§ 2 Definitions

§ 3 General principles and conditions for recognition

§ 4 General obligations and rights of the recognized PÜZ-Body

§ 5 Special requirements for recognition as a test centre

(1) The test body must have a sufficient number of employees with the training and professional experience required for the examinations. It must be up to a head of the head office who is responsible for the supervision of all the staff of the inspection body. The head or his/her deputy must have a technical-scientific type of training in the field of activity of the examination centre, completed at a university of applied sciences or university, and have a three-year practical training programme. (3) The Examination Office must also have the following information:
1.
written instructions for the use and maintenance of the test equipment, the handling and preparation of test objects, and the carrying out of the tests in accordance with the relevant test standards or test requirements (standard operating instructions) and
2.
a system for recording and documenting the tests.

§ 6 Special obligations of the recognised testing body

(1) The test equipment must be calibrated in accordance with the generally accepted rules of technology. (2) The test centre must participate in ring trials and comparative tests determined by the recognition authority. (3) The test centre has reports on to produce and document the results of the tests and the results of the tests. These must include information on the subject matter of the test, on the test date, on the test personnel involved, on the test methods used in accordance with the technical requirements of § 4 (4), on the test results and on the manufacturing plant. Section 7 Special requirements for recognition as a monitoring centre

(1) The monitoring body must have a sufficient number of employees with the training and professional experience required for the monitoring tasks. It must be headed by a manager responsible for supervision of all employees of the monitoring body. The head or his deputy must have a technical-scientific type of training in the field of activity of the monitoring body, with a university or university degree, and a three-year practical training programme. Proof of professional experience in the field of supervision of construction products. The number and qualifications of the other employees depend on the type and scope of the activities requested and on the technical requirements to be met. (2) The monitoring body must also have the following information:
1.
written instructions on the nature and scope of the monitoring; and
2.
a system for recording and documenting the monitoring.

Section 8 Special obligations of the recognised monitoring body

The monitoring body shall have reports on the implementation of the monitoring. These must include information on the subject of the surveillance, the monitoring period, the monitoring personnel involved, the monitoring procedures used, the monitoring results and the manufacturing plant. The monitoring report shall be signed by the head of the supervisory authority or his deputy. The reports and the accompanying records shall be kept for a period of five years and shall be submitted to the recognised authority or to the body designated by it at the request of the latter. § 9 Special requirements for recognition as a certification body

(1) The certification body must have a sufficient number of employees with the necessary training and professional experience for the certifications. You must have a manager who is responsible for the supervision of all the employees of the certification body. The head or his/her deputy must have a technical/scientific training course with a degree from a university of applied sciences or university, and a five-year practical professional experience in the field of examination, Demonstrate monitoring or certification of construction products. § 10 Special obligations of the recognised certification body

The certification body shall have records and reports of its certifications. The reports must include information on the subject-matter of the certification, the certification date, the certification staff involved, the certification procedures used, the certification result and the manufacturing plant. The report shall be signed by the head of the certification body or his deputy. The report shall be drawn up regardless of the need for a certificate of conformity.

Section 11 Application and application documents

(1) The recognition must be submitted in writing to the recognition authority. (2) The following documents must be submitted with the application form:
1.
Information on the product, product range or range of requirements for which recognition is requested, in accordance with the provisions of Article 3 (3) of the Treaty on the basis of standards, approval guidelines or decisions of the Commission of the European Communities 2 and a spatial limitation of the area of activity is requested;
2.
indication of which function within the meaning of the first sentence of paragraph 1 is to be accepted;
3.
information on the person and qualifications of the head and his deputy, on the staff and on his professional experience, and on the share of the work carried out for the PÜZ body;
4.
information on the economic or legal links of the PÜZ body, its director and its employees to individual manufacturers,
5.
Information on the premises and the technical equipment of the PÜZ site,
6.
in the case of natural persons, the indication of age, of legal persons, of the body or of the surveillance community, of the age of the director and of his/her deputy,
7.
Information on subcontractors.
(3) The recognition authority may obtain expert opinions on the fulfilment of individual recognition requirements. Unofficial table of contents

§ 12 Revocation and Ererase

(1) The recognition shall be revoked if the recognised PÜZ body has repeatedly or grossly failed to fulfil the obligations of the notified body. It shall also be revoked if there are any subsequent reasons or reasons which would have justified the approval of the authorisation. The recognition may be revoked if the recognised PÜZ body did not exercise its activity for two years. (2) The recognition shall be cancelled by written renunciation of the recognition authority or by the expiry of the time limit. In the case of natural persons, recognition shall also be granted
1.
with the completion of the 68. Life Year,
2.
with the loss of the ability to hold public offices,
3.
in the case of a conviction for a crime or an intentional offence in connection with the recognised activity, or
4.
by court order of the restriction at the disposal of the assets.
If, in the case of a legal person, body or surveillance community, the grounds for the erasure of the head or of his deputy are deleted, the recognition shall be extinguished if the recognition authority does not within six months a change of the conductor or of his/her deputy according to § 4 (10) is indicated. Section 13 Entry into force
