This Regulation provides for the implementation of the following EC directives for the area of mountain law in conjunction with the Bundesberggesetz:-
Council Directive 95 /63/EC of 5 December 1995 amending Directive 89 /655/EEC on the minimum safety and health requirements for the use of work equipment by workers at work (second individual Directive in the sense of Article 16 (1) of Directive 89 /391/EEC) (OJ L 327, 30.4.1989 EC No L 335 p. 28),

Council Directive 97 /11/EC of 3 March 1997 amending Directive 87 /337/EEC on the assessment of the effects of certain public and private projects on the environment (OJ L 378, 27.11.1997, p. EC No L 73 p. 5).

On the basis of § 57c and 66 sentence 1 No. 1 (b), No. 2, 3, 5, 6, 9, 10 and sentence 3, § 67 No. 1 and 8 and § 68 (2), in conjunction with § 126 (1) sentence 1 and paragraph 3 and § § 128 and 129 of the Federal Mining Act of 13 August 1980 (BGBl. 1310), as last amended by Article 23 of the Law of 18 June 1997 (BGBl I). 1430), the Federal Ministry of Economic Affairs, in agreement with the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety, as far as the rules are based on § 57c of the Federal Mining Act, and also in agreement with the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety. Art 6 Transitional provision to Article 5

The procedures already initiated at the time of the entry into force of this Regulation relating to projects subject to operations planning within the meaning of Article 1 of the Regulation referred to in Article 5 shall be brought to an end in accordance with the provisions in force so far. Type 7 Entry into force

This Regulation shall enter into force on the day after the date of delivery, unless otherwise specified in the second sentence. ... Articles 5 and 6 shall enter into force on 14 March 1999.
