§ 1 Granting of an allowance with limited service capability

Federal officials and judges of the federal government, who are limited in service (limited serviceable persons), do not receive one in addition to the salaries in accordance with Section 72a (1) of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz). surcharge for rest. § 2 Height of the surcharge

(1) The supplement shall be composed of a basic amount and an increase in amount. The basic amount is EUR 150; it is reduced by EUR 15 each for each percentage point, in order to exceed the 80 per cent of service. The increase amount is 10 percent of the difference between
1.
the salaries which correspond to the degree of service; and
2.
the salaries of the limited service person in full-time employment.
If the limited-service person receives remuneration in accordance with Section 72a (1), second sentence, of the Bundesbesoldungsgesetz (Bundesbesoldungsgesetz), these deductions replace the remuneration in accordance with sentence 3 (1). (2) If the working time is beyond the limited service capacity, it is due to a Parttime employment is reduced, the supplement is reduced according to the ratio between
1.
the reduced working time due to the limited service capacity, and
2.
working time, both on the basis of the limited service capacity and on the basis of part-time work.
(3) The remuneration referred to in paragraph 1 shall be as follows:
1.
the basic salary,
2.
Office and job allowances,
3.
Transfer and compensatory allowances,
4.
the family surcharge,
5.
Grants and benefits for professors at universities.

§ 3 Exclusion of surcharge

The contract shall not be awarded in addition to
1.
a surcharge in accordance with Section 6 (3) or (4) of the Federal Law on Pay, or
2.
A supplement to the Retirement Partial-Time Award Regulation.

§ 4 Entry into force, external force

This Regulation shall enter into force with effect from 1 January 2010. At the same time, the Limited Serviceability Award Ordinance of 25 August 2008 (BGBl. 1751), as defined by Article 15 (40) of the Law of 5 February 2009 (BGBl I). I p. 160), except for the force.
