§ 1 Scope

The Federal Railway Authority and the Federal Network Agency for Electricity, Gas, Telecommunications, Post and Railways (Regulatory Authority) levy for their individually attributable public services in accordance with the General Railway Act and after the Federal Railway Traffic Management Act (Bundeseisenbahnverkehrsverwaltungsgesetz) Fees and deposits under this Regulation. § 2 Fees

(1) The fee-based, individually attributable public services and the fees are derived from the list of fees (Appendix 1). (2) Insofar as the fee is fixed according to the amount of time spent, the hourly rate is 100 euros, for each 25 Euro for 15 minutes. The hourly rate for individually attributable public services in accordance with Annex 1, Part I and III is EUR 120, for each quarter of an hour 30 EUR. (3) For the retribution of multiple, individually attributable public services for the same charge debtor may be subject to a lump-sum fee on his application. It shall be fixed in advance for a period of one year on the basis of a calculated average fee, taking into account the lower level of administrative expenditure. (4) The charge debtor shall have the fee to be charged for the fee. , in the case of an individually attributable public service, on request, already with its position. Unofficial table of contents

§ 3 Fee exemption

No fees will be charged for a decision of the regulatory authority pursuant to Section 14f (2) of the General Railway Act and for the investigation of dangerous events in the railway operation. Unofficial table of contents

§ 4 Contradiction

A fee is levied for the full or partial refusal of an objection up to the level of the fee fixed for the contested administrative act; this does not apply if the appeal is not successful only because the Infringement of a procedural or formal provision according to § 45 of the Administrative Procedure Act is incontetable. In the event of an unsuccessful appeal, which shall be directed exclusively against a fixing of fees, the fee shall not exceed 10 per cent of the sum in question. If an appeal is withdrawn after the commencement of its factual processing, but before its completion, the fee shall not exceed 75 per cent of the opposition fee. Unofficial table of contents

§ 5 Revocation, withdrawal, rejection and withdrawal of applications

For the revocation or withdrawal of an administrative act, the rejection of an application for an individual attributable public service, and in the cases of withdrawal of an application for the acceptance of an individually attributable Public service charges are levied in accordance with § 23 (5) sentence 1 and 2 of the Federal Law on Fees. § 6 Deposits

(1) In addition to the fees, expenses shall be paid by the charge debtor in accordance with § 10 (1) (4) and (5) of the Administrative Cost Act of 23 June 1970 (BGBl). 821) in the version in force on 14 August 2013. § 7 Alt-Facts

(4) For Facts which arose from 14 July 2007 and until the end of the period of 21 January 2008, Section 2 (1) shall apply with the proviso that the chargeable, individually attributable public services and the fees from the List of charges of Appendix 5. (5) For matters which are due to expire on 22 January 2008 and up to the end of the 30 years. (6) In the cases referred to in paragraphs 1 and 2, § 2 (1) shall apply with the proviso that the fee-based, individually attributable public services and the fees are derived from the fee list of Appendix 6. (6) (7) § 6 (2) and Annex 1 (1) (1) (1.18) and (1.19) shall apply to facts established prior to 24 July 2014 only insofar as they relate to official acts and to individually attributable public services in accordance with § 7g Paragraphs 1 to 3 of the General Railway Act. § 8 Entry into force, external force

Billing appendix appendix to the fee schedule application
1.
The measurement of charges for points 2.1 to 2.4 and 2.6 to 2.10 shall be based on the construction costs and the valuation characteristics classified according to difficulty levels in charge zones.
2.
The costs for the fee measurement are not included in the cost of:
a)
the acquisition, the opening up, the production and the development of the land,
b)
Winterbauschutzvorconversions,
c)
surveying and marketing,
d)
compensation and compensation for damages,
e)
Bathing costs,
f)
Works of art and artistically designed components, insofar as they are not essential components of the object.
3.
Likewise, the costs for signal, telecommunications and electrical installations are not part of the construction costs in the sense of the fee measurement according to the tables 2 and 4.
4.
For tables 1 and 3, the operating installations shall be charged with the following charge zones:
a)
Zone 1: Objects with very low planning requirements, e.g. B. Operating systems without switches and crossings, unless mentioned in zones 2 to 5, simple traffic areas;
b)
Zone 2: Objects with low planning requirements, e.g. B. Operating systems of the free route without special compulsion points, operating systems of the free route in the little moving terrain, operating facilities of the stations with simple track plans;
c)
Zone 3: Objects with average planning requirements, e.g. (b) local plants, unless mentioned in Zone 4, operating installations of the free route with special forced points, operating installations of the free route in the moving terrain, operating facilities of the stations with difficult track plans;
d)
Zone 4: Objects with above-average planning requirements, e.g. (b) difficult internal facilities, operating installations of the free route with a large number of specific compultrating points, operating installations of the free route in the heavily moved terrain, operating facilities of the stations with very difficult track plans, Transport areas for goods handling in combined transport;
e)
Zone 5: Objects with very high planning requirements, e.g. B. very difficult intra-local operations.
5.
For Table 2, the following charge zones are added to the engineering structures:
a)
Zone 1: Objects with very low planning requirements, e.g. B. simple earthworks, webs, noise barriers, pipes for water or waste water without compulsion points;
b)
Zone 2: Objects with low planning requirements, e.g. B. Dammbauts, as far as not mentioned in Zone 3 or 4, straight single-field bridges of simple design, support structures with traffic load, simple noise protection systems, lines for water and waste water with small links and a few compullitions;
c)
Zone 3: Objects with average planning requirements, e.g. B. difficult dams, single-field bridges, as far as not mentioned in Zone 2 or 4, simple multi-field and arched bridges, support structures with anchorage, simple tunnel and trough structures, simple underground stations, lines for water or waste water with numerous links and numerous compulsion points;
d)
Zone 4: Objects with above-average planning requirements, e.g. Particularly difficult dams, difficult fields of single-field, multi-field and arched bridges, noise protection systems in difficult urban situations, difficult tunnel and trough structures, difficult underground stations, as far as not mentioned in Zone 5;
e)
Zone 5: Objects with very high planning requirements, e.g. B. particularly difficult bridges, particularly difficult tunnel and trough structures, underground crossing railway stations.

The charge zone of Table 4 is determined on the basis of the following evaluation characteristics in the case of high-rise buildings:
a)
Zone 1: Buildings with very low planning requirements, that is to say with

very low requirements for integration into the environment,

a functional area,
-
very low design requirements,
-
the simplest constructions,
-
None or simple technical equipment,
-
None or a simple extension;
b)
Zone 2: Buildings with low planning requirements, that is to say with

low technical equipment,

small extension;
c)

1.
The measurement of charges for points 301 to 303, 308 and 403 to 407 depends on the construction costs and on the valuation characteristics which have been allocated according to difficulty levels in charge zones.
2.
The costs for the fee measurement are not included in the cost of:
a)
the acquisition, the opening up, the production and the development of the land,
b)
Winterbauschutzvorconversions,
c)
surveying and marketing,
d)
compensation and compensation for damages,
e)
Bathing costs,
f)
Works of art and artistically designed components, insofar as they are not essential components of the object.
3.
Likewise, the costs for signal, telecommunications and electrical installations are not part of the construction costs in the sense of the fee measurement according to the tables 2 and 4.
4.
For tables 1 and 3, the operating installations shall be charged with the following charge zones:
a)
Zone 1: Objects with very low planning requirements, e.g. B. Operating systems without switches and crossings, unless mentioned in zones 2 to 5, simple traffic areas;
b)
Zone 2: Objects with low planning requirements, e.g. B. Operating systems of the free route without special compulsion points, operating systems of the free route in the little moving terrain, operating facilities of the stations with simple track plans;
c)
Zone 3: Objects with average planning requirements, e.g. (b) local plants, unless mentioned in Zone 4, operating installations of the free route with special forced points, operating installations of the free route in the moving terrain, operating facilities of the stations with difficult track plans;
d)
Zone 4: Objects with above-average planning requirements, e.g. (b) difficult internal facilities, operating installations of the free route with a large number of specific compultrating points, operating installations of the free route in the heavily moved terrain, operating facilities of the stations with very difficult track plans, Transport areas for goods handling in combined transport;
e)
Zone 5: Objects with very high planning requirements, e.g. B. very difficult intra-local operations.

For Table 2, the following charge zones are added to the engineering structures:
a)
Zone 1: Objects with very low planning requirements, e.g. B. simple earthworks, webs, noise barriers, pipes for water or waste water without compulsion points;
b)
Zone 2: Objects with low planning requirements, e.g. B. Dammbauts, as far as not mentioned in Zone 3 or 4, straight single-field bridges of simple design, support structures with traffic load, simple noise protection systems, lines for water and waste water with small links and a few compullitions;
c)
Zone 3: Objects with average planning requirements, e.g. B. difficult dams, single-field bridges, as far as not mentioned in Zone 2 or 4, simple multi-field and arched bridges, support structures with anchorage, simple tunnel and trough structures, simple underground stations, lines for water or waste water with numerous links and numerous compulsion points;
d)
Zone 4: Objects with above-average planning requirements, e.g. Particularly difficult dams, difficult fields of single-field, multi-field and arched bridges, noise protection systems in difficult urban situations, difficult tunnel and trough structures, difficult underground stations, as far as not mentioned in Zone 5;
e)
Zone 5: Objects with very high planning requirements, e.g. B. particularly difficult bridges, particularly difficult tunnel and trough structures, underground crossing railway stations.

The charge zone of Table 4 is determined on the basis of the following evaluation characteristics in the case of high-rise buildings:
a)
Zone 1: Buildings with very low planning requirements, that is to say with

very low requirements for integration into the environment,

a functional area,

very low design requirements,

the simplest constructions,
-
None or simple technical equipment,

None or a simple extension;

Billing appendix appendix to the fee schedule application
1.
The measurement of charges for points 301 to 303, 308 and 403 to 407 depends on the construction costs and on the valuation characteristics which have been allocated according to difficulty levels in charge zones.
2.
The costs for the fee measurement are not included in the cost of:
a)
the acquisition, the opening up, the production and the development of the land,
b)
Winterbauschutzvorconversions,
c)
surveying and marketing,
d)
compensation and compensation for damages,
e)
Bathing costs,
f)
Works of art and artistically designed components, insofar as they are not essential components of the object.
3.
Likewise, the costs for signal, telecommunications and electrical installations are not part of the construction costs in the sense of the fee measurement according to the tables 2 and 4.
4.
For tables 1 and 3, the operating installations shall be charged with the following charge zones:
a)
Zone 1: Objects with very low planning requirements, e.g. B. Operating systems without switches and crossings, unless mentioned in zones 2 to 5, simple traffic areas;
b)
Zone 2: Objects with low planning requirements, e.g. B. Operating systems of the free route without special compulsion points, operating systems of the free route in the little moving terrain, operating facilities of the stations with simple track plans;
c)
Zone 3: Objects with average planning requirements, e.g. (b) local plants, unless mentioned in Zone 4, operating installations of the free route with special forced points, operating installations of the free route in the moving terrain, operating facilities of the stations with difficult track plans;
d)
Zone 4: Objects with above-average planning requirements, e.g. (b) difficult internal facilities, operating installations of the free route with a large number of specific compultrating points, operating installations of the free route in the heavily moved terrain, operating facilities of the stations with very difficult track plans, Transport areas for goods handling in combined transport;
e)
Zone 5: Objects with very high planning requirements, e.g. B. very difficult intra-local operations.

For Table 2, the following charge zones are added to the engineering structures:
a)
Zone 1: Objects with very low planning requirements, e.g. B. simple earthworks, webs, noise barriers, pipes for water or waste water without compulsion points;
b)
Zone 2: Objects with low planning requirements, e.g. B. Dammbauts, as far as not mentioned in Zone 3 or 4, straight single-field bridges of simple design, support structures with traffic load, simple noise protection systems, lines for water and waste water with small links and a few compullitions;
c)
Zone 3: Objects with average planning requirements, e.g. B. difficult dams, single-field bridges, as far as not mentioned in Zone 2 or 4, simple multi-field and arched bridges, support structures with anchorage, simple tunnel and trough structures, simple underground stations, lines for water or waste water with numerous links and numerous compulsion points;
d)
Zone 4: Objects with above-average planning requirements, e.g. Particularly difficult dams, difficult fields of single-field, multi-field and arched bridges, noise protection systems in difficult urban situations, difficult tunnel and trough structures, difficult underground stations, as far as not mentioned in Zone 5;
e)
Zone 5: Objects with very high planning requirements, e.g. B. particularly difficult bridges, particularly difficult tunnel and trough structures, underground crossing railway stations.

The charge zone of Table 4 is determined on the basis of the following evaluation characteristics in the case of high-rise buildings:

Annex to the list of fees Part IApplication of the fee tables
1.
The measurement of charges for points 2.1 to 2.4 and 2.6 to 2.10 shall be based on the construction costs and the valuation characteristics classified according to difficulty levels in charge zones.
2.
The costs for the fee measurement are not included in the cost of:
a)
the acquisition, the opening up, the production and the development of the land,
b)
Winterbauschutzvorconversions,
c)
surveying and marketing,
d)
compensation and compensation for damages,
e)
Bathing costs,
f)
Works of art and artistically designed components, insofar as they are not essential components of the object.
3.
Likewise, the costs for signal, telecommunications and electrical installations are not part of the construction costs in the sense of the fee measurement according to the tables 2 and 4.
4.
For tables 1 and 3, the operating installations shall be charged with the following charge zones:
a)
Zone 1: Objects with very low planning requirements, e.g. B. Operating systems without switches and crossings, unless mentioned in zones 2 to 5, simple traffic areas;
b)
Zone 2: Objects with low planning requirements, e.g. B. Operating systems of the free route without special compulsion points, operating systems of the free route in the little moving terrain, operating facilities of the stations with simple track plans;
c)
Zone 3: Objects with average planning requirements, e.g. (b) local plants, unless mentioned in Zone 4, operating installations of the free route with special forced points, operating installations of the free route in the moving terrain, operating facilities of the stations with difficult track plans;
d)
Zone 4: Objects with above-average planning requirements, e.g. (b) difficult internal facilities, operating installations of the free route with a large number of specific compultrating points, operating installations of the free route in the heavily moved terrain, operating facilities of the stations with very difficult track plans, Transport areas for goods handling in combined transport;

For Table 2, the following charge zones are added to the engineering structures:
a)

Zone 2: Objects with low planning requirements, e.g. B. Dammbauts, as far as not mentioned in Zone 3 or 4, straight single-field bridges of simple design, support structures with traffic load, simple noise protection systems, lines for water and waste water with small links and a few compullitions;
c)
Zone 3: Objects with average planning requirements, e.g. B. difficult dams, single-field bridges, as far as not mentioned in Zone 2 or 4, simple multi-field and arched bridges, support structures with anchorage, simple tunnel and trough structures, simple underground stations, lines for water or waste water with numerous links and numerous compulsion points;
d)
Zone 4: Objects with above-average planning requirements, e.g. Particularly difficult dams, difficult fields of single-field, multi-field and arched bridges, noise protection systems in difficult urban situations, difficult tunnel and trough structures, difficult underground stations, as far as not mentioned in Zone 5;

Annex-Fee-list-Part Iapplication of the fee tables
1.
The measurement of charges for points 2.1 to 2.4 and 2.6 to 2.10 shall be based on the construction costs and the valuation characteristics classified according to difficulty levels in charge zones.
2.
The costs for the fee measurement are not included in the cost of:
a)
the acquisition, the opening up, the production and the development of the land,
b)
Winterbauschutzvorconversions,
c)
surveying and marketing,
d)
compensation and compensation for damages,
e)
Bathing costs,
f)
Works of art and artistically designed components, insofar as they are not essential components of the object.
3.
Likewise, the costs for signal, telecommunications and electrical installations are not part of the construction costs in the sense of the fee measurement according to the tables 2 and 4.
4.
For tables 1 and 3, the operating installations shall be charged with the following charge zones:
a)

For Table 2, the following charge zones are added to the engineering structures:
a)
Zone 1: Objects with very low planning requirements, e.g. B. simple earthworks, webs, noise barriers, pipes for water or waste water without compulsion points;
b)
Zone 2: Objects with low planning requirements, e.g. B. Dammbauts, as far as not mentioned in Zone 3 or 4, straight single-field bridges of simple design, support structures with traffic load, simple noise protection systems, lines for water and waste water with small links and a few compullitions;
c)
Zone 3: Objects with average planning requirements, e.g. B. difficult dams, single-field bridges, as far as not mentioned in Zone 2 or 4, simple multi-field and arched bridges, support structures with anchorage, simple tunnel and trough structures, simple underground stations, lines for water or waste water with numerous links and numerous compulsion points;
d)
Zone 4: Objects with above-average planning requirements, e.g. Particularly difficult dams, difficult fields of single-field, multi-field and arched bridges, noise protection systems in difficult urban situations, difficult tunnel and trough structures, difficult underground stations, as far as not mentioned in Zone 5;
e)
Zone 5: Objects with very high planning requirements, e.g. B. particularly difficult bridges, particularly difficult tunnel and trough structures, underground crossing railway stations.

The charge zone of Table 4 is determined on the basis of the following evaluation characteristics in the case of high-rise buildings:

The measurement of charges for points 2.1 to 2.4 and 2.6 to 2.10 shall be based on the construction costs and the valuation characteristics classified according to difficulty levels in charge zones.
2.
The costs for the fee measurement are not included in the cost of:
a)
the acquisition, the opening up, the production and the development of the land,
b)
Winterbauschutzvorconversions,
c)
surveying and marketing,
d)
compensation and compensation for damages,
e)
Bathing costs,
f)
Works of art and artistically designed components, insofar as they are not essential components of the object.
3.
Likewise, the costs for signal, telecommunications and electrical installations are not part of the construction costs in the sense of the fee measurement according to the tables 2 and 4.
4.
For tables 1 and 3, the operating installations shall be charged with the following charge zones:
a)
Zone 1: Objects with very low planning requirements, e.g. B. Operating systems without switches and crossings, unless mentioned in zones 2 to 5, simple traffic areas;
b)
Zone 2: Objects with low planning requirements, e.g. B. Operating systems of the free route without special compulsion points, operating systems of the free route in the little moving terrain, operating facilities of the stations with simple track plans;
c)
Zone 3: Objects with average planning requirements, e.g. (b) local plants, unless mentioned in Zone 4, operating installations of the free route with special forced points, operating installations of the free route in the moving terrain, operating facilities of the stations with difficult track plans;
d)
Zone 4: Objects with above-average planning requirements, e.g. (b) difficult internal facilities, operating installations of the free route with a large number of specific compultrating points, operating installations of the free route in the heavily moved terrain, operating facilities of the stations with very difficult track plans, Transport areas for goods handling in combined transport;
e)
Zone 5: Objects with very high planning requirements, e.g. B. very difficult intra-local operations.

For Table 2, the following charge zones are added to the engineering structures:
a)
Zone 1: Objects with very low planning requirements, e.g. B. simple earthworks, webs, noise barriers, pipes for water or waste water without compulsion points;
b)
Zone 2: Objects with low planning requirements, e.g. B. Dammbauts, as far as not mentioned in Zone 3 or 4, straight single-field bridges of simple design, support structures with traffic load, simple noise protection systems, lines for water and waste water with small links and a few compullitions;
c)
Zone 3: Objects with average planning requirements, e.g. B. difficult dams, single-field bridges, as far as not mentioned in Zone 2 or 4, simple multi-field and arched bridges, support structures with anchorage, simple tunnel and trough structures, simple underground stations, lines for water or waste water with numerous links and numerous compulsion points;
d)
Zone 4: Objects with above-average planning requirements, e.g. Particularly difficult dams, difficult fields of single-field, multi-field and arched bridges, noise protection systems in difficult urban situations, difficult tunnel and trough structures, difficult underground stations, as far as not mentioned in Zone 5;
e)
Zone 5: Objects with very high planning requirements, e.g. B. particularly difficult bridges, particularly difficult tunnel and trough structures, underground crossing railway stations.

The charge zone of Table 4 is determined on the basis of the following evaluation characteristics in the case of high-rise buildings:
