institutions of the Federal Government, for matters relating to human health, in particular in the following fields:
1.
Preparation of scientific elaboration, expert opinions and opinions on issues directly or indirectly related to food safety or consumer protection in relation to human health, including questions of Nutrition and nutrition prevention and, where feedingstuffs, feed additives, the marketing and use of medicinal products intended for use in animals, and pharmacologically active substances used in animals, with the exception of: Animal vaccines, also with regard to animal health in the relationship,

scientific advice from the Federal Ministry and other top federal authorities, insofar as the Federal Institute is responsible for the activities of its division, as well as the Federal Office for Consumer Protection and Food Safety in all matters concerning: belong to the activities of the Federal Institute,

Cooperation with the services of the European Community, in particular the European Food Safety Authority, as well as with other scientific institutions at national and international level, and coordination of the scientific information exchange in the field of food safety and consumer protection,

Evaluation of the health hazards of chemicals, documentation and information on poisoning events,
6.
Collection and evaluation of replacement and supplementary methods for animal testing,
7.
risk assessment of genetically modified animals, plants and micro-organisms as well as of genetically modified feed and feed additives,
8.
health issues relating to the transport of dangerous goods, in particular toxic and corrosive substances;
9.
Participation in monitoring according to § § 50 to 52 of the Food and Feed Code as well as to nationwide surveys in the field of feed and feed additives,
10.
The functioning of a Community or national reference laboratory where, by means of legislative acts or on the basis of acts of the European Community, this activity is carried out by the Federal Health Office or by the Federal Institute for health protection and veterinary medicine, and this activity is not carried out by any other body;
11.
the performance of a Community or national reference laboratory where the Federal Institute is designated for this activity by legislative acts or on the basis of legal acts of the European Community;
12.
to inform the public in its fields of activity of risks of a health nature and of other findings and results obtained; the provisions of the Product Safety Act shall remain unaffected,
13.
Information and advice to the Federal Government in the field of the effects of plant protection products in relation to human and animal health.
(2) In carrying out its activities, the Federal Institute may draw up scientific findings from the research institutes in the field of business of the Federal Ministry as well as other scientific institutions. To the extent that the scientific institutions referred to in the first sentence are those of the Länder, their findings should be included within the framework of a trusting cooperation. § 3 Task Implementation

(1) The Federal Institute shall carry out the administrative tasks of the Federal Government, which are assigned to the Federal Institute by law or under a law, within the scope of the activities assigned to it by § 2 (1). (2) The Federal Institute shall, if: No other jurisdiction is laid down by law, tasks of the Federal Government in its field of activity, with the implementation of which the Federal Institute is mandated by the Federal Ministry. § 4 Institutions

(1) The organs of the Federal Institute shall be the President or the President and the Executive Board. (2) The tasks and powers of the institutions shall be determined by the Statute, insofar as they are not governed by this Law. Unofficial table of contents

§ 5 President or President

(1) The President or the President shall conduct the business on his own responsibility in accordance with the provisions of this Act and of the Statute. § 6 Executive Board

(1) The Executive Board shall consist of the President, the Vice-President or the Vice-President and the Head of Department of the Federal Institute. § 7 Statute

The Board of Directors, by a majority of its members, shall adopt a statutes for the Federal Institute; Section 6 (4) shall not apply. the rights and obligations of the institutions of the Federal Institute,

§ 8 Supervision

(1) The Federal Institute is subject to the supervision of the Federal Ministry, which is limited to the supervision of the law in the cases of § 2 (1) (12) and (3). To the extent that the Federal Institute performs tasks from a different business unit than that of the Federal Ministry, it is subject to the technical instructions of the competent supreme federal authority. Section 9 Budget

(1) The Federal Institute shall have the revenue to be expected and the expenditure likely to be incurred in a budget. § 10 Officials and Officials

§ 11 Employees, workers and workers

§ 12 Takeover of civil servants and employees

(1) The Federal Institute for Health Consumer Protection and Veterinary Medicine shall, subject to the provisions of Section 7 (1) and (2) of the BVL Act, become official with the entry into force of this Act. Section 13 Transitional measures

(1) After the establishment of the Federal Institute, elections to the Staff Committee shall take place within six months of the entry into force of this Act. Pending the constitution of the Staff Council, the tasks of the Staff Committee of the Federal Institute shall be the temporary staff council of the Federal Institute for Health Protection and Veterinary Medicine of the Federal Institute for Health Protection and Veterinary Medicine. (2) The transitional staff council shall immediately appoint the Executive Board for the conduct of the election of the personnel council in the Federal Institute. (3) Paragraphs 1 and 2 shall apply accordingly to the representation of youth and trainees as well as to the Disability representation. (4) After the establishment of the Federal Institute shall take place within six months of the entry into force of this Act, the election of the Equal Opportunities Officer and of her Deputy. Until the appointment of the Equal Opportunities Officer and her deputy at the Federal Institute, her duties will be carried out by the former Equal Opportunities Officer and her deputy at the Federal Institute for Health Consumer Protection and veterinary medicine.
