Type IV Transitional provisions

(1) The unquestionability or the legal force of a decision taken prior to the proclamation of this Regulation shall not preclude a new decision under this Regulation. (2) A right of entitlement to a pension on the grounds of damage in the course of professional progress shall be justified within the framework of paragraph 1 only in cases where the application of Article III establishes the conditions for the exercise of the right to choose a pension. In so doing, the date of the unquestionability or the legal force of the decision prior to the proclamation of this Regulation shall be terminated. (3) Insofar as before the date of the proclamation of this Regulation the rights of the beneficiaries shall be determined by a decision or by a final decision of the right of a final decision. In this case, it shall be entitled to the right of appeal to the beneficiaries of the court. The same shall apply in so far as the claims before the proclamation of this Regulation have been settled by an indisputable comparison. Unofficial table of contents

Type V Application in Berlin

This Regulation shall apply in accordance with Section 14 of the Third Transfer Act of 4 January 1952 (Bundesgesetzblatt I p. 1) in conjunction with Section 240 BEG in the Land of Berlin as well. Unofficial table of contents

Type VI Entry into force

This Regulation shall enter into force, with the exception of the second part of Article III, with effect from 1. October 1953 in force. The second part of Article III shall enter into force with effect from 1 April 1959.
