§ 1 Fees and Deposits

(1) The Federal Agency for Nature Conservation charges fees and expenses for individually attributable public services in accordance with the Federal Nature Protection Act and the Environmental Damage Act. (2) The provisions of this cost regulation shall apply in accordance with the requirements of the of the United Nations Convention on the Law of the Sea of 10 December 1982 (BGBl. 1994 II p. 1798, 1799; 1995 II p. 602) also in the area of the German exclusive economic zone and the continental shelf. (3) The chargeable facts and the amount of the fees are the result of the applicable fee list. (4) Expositions are levied in accordance with § 23 (6) of the Federal Law on Fees. If the deposits do not reach the amount of 5 euros, they will not be collected. Unofficial table of contents

§ 2 Use of plant (leaves) n, exemption and reduction of fees for imports, exports or exports from third countries according to the fifth chapter of the Federal Nature Protection Act, Regulation (EC) No 338/97 and Regulation (EC) No 865/2006

(1) At the request of the fee debtor, a waiver of fees shall be granted where the specimens are intended for scientific research and teaching, which contribute in particular to the conservation of the species concerned, or to scientific research. Arterial rearing programs are in or performed. The use of the copies for mainly commercial purposes excludes a waiving of fees. Proof may be required by the debtor of the fees a certificate issued by a recognised scientific institution stating that the specimens are used for the purposes mentioned above. (2) A fee exceeds the value of the goods. more than 30 percent, a reduced fee, but at least five euros, can be charged. The value of the goods refers only to the part of the goods subject to the authorization. If the customs value is already known at the time of approval, the customs value shall be the value of the goods. (3) If a permit or certificate referred to in Article 2 (1) of Commission Regulation (EC) No 865/2006 of 4 May 2006 is notified, the customs value shall be the value of the value of the goods. Detailed rules for the application of Council Regulation (EC) No 338/97 on the protection of species of wild fauna and flora by regulating trade therein (OJ L 378, 31.12.1997, p. 1), as amended by Regulation (EC) No 100/2008 (OJ L 145, 31.5.2008, p. 3), as amended, an annex pursuant to Article 6 of Regulation (EC) No 865/2006 concerning the extension of the authorisation to other species, or to the specification of information in box 8 or 21 of the In Annex I to Regulation (EC) No 865/2006, a first investment sheet is added, the fee shall be increased by half the fee laid down in the list of fees for the approval or certificate. To the extent that further investment sheets with up to 20 species names per investment sheet are added to the specification in boxes 8 or 21 above the first investment sheet, the fee will be increased by EUR 10 for each additional investment sheet required. § 3 Fees in special cases

For the withdrawal or revocation of an administrative act, the rejection of an application for the acceptance of an individually attributable public service as well as in the cases of the withdrawal of an application for the acceptance of an individually attributable Public service charges are levied in accordance with § 23 (5) sentence 1 and 2 of the Federal Law on Fees. Section 4 Rejection or withdrawal of an appeal against a substantive decision

(1) For the full or partial refusal of an objection to a substantive decision, a fee may be levied up to the amount of the fee fixed for the contested administrative act. This does not apply if the contradiction has not been successful only because the infringement of a procedural or formal provision according to § 45 of the Administrative Procedure Act is inconformable. (2) If there is an objection to a decision of the kind after the beginning of the proceedings, the decision shall be taken as the first time. However, the fee shall not exceed 75 per cent of the fee referred to in paragraph 1, but shall be withdrawn before the end of the processing. Unofficial table of contents

§ 5 Rejection or withdrawal of an objection exclusively directed against the fixing of fees or charges

A fee of up to ten per cent of the amount in question may be charged for the complete or partial refusal and withdrawal of an objection exclusively directed against the fixing of fees or charges. Unofficial table of contents
