§ 1 Scope

Trainers and trainers have to prove, in accordance with the Vocational Training Act, the acquisition of vocational and occupational pedagogical skills, knowledge and skills in accordance with the provisions of this Regulation for the training in recognised training occupations. This does not apply to training in the field of members of the liberal professions. Unofficial table of contents

§ 2 Professional and occupational pedagogical aptitude

Vocational and occupational pedagogical aptitude encompasses the competence to independently plan, carry out and control vocational training in the fields of activity:
1.
Study training requirements and plan training,
2.
prepare education and participate in the recruitment of apprentices,
3.
training and
4.
Complete the training.

§ 3 Areas of action

(1) The field of action in accordance with Section 2 (1) shall include the educational aptitude of vocational and occupational pedagogy, the examination of training requirements and the planning of training. The trainers and trainers are in a position to do so,
1.
the advantages and benefits of occupational training and to be able to justify them,
2.
to participate in the planning and decision-making with regard to company training needs on the basis of the legal, collective bargaining and operating framework conditions,
3.
to present the structures of the vocational training system and its interfaces,
4.
To select and justify training occupations for the holding,
5.
examine the suitability of the establishment for the training in the desired training occupation and, whether and to what extent training contents are carried out by measures outside the training centre, in particular in the form of training in the network, and out-of-company training,
6.
to assess the possibilities for the use of measures preparatory to vocational training, and
7.
in operation, to coordinate the tasks of the participants in the training, taking into account their functions and qualifications.
(2) The field of action in accordance with Section 2 (2) shall include the ability to prepare vocational and occupational pedagogy to prepare the training, taking into account the organisational and legal aspects. The trainers and trainers are in a position to do so,
1.
to draw up an in-company training plan based on a training order, which is based in particular on working and business-related business processes,
2.
to take into account the possibilities of participation and participation of the operational interest groups in vocational training,
3.
to identify the need for cooperation and to coordinate with the cooperation partners, in particular the vocational school, in terms of content and organisation,
4.
to apply criteria and procedures for the selection of trainees, also taking account of their differences in their diversity,
5.
to prepare the vocational training contract and to arrange for the registration of the contract with the competent authority;
6.
to examine the possibilities of whether parts of vocational training can be carried out abroad.
(3) The field of action in accordance with Section 2 (3) comprises the ability to promote vocational and occupational pedagogical aptitude, self-employed learning in professional working and business processes, in a way that is oriented to the action of the person. The trainers and trainers are in a position to do so,
1.
to create conditions conducive to learning and a motivating learning culture, to give feedback and to receive feedback,
2.
to organize, design and evaluate the probaation period,
3.
to develop and design operational learning and work tasks from the company training plan and the working and business processes that are typical of the profession,
4.
to select training methods and media in a targeted manner and to use them in a situation-specific manner,
5.
To support apprentices in learning difficulties through individual training and learning guidance, to use support for training as needed, and to examine the possibility of extending the training period,
6.
to make additional training courses to be developed, particularly in the form of additional qualifications, and to examine the possibility of shortening the duration of the training and the possibility of early admission to the final examination,
7.
to promote the social and personal development of trainees, to identify problems and conflicts in good time and to work towards a solution,
8.
to identify and evaluate services, evaluate performance assessments of third parties and test results, conduct assessment discussions, draw conclusions for the further course of training, and
9.
to promote intercultural competences.
(4) The field of action in accordance with Section 2 (4) comprises the suitability for vocational and occupational pedagogy to lead the training to a successful conclusion and to demonstrate the prospects for his professional development to the trainee. The trainers and trainers are in a position to do so,
1.
prepare apprentices for the completion or journeyman examination, taking into account the dates of the examination, and to lead the training to a successful conclusion,
2.
to ensure that the trainees register for examinations at the competent authority and to draw attention to specific features which are relevant to the implementation of the application,
3.
Participate in the preparation of a written certificate on the basis of performance assessments, and
4.
To inform and advise apprentices about company development paths and vocational education and training opportunities.

§ 4 Proof of suitability

(1) The suitability according to § 2 shall be proven in an examination. The examination consists of a written part and a practical part. The test has been passed if each test piece has been evaluated with at least "sufficient". Within an examination procedure, an examination that has not been passed can be repeated twice. In the written part of the examination, case-related tasks from all fields of action are to be processed. The written exam is to last three hours. (3) The practical part of the examination consists of the presentation of a training situation and a technical discussion with a duration of no more than 30 minutes. For this purpose, the examination participant selects a vocational training situation. The presentation should not exceed 15 minutes. The selection and design of the training situation will be explained in the expert discussion. In place of the presentation, a training situation can also be carried out in practice. (4) In the field of agriculture and in the field of domestic economy, the practical part consists of the implementation of one of the participants in the examination the training situation to be selected with the examination board and a specialist discussion in which the selection and design of the training situation must be justified. The examination in the practical part is intended to last at most 60 minutes. (5) For the acceptance of the examination, the competent authority establishes an examination board. § 37 (2) and (3), § 39 (1) sentence 2, § § 40 to 42, 46 and 47 of the Vocational Training Act apply accordingly. § 5 Certificate

A certificate must be issued for each of the annexes 1 and 2 on the basis of the examination. Unofficial table of contents

§ 6 Other proofs

(1) Anyone who has passed the examination following an Educational Aptitude Regulation in force before the entry into force of this Regulation and which has been adopted pursuant to the Vocational Training Act shall be deemed to have been employed in the course of vocational training as referred to in this Regulation. (2) Those who have demonstrated a vocational and occupational educational aptitude by a master examination or another examination of the vocational training in accordance with the handicraft order or the Vocational Training Act shall apply to the Vocational education and training as defined in this Regulation (3) Any person who has passed any other state, state-approved or public-law audit whose content corresponds in whole or in part to the requirements referred to in § 3 may be accepted by the competent authority. In the case of a request, all or part of the examination shall be exempt from the examination in accordance with § The competent body shall issue a certificate. (4) The competent body may, upon request, exempt from the submission of proof of the acquisition of vocational and occupational pedagogical skills, knowledge and skills, if the existence of such a certificate has been received. Professional and occupational pedagogical aptitude is made credible in other ways and the proper training is ensured. The competent authority may issue conditions. Section 7 Continuing of the training activity

Anyone who served as trainers within the meaning of Section 28 (1) sentence 2 of the Vocational Training Act before 1 August 2009 shall be exempted from the proof in accordance with § § 5 and 6 of this Regulation, unless the previous training activity has to be subject to complaints with a request for rectification by the competent authority has been taken. If, after a request, the deficiencies have been remedied and hazards are not to be expected for a proper training, the competent authority may exempt from the proof in accordance with § § 5 and 6; it may issue conditions. § 8 Transitional Regulation

Initiated examination procedures can be completed by the end of the 31 July 2010 according to the previous regulations. The competent authority may, at the request of the examination participant or the examination participant, carry out the repeat examination in accordance with this Regulation; § 4 (1) sentence 5 shall not apply in this case. § 9 Entry into force, external force
