Type IV Transitional Rules

(1) The indisputability or the legal force of a prior notice of this Regulation This Regulation shall not preclude a decision on the basis of a new decision.(2) In the context of paragraph 1, a right to choose a pension for damage in the course of professional development shall be justified only in cases where the application of Article III establishes the conditions for exercising the right to vote in a pension. The decision shall be taken at the time of the unquestionability or the legal force of the decision taken before the date of delivery of this Regulation.(3) Insofar as before the proclamation of this Regulation claims by beneficiaries have been set unconditionally by a decision or by a final court decision, it shall retain the benefit of the beneficiaries in this case. The same shall apply in so far as the claims before the proclamation of this Regulation have been settled by an indisputable comparison. Non-official table of contents

Art V Application in Berlin

This regulation applies in accordance with Section 14 of the Third Transfer Act of 4. January 1952 (Bundesgesetzblatt I p. 1) in connection with § 240 BEG also in the Land of Berlin. Non-official table of contents

Type VI Entry into force

This regulation occurs with the exception of the second part of Article III, with effect from 1. October 1953 in force. The second part of Article III shall enter into force with effect from 1. April 1959, in force.
