On the basis of Section 76 (2) of the Employment Promotion Act of 25 June 1969 (BGBl. 582), as defined by Article 1 (23) of the Law of 23 July 1979 (BGBl). 1189), after consultation of the Federal Labour Office pursuant to Section 234 (2) of the Employment Promotion Act and the Contracting Parties to the Construction Industry Act, according to Article 76 (2) sentence 4 of the Employment Promotion Act (Arbeitsförderungsgesetz), the Federal Employment Promotion Act (Arbeitsförderungsgesetz) is hereby ordered: Unofficial table of contents

§ 1 Establishments Admitted

(1) All-year employment in the construction sector is to be promoted through the season-short-time allowance in enterprises and operating departments which are predominantly in construction services (Section 101 (2) of the Third Book of the Social Code). (2) Holders and operating departments within the meaning of paragraph 1 are those in which, in particular, the following work is carried out (main building):
1.
Sealing work against moisture;
2.
Processing and drainage work, such as the dewatering of land and urinable land, including the excavation work, the laying of drainage pipes, and the laying down of drainage pipes, and the production of Pre-flood and lock-in facilities;
2a.
Asbestos remediation work on buildings and construction works;
3.
Construction drying works, which are works which act under the influence of the structure of the masonry of dehumidification, also using plastics or chemical agents as well as by the installation of capacitors;
4.
Concrete and reinforced concrete work, including concrete protection and concrete renovation work as well as reinforcement work;
5.
drilling;
6.
Well-built works;
7.
chemical soil solidification;
8.
Insulation (insulating) works (for example, heat, cold, sound-protection, sound-absorbing, sound-improvement, sound finishing), including the installation of substructures and technical insulation (insulating) works, in particular on technical installations and on land, air and water vehicles;
9.
Earthmoving works, such as for example weaving, melioration, land extraction, dyke construction, wild bach and avalanche construction, sports equipment construction as well as erection of soundproofing rollers and side mountings on traffic routes;
10.
Estrichwork, for example, works using cement, asphalt, anhydrite, magnesite, gypsum, plastics or similar materials;
11.
Facade construction works;
12.
Construction works: installation or assembly of prefabricated parts for the production, repair, maintenance or alteration of structures; and manufacture of prefabricated components, if the majority of these components are operated by the holding, another the operation of the same undertaking or within concentrations of undertakings, without prejudice to the legal form, by the establishment or installation of at least one of the partners concerned; the manufacture of such undertakings shall not be covered by: Prefabricated concrete parts, prefabricated timber parts for the purpose of the erection of prefabricated timber structures and insulating elements in solid, fixed and permanently established workplaces in the manner of stationary plants; § 2 No. 12 shall remain unaffected;

Fire and kiln construction work;
14.
Tile, plate and mosaic coating and laying work;
14a.
Joint work on structures, in particular the installation of laying brickwork and of connections between installation parts and masonry, as well as permanent elastic and permanent plastic joints of all kinds;
15.
Glass reinforced concrete work as well as lining and laying of glass building blocks;
16.
track construction;
17.
Manufacture of non-storable building materials, such as concrete and mortar mixtures (ready-mix concrete and ready-made mortar), where the majority of the building materials produced are the construction sites of the manufacturing plant, of another holding without prejudice to the legal form of the operation of the same undertaking or within undertakings, the construction sites of at least one of the members of the undertaking concerned shall be provided;

High-construction work;
19.
Wood protection works on components;
20.
Sewer-(Sielbau-) Arbeiten;
21.
Masonry work;
22.
Ramming work;
23.
Pipeline construction, pipeline construction, cabling construction work and floor-to-earth extrusion;
24.
Shaft construction and tunnel construction;
25.
formwork;
26.
Chimney construction;
27.
Demolition, demolition and demolition work, not covered by demolition and scrapping operations, the predominant activity of which is the extraction of raw materials or the reprocessing of demolition materials;
28.
steel bending and braided work, insofar as they are carried out for the purpose of providing other construction services of the company or on construction sites;
29.
Tactics;
30.
Stoneming;
31.
Road construction works, such as stone, asphalt, concrete, black road construction work, paving work of all kinds, road marking work; furthermore, production and preparation of the mixed material, if with the predominant part of the mixed material of the operation, other operation of the same undertaking or within concentrations of undertakings, without prejudice to the legal form of the operation of at least one of the members of the undertaking concerned;

Road rolling;
33.
stucco, plaster, plaster and rebated work, including the installation of substructures and plaster beams;
34.
Terrazzowork;
35.
Civil engineering works;
36.
Dry and assembly works (for example, wall and ceiling installation and linings), assembly of building parts, including the mounting of substructures and plaster beams;
37.
Laying of floor coverings in combination with other structural services;
38.
Renting of construction machinery with operating personnel when the construction machinery is used with operators to provide structural services;
38a.
Thermal insulation composite systems;
39.
Hydraulic engineering works, water conservation work, water engineering works (for example, waterway construction, water basin construction, lock plant construction);
40.
Carpentry and timber construction work carried out within the framework of the carpentry;
41.
Installation of building elevators.
(3) holdings and operating departments within the meaning of paragraph 1 shall also be
1.
Farms that set up scaffolders (scaffolders),
2.
Holdings of the roofing craft.
(4) The holdings and operating departments referred to in paragraph 1 shall also be those of gardening and landscaping in which the following works shall be carried out:
1.
Creation of garden, park and green spaces, sports and playgrounds as well as cemetery facilities;
2.
Creation of total external facilities in housing construction, public works projects, in particular schools, hospitals, swimming pools, road, motorway, railway, airfields, barracks;
3.
Dike, slope, semi-and embankment construction, including the construction of the fascists;
4.
engineering works of all kinds;
5.
Protective plantations of all kinds;
6.
Drainage work;
7.
Melioration work;
8.
Land thread and recultivation works.
(5) holdings and operating departments within the meaning of paragraph 1 are excluded from the promotion of year-round employment by the seasonal short-time allowance, if they belong to a group which is limited and noteworthy, in which a group of undertakings, Inclusion in accordance with paragraphs 2 to 4 in the period of bad weather does not lead to a recovery of economic activity or to a stabilisation of the employment situation of workers affected by seasonal work. § 2 excluded holdings

Establishments which cannot be regarded as eligible establishments within the meaning of Article 1 (1)
1.
the construction and protection of the iron and steel industry;
2.
the concrete goods and the terrazowar manufacturing industries, unless, according to their intended purpose, construction services within the meaning of Section 1 (1) and (2) are mainly carried out in operating departments.
3.
the cleaning of the facade;
4.
the floor and parquet floor;
5.
the glass-craft;
6.
the installation industry, in particular plumbing, air-conditioning plant construction, gas, water, heating, ventilation and electrical installation, as well as lightning protection and grounding equipment;
7.
the painting and varnishing craft, in so far as construction services are not predominantly carried out within the meaning of Article 1 (1) and (2);
8.
the natural stone and natural stone industry and the stonemasonry trade;
9.
wet dredging;
10.
the tiled stove and air heating system;
11.
the acid-building industry;
12.
the carpentry and woodworking and processing industries, including the woodworking industry, in so far as they do not predominantly carry out prefabricated construction, insulation (insulating), dry-building and assembly works or room-work operations;
13.
the pure steel, iron, metal and light-metal construction as well as the guidance, free-line, local and cable construction;
14.
and businesses that make concrete unloading equipment commercially available.
