This Regulation shall be used to implement the following Directives:

§ 1 Gender Equality

Impregnating agents in aerosol packaging for leather and textile products intended for domestic use and not products within the meaning of Article 2 (6), first sentence, of the Food and Feed Code, shall be: On an equal footing with needs. Unofficial table of contents

§ 2 Definitions

For the purposes of this Regulation:
1.
Food supplies: commodities within the meaning of § 2 (6) sentence 1 (1) of the Food and Feed Code;
2.
Food items made of cellular glass sheet: intended for use as food items
a)
uncoated cellular glass films,
b)
coated cell glass films with a coating obtained from cellulose, or
c)
coated cell glass films with a coating of plastic material within the meaning of Article 3 (2) of Commission Regulation (EU) No 10/2011 of 14 January 2011 on plastic materials and articles intended to be used with: to come into contact with food (OJ L 327, 22. 1; L 278, 25.10.2011, p. 13), as amended,
in each case, produced from regenerated cellulose obtained from wood not processed for other purposes or from cotton not processed for other purposes, whether or not coated on one or both sides, with the exception of: Artificial casings made of regenerated cellulose;

4.
Ceramic food items: articles intended for use as food items, articles made from a mixture of inorganic substances with a generally high content of clay or silicate, with the possible addition of small quantities of Quantities of organic substances are produced and burned after they have been formed. They can be burnt up and equipped with glazes or decor;
5.
Requirements made of vinyl chloride polymers:
a)
Subject-matter within the meaning of Article 2 (6), first sentence, point 3 of the Food and Feed Code,
b)
Subject-matter within the meaning of Article 2 (6), first sentence, point 5 of the Food and Feed Code, which come into contact with the mucous membranes of the mouth when used in the intended or pre-intended use; and
which are produced using vinyl chloride polymers or vinyl chloride copolymers;
6.
Baby articles: any product intended to facilitate sleep, relaxation, feeding and sucking of children, or to serve their hygienic care.

§ 3 Prohibited Substances

The materials referred to in Appendix 1 shall not be used for the commercial production or treatment of the materials listed in Appendix 1. Unofficial table of contents

§ 4 Authorized substances

(1) In the case of commercial production of food supplies from the cell glass films referred to in Article 2 (2) (a) and (b), only the substances listed in Appendix 2 may be used in compliance with the conditions laid down therein in column 2. Usage restrictions are used. Substances may only be used if they comply with the purity requirements laid down in column 4. Insofar as no purity requirements are laid down in column 4, the substances used must comply with commercial purity requirements with regard to their range of applications. By way of derogation from the first sentence, substances other than those referred to therein may also be used as dye and adhesive, provided that a transfer of the substances to the food in contact with the film or to the surface thereof in accordance with a recognised (1a) Only the substances listed in Annex 2, Part A, may be used for the commercial production of food supplies from the cell glass films referred to in § 2 (2) (c) before coating. Compliance with the use restrictions referred to in column 2. (2) Subject to the provisions of paragraph 3, the commercial manufacture of food items as defined in paragraph 2 (2) (c) of this Article shall be deemed to be subject to the following conditions:
1.
monomers or other starting materials,
2.
additives other than colouring agents,
3.
Excipients in the manufacture of plastics other than solvents and
4.
macromolecules obtained by microbial fermentation
only the substances listed in Annex I (1) (1) of Regulation (EU) No 10/2011 in the version in force on 1 January 2013, subject to compliance with the restrictions and specifications referred to in Annex I (1), Table 1, column 10 and point 4 of the Regulation (EU) No 10/2011 shall be used in the version valid on 1 January 2013. The substances may only be used if they comply with the general requirements laid down in Article 8, first sentence, of Regulation (EU) No 10/2011, as amended. Article 6 (3) of Regulation (EU) No 10/2011, as amended, shall apply accordingly. (3) By way of derogation from paragraph 2, the professional manufacture of food supplies within the meaning of Article 2 (2) (c) shall be allowed to: in respect of the coating as additives, the substances listed in Appendix 13 shall also be used, in compliance with the restrictions set out in Annex 13, column 4, provided that Article 3 (1) of Regulation (EC) No 1935/2004 does not (4) In the industrial production of materials and articles made of plastic in the sense of Article 3 (1) of Regulation (EU) No 10/2011 may, in addition to the additives authorised in accordance with Annex I to Regulation (EU) No 10/2011, also include the substances listed in Appendix 13 in compliance with the provisions of Annex 13, column 4. restrictions shall be used, provided that Article 3 (1) of Regulation (EC) No 1935/2004 does not preclude this. § 5 Forbidden Procedures

The procedures referred to in Annex 4 shall not be used in the manufacture of the materials referred to in Appendix 4. Unofficial table of contents

§ 6 Maximum quantities

Non-commercial vehicles may not be placed on the market
1.
food items made from a glass sheet if they contain the substances listed in Appendix 2 above the maximum levels set out in column 3,
2.
Food items within the meaning of section 2 (2) (c) if they are covered by the substances listed in Annex I, point 1, Table 1 of Regulation (EU) No 10/2011, in the version in force on 1 January 2013, in respect of the coating in addition to the maximum quantities laid down in column 10,
3.
items listed in Appendix 5, if they contain the substances referred to in column 3 above the quantitative limits laid down in column 4,
4.
items listed in Annex 5a, if they release the substances listed in column 3 of this Annex for the quantitative limits set out in column 4.
Sentence 1 no. 1 shall not apply to the extent that the coating is made of plastic within the meaning of Article 2 (2) (c). Unofficial table of contents

§ 7 Usage prohibitions

(1) Food requirements which do not comply with the requirements of § § 4 to 6 may not be used in the commercial production or treatment of foodstuffs. (2) Printed cell glass film may only be used for commercial purposes only in such a way that the printed side does not come into contact with food. Unofficial table of contents

Section 8 Transition of substances to food

(1) (omitted) (1a) (omitted) (1b) (omitted) (1c) In the case of the provisions of Article 1 (2) in conjunction with paragraph 3 of Commission Regulation (EC) No 1895/2005 of 18 November 2005 on the restriction of the use of certain epoxy derivatives in Materials and articles intended to come into contact with foodstuffs (OJ L 327, 30.4.2004, p. EU No 28), the materials and articles referred to in Annex I to Regulation (EC) No 1895/2005, which are transferred from the materials or articles to food, may be subject to the specific substances and articles specified in Annex I to Regulation (EC) No 1895/2005. Do not exceed the maximum migration levels. (1d) (omitted) (2) (omitted) (3) In the case of the food products listed in Appendix 6, shares of the substances referred to therein, which are transferred from the supplies to foodstuffs, shall be subject to the following: (4) Articles 10, 11, 12, 17 and 18 Regulation (EU) No 10/2011, as amended, shall apply in respect of food requirements as defined in Section 2 (2) (c) of the Regulation. § 9 Special warnings

Items listed in Appendix 7 may only be placed on the market for commercial purposes if the warning notices listed there are indelible, clearly visible, easily legible and indicated in German at the place referred to therein. . Unofficial table of contents

§ 10 Labelling, Follow-up duties

(1) (omitted) (1a) Food requirements made of cellular glass film may only be placed on the market if they are accompanied by a written declaration in the German language certifying that they meet the requirements of: of this Regulation and of Regulation (EC) No 1935/2004. The first sentence shall not apply to the placing on the market in the retail trade and to food items of cellular glass film which are apparently intended to be used for the production, treatment, placing on the market or the consumption of foodstuffs. (2) Food supplies from ceramics which have not yet come into contact with food shall be subject to the provisions of the first sentence of paragraph 1a. The declaration must be issued by the manufacturer or, if the manufacturer is not established in the European Union, the importer established in the European Union, and must include the following additional information:
1.
the name and address of the manufacturer and, where the manufacturer is not established in the European Union, the importer,
2.
Identity of the ceramic food requirement,
3.
Date of preparation of the declaration.
In addition, the manufacturer or importer shall, for the purpose of monitoring, provide evidence on whether the subject-matter of the food product complies with the quantitative limits laid down in Annex 6 (2). Such evidence shall contain at least the results of the analyses carried out, the test conditions and the name and address of the laboratory which carried out the analysis. (2a) The provisions referred to in Article 1 (2), in conjunction with paragraph 3 of Materials and articles referred to in Regulation (EC) No 1895/2005 which contain BADGE or its derivatives may only be placed on the market in commercial terms if they are accompanied by a written declaration in German, in which: Certifying that it meets the requirements of Regulation (EC) No 1895/2005 and Regulation (EC) No 1895/2005 (EC) No 1935/2004. The first sentence shall not apply to the placing on the market in the retail trade. (3) The goods listed in Appendix 9 may not be made commercially available to consumers unless the particulars listed in column 3 are given in column 4. , the information referred to in Article 15 (1) (a) and (b) of Regulation (EC) No 1935/2004 shall be clearly visible, easily legible, easily legible and in German. Section 10a Marking of footwear products

(1) School products referred to in Annex 11 (1) must be manufactured by the manufacturer or his authorised representative established in the European Union or, if neither the manufacturer nor his authorized representative in the European Union has an establishment, of shall be accompanied by the particulars referred to in paragraph 2, first sentence, in conjunction with paragraph 3, to the person who places the products on the market for the first time in the European Union before being placed on the market. The particulars referred to in the first sentence shall be affixed to at least one footwear product of each pair, legible, preserved and clearly visible. Those who make school products on a commercial basis must ensure that the levy is affixed in accordance with the second sentence. The information may be supplemented by written information. (2) School products shall be accompanied by pictograms or written particulars indicating their components and the indication of the materials used for this purpose and determined in accordance with paragraph 3. the conditions laid down in Annex 11 (2) and (3). This shall not apply to:
1.
used shoes,
2.
security footwear falling within the scope of the Regulation on the placing on the market of personal protective equipment,
3.
Toy shoes.
The provisions of the Chemicals Prohibition Regulation shall remain unaffected. (3) The marking referred to in paragraph 2 shall indicate the material which shall be at least 80 per cent in each case.
1.
the surface area of the upper material,
2.
the area of lining and insole and
3.
the volume of the outsole
. If no material is at least 80 per cent, information on the two materials with the largest proportions of the shoe component must be provided. The materials of the upper material are determined independently of accessories or reinforcing parts, such as ankle protectors, border frames, decorations, buckles, brackets, eyelets or similar devices. Section 11 Investigation procedure

The tests referred to in Annex 10 shall be carried out in accordance with the methods of investigation listed in that Annex. Unofficial table of contents

Section 11a Special provisions for imports

(1) Article 18 (1) of the food imports Regulation shall apply mutas to the importation of supplies of supplies, subject to the condition that the place of importation shall be replaced by
1.
the prohibition of the first sentence of Article 5 (1) of the Food and Feed Code and the prohibition of Section 30 (1) of the Food and Feed Code; and
2.
the prohibition laid down in Article 14 (2) (a) of Regulation (EC) No 178/2002 prohibiting the prohibition of Article 30 (2) of the Food and Feed Code
(2) Shipments of food items referred to in Article 1 in conjunction with Article 2 (a) of Commission Regulation (EU) No 284/2011 of 22 March 2011 with special conditions and detailed procedures for the import of Polyamide and melamine plastic kitchens, the origin or origin of which is the People's Republic of China or the Hong Kong Special Administrative Region, China (OJ C 327, 18.4.2004, p. 25), only one of the designated specific sites of the first introduction within the meaning of Article 5 of Regulation (EU) No 284/2011 may be introduced from third countries. The Federal Office of Consumer Protection and Food Safety makes the list of designated specific places of the first introduction within the meaning of Article 5 of Regulation (EU) No 284/2011 in the Federal Gazette and in the news on its website known. § 12 Crime offences and administrative offences

(1) According to § 58 (1) (18), (4) to (6) of the Food and Feed Code, it is punished who intentionally or negligently uses goods subject to § 7 requirements. (2) According to § 58 (1) (18) (4) to (6) of the Food and Feed Code (2) Animal feed code shall be punished, who intentionally or negligently
1.
the use of the substances referred to in Annex 1 shall be used in the manufacture or treatment of the materials referred to in Appendix 1,
2.
Contrary to § 4 (1) sentence 1 or subsection 1a, sentence 1, in the production of food supplies from cell glass film
a)
substances other than those listed in Appendix 2; or
b)
substances listed in Appendix 2, failing to comply with the restrictions on use referred to therein
used
3.
uses a substance, contrary to Article 4 (2) sentence 1, or
4.
shall apply the procedures referred to in paragraph 5 in connection with the production of the supplies referred to in Appendix 4.
(2a) In accordance with Article 58 (3) (2), (4) to (6) of the Food and Feed Code, it shall be punished who:
1.
Commission Regulation (EC) No 1895/2005 of 18 November 2005 on the restriction of the use of certain epoxy derivatives in materials and articles intended to come into contact with foodstuffs (OJ L 327, 22.12.2005, p. OJ L 302, 19.11.2005, p. 28), by deliberately or negligently
a)
contrary to Article 3, in the manufacture of the materials or articles referred to therein BFDGE, or
b)
contrary to Article 4, in the manufacture of the materials or articles referred to therein, or
2.
Commission Regulation (EC) No 450/2009 of 29 May 2009 on active and intelligent materials and articles intended to come into contact with foodstuffs (OJ L 393, 30.4.2009, p. 3), by using, intentionally or negligently, Article 5 (1), in conjunction with paragraph 2 (c) (i) or (ii), one of the substances referred to therein.
(3) In accordance with Article 59 (1) (21) (a) of the Food and Feed Code, it shall be punished who, contrary to § 6, sentence 1, places consumer goods on the market if they are referred to there by the substances referred to in the first sentence or by the maximum residue limits. (3a) In accordance with Section 59 (3) (1) of the Food and Feed Code, it shall be punished who, in accordance with Article 4 (e) in conjunction with Article 10 (1) of Regulation (EC) No 450/2009, shall be punished by the penalties provided for in Article 4 (3) of Regulation (EC) No (4) Any person referred to in paragraph 3 or 3 of this Article shall be negligent. In accordance with § 60 (1) of the Food and Feed Code, illegal. (5) is in breach of order within the meaning of Section 60 (2) (26) (a) of the Food and Feed Code, who intentionally or negligently counteracts § 9 placing goods on the market which are not or not provided with warnings in the prescribed manner. (6) Contrary to the law of the meaning of § 60 (2) (26) (a) of the Food and Feed Code, who intentionally or negligently
1.
in accordance with the first sentence of Article 10 (1a), including in conjunction with paragraph 2, or the first sentence of paragraph 2a, placing a food item on the market in a commercial manner,
2.
(dropped)
3.
Contrary to § 10, second sentence, sentence 3 and 4, not proof, not correct or not completely,
4.
, contrary to Article 10 (3), an item of goods,
5.
Contrary to § 10, paragraph 4, an indication is not provided in German or
6.
Contrary to § 10a (1) sentence 1 or 2, a school certificate does not provide the required information or, contrary to § 10a (1) sentence 3, does not ensure the affixing of the mandatory marking.
(7) Administrative offences within the meaning of Article 60 (4) (2) (a) of the Food and Feed Code shall be those who intentionally or negligently
1.
against Regulation (EC) No 1935/2004 of the European Parliament and of the Council of 27 June 2004 October 2004 on materials and articles intended to come into contact with food and repealing Directives 80 /590/EEC and 89 /109/EEC (OJ L 103, 25.4.1979, p. OJ L 338, 13.11.2004, p.4), by:
a)
contrary to Article 15 (1) in conjunction with paragraph 3, materials or objects shall not be marked in the correct, non-exhaustiable manner, not in the prescribed manner or in a timely manner,
b)
does not have a system or procedure in accordance with the first sentence of Article 17 (2), or
c)
in the case of an entrepreer contrary to the second sentence of Article 17 (2), do not provide an indication, not correct, complete or not in good time.
2.
against Commission Regulation (EC) No 2023/2006 of 22 December 2006 on good manufacturing practice for materials and articles intended to come into contact with foodstuffs (OJ L 327, 30.12.2006, p. 75), as amended by Regulation (EC) No 282/2008 (OJ No L 384, 29.12.2006, p. 9) has been amended, by:
a)
contrary to Article 4 (b), in conjunction with Annex A, it does not ensure that the manufacturing processes for the materials and articles referred to in Article 1 are in accordance with the detailed rules for the good manufacturing practice,
b)
, contrary to Article 7 (1) or (2), a document referred to in that paragraph does not lead, not properly or incompletely,
c)

Section 16 Transitional provisions

(1) Food requirements which comply with the provisions of this Regulation in the version valid up to 10 April 2003 and which were first placed on the market before 11 April 2003 may continue until stocks have been dismantled. the traffic is brought. However, to the extent that, in the production of food supplies, the substances with the PM/REF numbers 13510, 13720, 14650, 14950, 15310, 15700, 16240, 16570, 16600, 16630, 16690, 18640, 22420, 22570, 25210, 25240, 25270, 25840, 36840, 39120, 40320, 40580, 45650, 68860, 71670 or 87040, and these substances comply with the provisions of this Regulation in the version up to 10 April 2003, these materials may still be manufactured until 29 February 2004; and , and after that date has been put on the market until stocks have been dismantled (2) Items according to Appendix 1 (7), column 2, manufactured by 9 January 2004 in accordance with the provisions of this Regulation until 9 January 2004, or to the scope of the food and consumer goods law until that date. and which do not comply with the requirements of Section 3 in connection with Appendix 1, point 7, may be placed on the market until 29 February 2004. By way of derogation from the first sentence, textile products manufactured from recovered fibres may be manufactured or brought into the scope of the Food and Consumer Products Act until 1 January 2005, provided that the products referred to in Appendix 1 (7) Column 3, azo dyes which originate from the recovered dyed fibres, release the amines indicated therein in quantities of less than 70 milligrams in one kilogram. (3) Plastic food items which are the subject of the the provisions of this Regulation shall be in accordance with the version in force until 20 July 2005, and which have been manufactured or imported until the end of 28 February 2006, may continue to be placed on the market even after that date until the stocks have been dismantled. (4) Food supplies made of a glass sheet which The provisions of this Regulation, which are in force until 20 July 2005, and which have been manufactured or imported until 28 January 2006, may continue to be placed on the market, even after that date, until the stocks have been dismantled (5) Plastic food articles, in the manufacture of which the Substance Azodicarbonamide (PM/REF-No. 36640) and which have been in contact with foodstuffs by 1 August 2005 may also be placed on the market after 1 August 2005 if the date of bottling is indicated on them. By way of derogation from the first sentence, the date of 1 December 2005 shall apply to closures which are used for carbonated drinks filled in bottles of glass bottles. The day of bottling in accordance with the first sentence may be replaced by another indication, provided that it enables the identification of the day of bottling. The person responsible for placing the goods on the market shall, on request, inform the competent authorities of the date of bottling. (6) Food requirements made of ceramics which comply with the provisions of this Regulation in the period up to 9 June 2006 (7) (8) (8) (7) (8) The following shall be taken into account: PVC sealing material, which

epoxidized soybean oil (PM/REF-No. 88640) and is used for the sealing of glass vessels with infant formulae, follow-on formulae, cereal-based foods or other co-foods which have been bottled before 7 December 2006; and
2.
complies with the requirements laid down in Annex 3, Section 2, Part A, in the version valid until 6 December 2006,
may continue to be placed on the market as far as the date of bottling is appropriate on the subject of the food demand. The bottling date may be replaced by another claim by the user of the food item, provided that it enables the identification of the filling date. At the request of the competent authority, the user of the food item shall be notified of the bottling date. (9) Plastic food items which are subject to the provisions of this Regulation in the up to 13 May 2008 , may be manufactured or imported until 30 April 2009 and be placed on the market after that date. By way of derogation from the first sentence, the following plastic food requirements may be manufactured or imported until 30 June 2008 and shall be placed on the market after that date:
1.
Caps containing a seal and which do not comply with this Regulation in the version up to 13 May 2008 with regard to the restrictions and specifications for PM/Ref No 36640; and
2.
Food items containing phthalates and corresponding to the restrictions and specifications for PM/Ref numbers 74560, 74640, 74880, 75100 and 75105 of this Regulation in the version up to 13 May 2008.
(10) The goods referred to in Annex 4 (1) (b), manufactured or imported before 8 July 2008, which comply with the legislation in force until that date, may still be placed on the market until 1 April 2009. (11) Items according to Annex 7 (2), which do not bear the warning notice referred to therein, may be placed on the market until 31 August 2009. (12) Food requirements made of plastic and food items in the The meaning of Section 2 (2) (c) with regard to the coating to be applied, which shall: Subject to paragraph 13, the provisions of this Regulation, as amended by 28 September 2009, may still be manufactured or imported until 6 March 2010 and be placed on the market after that date. By way of derogation from the first sentence, Article 4 (3) shall apply from 1 January 2010 for the manufacture or import of the food items referred to therein; food items which meet the requirements of Article 4 (3b) shall apply: may also be placed on the market after the date mentioned there. (13) Paragraph 12, first sentence, shall not apply if, in the manufacture of the said food products, the substance is 2,4,4 '-trichloro-2'-hydroxydiphenyl ether (PM/REF-No). 93930). Food items according to the first sentence may be placed on the market until 1 November 2011. (14) Plastic bottles intended for infants and the provisions of this Regulation in the up to 11 February 2011 shall be manufactured and put into circulation until 28 February 2011 and be placed on the market until 31 May 2011.
