§ 1 Content of the data sets

The data which may be stored in the Register of Foreigners Registers shall be obtained from column A of sections I and II of the Annex to this Regulation. Column A1 of section I of the annex to this Regulation provides for information on non-EU nationals who are not citizens of the Union or citizens of the Union where a determination of the non-existence or the loss of the right of free movement of persons is or for Union citizens who do not have such a determination. § 2 AZR-Number

§ 4 General Regulations

(1) The public authorities which are obliged or entitled under the AZR Act to transmit to the register authority data which are to be stored in the register shall be obtained from column C of sections I and II of the annex to this Regulation. (2) The date in which one of the events is in accordance with § 2 or § 28 of the AZR Act or a decision on one of the occasions pursuant to § 3 sentence 1 (7) or sentence 2 (7) or § 29 (1) no. 6 of the AZR-Act) is decisive for the data transfer. § 5 Procedure of data transfer

§ 6 Founder texts

§ 7 Transmission Locks

(1) Any foreigner whose data are stored in the general data base of the register may apply for a transfer lock in accordance with § 4 of the AZR Act. Data transmission by the register authority

§ 8 Request for transmission

(1) Any public body requesting the transmission of data from the register shall, prior to the request for transmission, verify whether the knowledge of the data stored in the register is necessary for the performance of its tasks. (2) Requests for delivery can be made on machine-usable data carriers, in the context of the call in the automated procedure, on pre-forms provided for this purpose, in some other way in writing or by telephone. The requesting body shall only use machine-usable data carriers for the request for transmission if they are registered with the register authority. A telemelic transfer request shall be admissible only for public sector bodies and only if the time delay associated with a written request for transmission is not to be represented for urgent service reasons. (4) In the case of data retrieval in the automated procedure, only the following designations shall be used for the data referred to in § 22 (1) (9) (a) and (b) of the AZR Act:

§ 9 General rules of data transfer by the register authority

(1) The extent of the data which the register authority may transmit and pass on to the body in question pursuant to the AZR Act shall be obtained from columns A and D of sections I and II of the annex to this Regulation. § 10 Approval for retrieval in automated procedures

(1) The admission to the retrieval of data in the automated procedure pursuant to § 22 (1) of the AZR Act shall be applied for in writing to the Register Authority. In the case of § 22 (1) no. 9 of the AZR-Laws, the approval of the highest federal or state authority responsible for the applicant must be obtained. Section 11 Group information on public sector bodies

(1) The request for group information shall indicate the characteristics according to which the group information is to be made. Group properties can be

the data referred to in column A of section I of the annex to this Regulation;
2.
spatial maps (federal, state, local) and
3.
certain periods.
The selection of properties and the scope of information for a group meeting are limited to the data that may be transmitted to the requesting body in the case of individual requests for transmission. § 12 Data transfer to non-public bodies performing humanitarian or social tasks

(1) Non-public bodies requesting data transmission in accordance with Article 25 of the AZR Act shall demonstrate to the Registry that they are responsible for the performance of their humanitarian or social tasks in the event of a disappearing Seek family reunification or provide support in guardianship and maintenance matters. § 13 Data transfer to authorities of other States and to intergovernmental bodies

(1) The authorities of other States shall, in so far as the person concerned is a member of their State, send their requests for transmission to the Register Authority through their consular post. If the person concerned is a national of a third State, the diplomatic mission shall direct the request for transmission via the Federal Foreign Office to the register authority. Intergovernmental bodies shall forward their request for transmission via the Federal Foreign Office to the register authority. The Federal Ministry of the Interior, with the agreement of the Federal Foreign Office, may take different regulations. Regulations in international agreements remain unaffected. (2) The register authority shall examine whether the conditions of § 26 of the AZR Act for a data transfer to the authorities of other States or intergovernmental bodies are fulfilled. If the register authority wishes to accept the application, it shall first obtain the opinion of the Office of the Foreigners ' Office, or, in so far as the person concerned is in an asylum procedure, the opinion of the asylum procedure. § 14 Data transfer to other non-public bodies

(1) Other non-public bodies within the meaning of Section 27 of the AZR Act have to prove to the register authority that the demand for the most recently responsible reporting authority has not been successful. Proof must be provided by submitting a corresponding information to the reporting authority, which is not to be older than four weeks. (2) § 12 para. 2 shall apply accordingly.

Information to the person concerned

§ 15 Conditions and procedures for the exchange of information

(1) In accordance with § 34 of the AZR Act, the person concerned may submit a request for information at any time. The application may also be made by a legal or authorized representative. (2) The application must be submitted to the register authority in writing. It does not require any justification. Records of data transfers, blocking and deletion of data

§ 16 Records of data transfers

§ 17 blocking of data

(1) The dispute concerning the correctness of stored data in accordance with § 37 (1) of the AZR Act must be made in writing to the register authority. § 18 Deletion of data, deletion periods in general data collection

(1) In the general data base of the register, the data set of an exportor who has left the country shall be deleted no later than ten years after leaving the register. The record of a deceased expat is to be deleted no later than five years after his death. The periods begin at the end of the quarter in which the relevant event has occurred. (2) By way of derogation from the first sentence of paragraph 1, the deletion of the data set of an exportor who has left the country shall be deleted at the latest with the expiry of the Quarterly, in which he is the 90. is completed when one of the following facts is stored:

Legal status as a homeless foreigner or contingent refugee,

Recognition as an asylum seeker,

(3) The register authority shall delete the following data:
1.
after five years
a)
the rejection of the application for the determination of the status of a German or of recognition as a settler or a ethnic German resettler, or the withdrawal of that determination,
b)
a travel ban,
c)
a refusal,
2.
after ten years
a)
the issue of a passport sentence in accordance with Article 4 of the Residence Regulation, in so far as it is listed in column A of section I of the annex to this Regulation,
b)
Data in accordance with § 3, first sentence, no. 3 and 7 in conjunction with § 2 para. 2 no. 7 and 7a of the AZR Act,
c)
Data in accordance with § 3, second sentence, number 3 and 7 in conjunction with Section 2, paragraph 3, point 7 of the AZR Act.
The time-limits shall begin at the end of the quarter in which the data have been transmitted. (4) Data shall be deleted, otherwise, if the measures on which they are based are withdrawn, revoked, otherwise repealed or by the expiry of their Fixed-term or otherwise. Information already stored in the register on the status of the residence status will not be deleted by storing further information on the status of the residence status. § 19 Deletion of data, deletion periods in the visa file

In the visa file of the register, the data record of an expat is to be deleted after five years at the latest, if data are stored in accordance with § 29 (1) of the AZR Act. If additional data are stored in accordance with § 29 (2) of the AZR Act, a deletion shall take place after ten years at the latest. § 19a Effects of subsequent legal changes on the register stock

(1) Information stored until the entry into force of a change in law relating to the status of residence within the meaning of section 2 (2) (3) in conjunction with § 3 sentence 1 (6) or § 2 (3) (3) and (4) in conjunction with § 3 sentence 2 (6) of the AZR law shall remain stored even if, after the entry into force of the legal amendment, they are no longer or no longer designated under the same name, unless the amending act or the amending regulation meets a different Regulation. § 18 shall remain unaffected. § 19b Effects of a later change of the group of persons on the data set for a person

(1) Data on a citizen of the Union who have been stored prior to the acquisition of European citizenship may remain stored, provided that the data are data in accordance with § 3 sentence 2 in conjunction with § 2 paragraph 3 of the AZR Act. Data relating to a third-country national who has been stored prior to the acquisition of the nationality of the third country may remain stored, provided that it is data according to § 3 sentence 1 in conjunction with § 2 paragraph 1 or 2 of the AZR Act . § 18 shall remain unaffected. (2) Data which are still stored in accordance with paragraph 1 shall be transmitted by the register authority in accordance with the rules of its kind to comparable data.

Section 20 Transitional regulation on the occasion of the entry into force of the immigration law

(1) Information stored until 31 December 2004 concerning the status of residence within the meaning of § 2 (2) (3) in conjunction with § 3 sentence 1 (6) or second sentence 2 (6) of the AZR Act shall remain valid even after the entry into force of the immigration law is stored. New measures and decisions allowed under the Residence Act or the EU's Freedom of Movement/EU are to be stored only if they are taken on a case-by-case basis. (2) Foreigners ' authorities may provide information on the residence status under previously used identifiers, as long as and insofar as the information technology requirements for a transmission are not yet established in accordance with the law applicable from 1 January 2005. With regard to the data transfer by the register authority, the greatest possible extent of the data-without mentioning statutory purposes-is indicated, which the respective body may receive under the AZR law. Restrictions arise from the individual provisions of the AZR Act.
