§ 1 Name, legal form and seat of the Foundation

Under the name "Bundesstiftung Baukultur" (Federal Foundation for Building Culture), a legal foundation under public law, based in Potsdam, is being established. Non-official table of contents

§ 2 Foundation Purpose

The purpose of the foundation is to ensure the quality, sustainability and performance of the planning and Building construction in Germany both nationally and internationally, and raising awareness of good planning, building and building culture as well as the value of the built environment in construction workers and in the population. To this end, the foundation is to serve as a communication platform for the nationwide discussion of urban planning, planning, construction and housing quality standards. § 3 Convent of the building culture

(1) The Foundation regularly holds a public convention of building culture.(2) As members of the Convention, it is the institution and sponsor of nationwide significant prizes in the field of building culture, independent persons with professional authority, the experience of the essential areas of private and public planning and Building in Germany as well as other people with an idealistic or financial commitment in the field of building culture.(3) The task of the Convention is to carry out a public identification of the location of the building culture in Germany and to develop it continuously, to pay tribute to special achievements in the field of building culture, and to demonstrate the need for action in this area.(4) The members of the Convention shall propose from their ranks the persons who participate in the institutions of the Foundation in accordance with the provisions of Section 7 (1) and Section 8 (1).(5) The provisions of the Statute shall be laid down in detail. § 4 Foundation assets

(1) The federal government provides the foundation with an endowment capital of 250,000 euros.(2) The Foundation shall also be required to raise the capital required for the performance of its duties, including by means of the acquisition of grants and donations of third parties. It can serve the support of private funding associations or similar associations.(3) To the extent necessary, the Foundation shall also receive a federal grant in accordance with the federal budget for the performance of its tasks.(4) The Foundation shall be entitled to provide services to third parties within the scope of the Foundation's purpose and with the approval of the Board of Trustees.(5) Income of the Foundation's assets and other income shall be used only for the purpose of the Foundation's purpose. § 5 Institutions of the Foundation

§ 6 Board of Directors

(1) The Executive Board shall consist of the Chairperson or the Chairman and a Deputy or Deputy.(2) The members of the Executive Board shall be appointed by the Board of Trustees by a majority of its members for up to five years. § 7 Board of Trustees

(1) The Board of Trustees is made up of 13 members:

five members will send the German Bundestag from its center,

each one member will send the Federal Ministry of Transport, Building and Urban Development, the Federal Ministry of Finance, as well as the Ministry of Culture and the Media responsible top federal authority,
3.
five members shall send the Convention of Building Culture.
(2) The posting of the members of the Board of Trustees shall be made for four Years. The repeated posting is allowed. If a member fails early, a successor may be appointed for the remainder of his term of office.(3) The Chairman of the Board of Trustees is the representative of the Federal Ministry of Transport, Building and Urban Development.(4) The Board of Trustees shall be responsible for all matters of fundamental importance to the Foundation, in particular the organisation, the medium-term financial programming, the economic plan and the work programme and its implementation.(5) In budgetary and personnel matters, the decisions of the Board of Trustees require the approval of the representatives of the Federal Ministry of Transport, Building and Urban Development and the Federal Ministry of Finance.(6) The Board of Trustees shall have a quorum if more than half of the members of the Board of Trustees are present. It shall take its decisions by a simple majority. In the event of a tie, the vote shall be taken by the Chairperson or the Chairman.(7) The members of the Board of Trustees act on a voluntary basis and are entitled to a travel expenses compensation in accordance with the Federal Travel Cost Act.(8) The provisions of the Statute shall be laid down in detail. § 8 Advisory Board

(1) The Advisory Board consists of 20 members of different disciplines, who are members of the Advisory Board. Building culture. They are appointed by the Board of Trustees after the foundation has carried out for the first time a convention of the building culture according to § 3. Three quarters of the members are appointed by the Board of Trustees on the basis of a proposal from the Convention on Building Culture.(2) The members of the Advisory Board shall be appointed for a period of four years. The re-appointment of Members shall be admissible once. If a member fails early, the Board of Trustees may appoint a successor for the remainder of the term of office.(3) With the majority of its members, the Advisory Council shall elect a Chairperson or a Chairman from among its members. The chairman or the chairman may be voted down by the same majority of votes.(4) The Advisory Board shall advise the Board of Trustees in the planning and implementation of its tasks.5. The Advisory Council shall be validly validly present when more than half of its members are present. It shall take its decisions by a simple majority. § 9 Statutes

The foundation is set up by the Board of Trustees, which is approved by the majority of its members. Amendments shall also be subject to the majority of the members of the Board of Trustees. Non-official table of contents

§ 10 Supervision, Budget, Auditing

(1) The Foundation is subject to the legal supervision of the Federal Ministry for Transport, construction and urban development.(2) The provisions applicable to the Federal Administration shall apply to the budget, treasury and accounting system as well as to the accounts of the Foundation. The Foundation shall set up an economic plan in good time before the beginning of each financial year, which shall require the approval of the Board of Trustees.(3) The budget and economic management of the Foundation shall be subject to the examination by the Federal Court of Auditors. § 11 Employees

(1) The Foundation's operations are carried out by employees perceived.(2) The employment relationships of the employees of the Foundation shall be subject to the collective agreements and other provisions applicable to the employees of the Federal Government. Non-official table of contents

§ 12 Transitional regulation

To enable the foundation to prepare the first convention of the building culture in accordance with § 3 and to implement it, the Board of Trustees shall first be constituted without the members to be appointed by the Convention of Building Culture. This Board of Trustees is entitled and obliged to take all decisions necessary in connection with the preparation and implementation of the Convention as well as inundifiable decisions. § 13 Entry into force

This law enters into force on the day after the announcement.
