§ 1 Scope
The Federal Institute for Materials Testing (Bundesanstalt für Materialprüfung) charges fees and expenses according to this cost regulation for its benefits.

§ 1a Fee in special cases
Fees shall also be charged for benefits which have been started but not brought to an end if the reasons are to be represented by the person who has led the benefit.

§ 2 Calculation of fees
(1) The fee shall be calculated on the basis of the hourly rates set out in the Appendix to this Costing Regulation for each organisational unit. The hourly rates include all costs incurred in the respective organizational unit. (2) If the average costs (lump sums) are calculated for individual benefits, only those costs are calculated. (3) The fee can be increased in individual cases (§ 6) or discounted (§ 7).

§ 3 Fee after time, travel and waiting times
(1) The time taken to cover the following activities shall be as follows:

preparatory activities (e.g. B. correspondence, meetings, literature studies, file inspection, examination of documents, constructions, experimental preparation),
-
2.
-
Execution work (e.g. Workshop work, design of test facilities, conduct of the investigation, evaluation of the results, verification of results of third parties),
-
3.
-
post-travel activities (e.g. B. experimental follow-up, dismantling of test facilities, drafting of reports and reports, preparation of approval, preparation of documents, writing work, registry).
(2) The time spent is determined in hours. Trapped hours are recorded proportionally. (3) In the case of continuous tests in which no personnel costs are incurred, it is possible to apply machine rates for the use of the technical equipment in time. (4) In the case of continuous-time trials, the the time required in accordance with the specific test conditions. For the calculation of fees, the hourly rates for the benefits of the respective organizational unit are used. (5) The time spent by the respective application also includes the travel times, which are in the usual working time, , as well as the waiting times, provided that they have been caused by the applicant.

§ 4 Special expenses
If the net benefit requires exceptional costs for material, energy, special test facilities, measuring and auxiliary equipment or other measures or tools, or if the useful performance causes other above-average costs, to calculate these special expenses in accordance with the cost of self-cost.

§ 5 Late of equipment and equipment on time
The transfer of equipment and equipment on time shall be calculated in accordance with the cost of the self-cost.

§ 6 Accelerated benefits
If a benefit is provided on request in addition to the series of ongoing work due to special urgency, a surcharge of not more than 100 per hundred of the fee calculated in accordance with § § 3 to 5 may be levied.

§ 7 Reduction of the fee
If, on a case-by-case basis, the consideration of the economic value of the net benefit to the applicant shows that the fee calculated in accordance with § § 3 to 5 is disproportionate, it may be reduced by a reasonable amount.

§ 9 Deposits
The following are to be reimbursed:

Expenses for the transport of test equipment and test objects,

in the case of the examination of goods sent from abroad, the import duties and the charges related to them,

Expenses for deliveries and services of third parties.

§ 10 Fee debtors
(1) The payment of fees shall be subject to the obligation to:
-
1.

who requests the net benefit,
-
2.
-
who has accepted the fees by a statement issued to the Federal Institute or communicated to it,
-
3.
-
who is liable for the fee debt of another power of law.
(2) Several charge debtors shall be liable as total debtors.

Section 11 Setting of fees, due date and advance
(1) The fees shall be determined by written notice. At least, the communication must be based on:
-
1.
-
the debtor,
-
2.
-
the chargeable service,
-
3.
-
the amount of the amounts to be paid,
-
4.
-
the legal basis for the charging and calculation of the fees;

5.
-
where, when and how the fees are to be paid.
(2) The fees shall be charged with the announcement of the fixing of fees to the debtor, unless the Federal Office determines a later date. (3) The provision of a net benefit may be due to the payment of an appropriate advance payment. or from a reasonable amount of security, up to the level of the expected fees. § 12 Stundung, embezzlement and remission
The provisions of the Federal Budget Regulations shall apply accordingly to the payment of charges, the suppression and the remission of claims by the Federal Agency for the payment of fees under this cost order.

Section 15 Refunding
(1) Overpaid or unduly levied fees shall be reimbursed without delay, but charges wrongly levied shall only be provided in so far as a fixing of charges has not yet become unquestionable; after that date, charges may be unduly levied only (2) The claim for reimbursement shall expire by means of limitation if it is not asserted until the end of the third calendar year following the creation of the claim; however, the statute of limitations does not commence before the end of the period of limitation. the indisputability of the fixing of charges.

Section 17 Entry into force
This Regulation shall enter into force on the day following that of its announcement. At the same time, the Federal Institute for Materials Testing (Bundesanstalt für Materialprüfung) in Berlin has been replaced by the fees for the official material test (GaM) of 8 February 1961 (Federal Gazette No. 35 of 18 February 1961), as last amended by the Second Amendment The Federal Institute for Materials Testing (Bundesanstalt für Materialprüfung) on the fees for official material testing (GaM) of 1 June 1968, approved on 19 July 1968 (Federal Gazette No. 140 of 31 July 1968), repeals the force.
