Definitions

§ 1

(1) For the purposes of this Regulation:
1.
Aujeszky's disease, if this
a)
by clinical and serological examination (antibody detection),
b)
through virological examination (virus or antigen detection) or
c)
in the case of bovine animals, also by histological examination in connection with clinical manifestations
has been identified;
2.
Suspected Aujeszky ' s disease, if it has been identified by clinical, serological or histological examination.
Sentence 1 (1) (a) and (2) in the case of serological examination shall apply to pigs vaccinated with vaccines as defined in Article 3 (4) only if antibodies against the gl-glycoprotein of the virus of Aujeszky ' s disease (2) For the purposes of this Regulation, a pig population free of Aujeszky ' s disease is a herd of pigs which has
1.
meets the requirements of Appendix 1; or
2.
is situated in an area which, in accordance with Article 10 of Council Directive 64 /432/EEC of 26 June 1964 on animal health conditions, is not directly applicable to the European Community or to the European Union Questions relating to intra-Community trade in bovine animals and swine (OJ L 327, 31.12.2002, p EC No L 121 p. 1977) as amended by the Federal Ministry of Food, Agriculture and Consumer Protection (Federal Ministry for Food, Agriculture and Consumer Protection) in the Federal Gazette (Bundesanzeiger) is considered to be free of Aujeszkyscher's disease.

§ 2

In order to maintain the status of an area free of Aujeszky's disease within the meaning of § 1 para. 2 no. 2, the examinations according to Appendix 2 shall be carried out.

II.
Protection measures against Aujeszky's disease in pigs

1.
General protection measures

§ 3

(1) vaccinations against Aujeszky ' s disease, as well as medical tests for pigs suspected of being infected and suspected of being infected, shall be prohibited. § 3a

§ 4

(1) Breeding and commercial pigs may be used
1.
in pig herds, only spent or discontinued, or
2.
on livestock markets, animal shows or exhibitions or events of a similar nature only
if they originate from a pig population free of Aujeszky's disease. Special protection measures

A.
Before official identification of Aujeszky ' s disease or disease suspicion

§ 5

In the event of an outbreak or suspicion of the outbreak of Aujeszky ' s disease in pigs in a farmhouse or in another location, the following shall be considered before the official determination:
1.
The owner has good signs with the clear and durable inscription "Aujesky's Disease-Unauthorised Access" at the entrances to the farmhouse and to the swine and other sites in or on which pigs are located. to be visible.
2.
The owner has to confront all pigs in their stables or at their other locations.
3.
Stalls or other locations in or on which pigs are located may only be used by the owner of the pigs, his representative, the persons responsible for the supervision, maintenance and care of the pigs, by veterinarians and by persons in the official contract, in each case only in the case of a protective clothing which has been passed on.
4.
The persons referred to in point 3 shall, after leaving the stables or sites, immediately put off the protective clothing and have the hands cleaned and disinfected.
5.
Pigs may not be moved to the farmhouse or to any other location, or removed from the farmhouse or other site.
6.
Dead or killed pigs, rebutted or deceased fruit, total-born piglets or post-births must be kept in such a way that they are protected from external influences and that people or animals cannot come into contact with them.
7.
Parts, products and raw materials originating from pigs, as well as fodder, litter, manure and liquid stables, as well as other objects which have come into contact with pigs shall not be removed from the farmhouse or other site.

B.
After official detection of Aujeszky's disease or disease suspicion

Section 5a

The competent authority shall make public the outbreak of the disease. Unofficial table of contents

§ 6

If the outbreak or suspected outbreak of Aujeszky ' s disease has been officially detected in pigs, the farmhouse or other site shall be subject to the following conditions:
1.
The owner has good signs with the clear and durable inscription "Aujeszky's Disease-Unauthorised Access" at the entrances to the farmhouse and to the swine and other sites in or on which pigs are located. to be visible.
2.
The owner has to confront all pigs in stables or other locations.
3.
Pigs may be moved to the farmhouse or other site or removed from the farmhouse or site only with the approval of the competent authority; the removal shall be permitted only
a)
for immediate slaughter in a slaughterhouse designated by the competent authority, or
b)
for the purpose of fattening in a fattening stock, provided that the pigs to be moved and all the bills of the receiving stock have been vaccinated at least twice against Aujeszky ' s disease and shall ensure that the pigs from that herd are Stock only shall be removed for the purpose referred to in point (a).
4.

At the entrants and exits of the stables, mats or other suitable equipment must be fitted for disinfection of the footwear which, according to the instructions of the veterinarian, must be constantly provided with an effective disinfection agent.
10.
Stalls or other locations in or on which pigs are located may only be used by the owner of the pigs, his representative, the persons responsible for the supervision, maintenance and care of the pigs, by veterinarians and by persons in the official contract, in each case only in the case of a protective clothing which has been passed on.
11.
The persons referred to in paragraph 10 shall, after leaving the stables or sites, immediately deposit the protective clothing and have the hands cleaned and disinfected.
12.
All persons who leave the farmhouse have to disinfect their footwear in advance.
13.
Dogs and cats shall be kept away from stables or other locations in or on which pigs are located.

§ 7

(1) If Aujeszky ' s disease is officially detected in a farmhouse or other site, the competent authority shall arrange for the killing and destruction of the disease sufferers, as well as the killing of the suspected pigs. It may order the killing of the other pigs, provided that this is necessary for reasons of disease control. This also applies to piglets killed up to two weeks old. (2) If the suspicion of Aujeszky's disease has been officially detected in a farmhouse or other site, the competent authority shall order the killing of the disease on the basis of a A serological examination of pigs suspected of being infected with the disease. It may order the killing of the suspected pigs identified as a result of a clinical investigation. § 10

If the outbreak of Aujeszky ' s disease in pigs is officially detected in a farmhouse or other site, the competent authority may, within a certain radius of the area concerned, be able to locate the site or location in question. C.
In case of contagion

§ 11

If the outbreak or suspected outbreak of Aujeszky ' s disease has been officially detected in a farmed or other site, the competent authority shall investigate epizootiological investigations and shall submit to all the pigs of the Related or other sites,
1.
of which the disease has been introduced or
2.
in which the disease has already been dragged on
, for the duration of three weeks of official observation. The competent authority may order the killing of the pigs suspected of being infected.

D.
Disinfection

§ 12

(1) After removal of the infected and suspected pigs, the veterinarian shall be immediately informed of the instructions of the official veterinarian.
1.
to clean, disinfect, disinfect and depart the stables and other locations in or on which sick or suspected pigs have been kept;
2.
Articles of any kind which may be carriers of the disease control system, including the vehicles which have come into contact with these animals, must be cleaned and disinfected.
(2) Feed and litter, which may be carriers of the disease regulator, shall be incinerated or packed together with the Dung; fodder may also be subjected to a treatment procedure which ensures the destruction of the disease regimer. The dung shall be packed at a place inaccessible to pigs, disinfected or stored for at least two months after the official veterinarian has been instructed to do so. Liquid exits from the pigs ' stalls or other sites of the pigs shall be disinfected or stored for at least two months after the instruction of the official veterinarian has been closely instructed. By way of derogation from the rates 2 and 3, the competent authority may authorise shorter storage periods if it does not preclude the control of the disease. Protection measures for pig exhibitions

§ 13

§ 14

1.
a)
all the pigs of the stock have died or have been killed or have been removed, or
b)
the infected and suspected pigs and their piglets, up to two weeks old, have died or have been killed or have been removed and, in the case of the rest of the pigs, there are no occurrences suspected of Aujeszky ' s disease and two blood samples taken at intervals of at least four weeks in all pigs over three months of age have been studied with a negative result on Aujeszky ' s disease, and
2.
the measures provided for in Article 12 (1) and (2) have been carried out according to the instructions of the official veterinarian and have been removed from the veterinary surgeon.
(3) The suspicion of Aujeszky ' s disease shall be deemed to be eliminated if:
1.
the suspect pigs have died or have been killed or have been removed, and
2.
in the case of the remaining pigs of the stock
a)
no clinical manifestations of Aujeszky ' s disease have been observed, and
b)
no earlier than 21 days after the removal of the suspected pigs, a serological survey has been carried out in accordance with Section I (1) (b) of Appendix 1, with negative results.

III.
Protection measures against Aujeszky's disease in other animals

§ 15

In the case of other animals susceptible to Aujeszky ' s disease, if the outbreak or suspected outbreak of the disease is officially detected, the provisions of sections 5a to 14 shall apply mutatily.

IV.
Irregularities

§ 16

Contrary to the provisions of Section 32 (2) (4) (a) of the Animal Health Act, who intentionally or negligently is acting in accordance with the provisions of the Animal Health Act
1.
, contrary to § 3 (1), a vaccination or a medical test shall be carried out,
2.
shall be contrary to a fully-enforceable condition connected with an authorisation pursuant to Article 3 (2), Section 3a, sentence 2, Section 6, point 3, part of the sentence before the second half sentence, point 4, first sentence, or point 5, sentence 1, or section 12, second sentence, sentence 4;
3.
a enforceable arrangement according to § 3 (3) or (5), § 3a, sentence 1, § 3b, § 6 number 6, 7, 8 or number 9, § 7, § 10 or § 11 sentence 2, also in connection with § 13 or § 15, or in accordance with § 12 paragraph 1 or paragraph 2 sentence 2 or sentence 3 shall be contrary to
4.
Contrary to § 4, a pig spends,
5.
, contrary to § 5 (1) or (6) (1), does not apply a sign, not correct or not in good time,
6.
, contrary to Article 5 (2) or § 6 (2), a pig is not or is not dissected in good time,
7.
enters a stable or other location in accordance with Section 5 (3) or Section 6 (10),
8.
, contrary to § 5 (4) or (6) (11) or (12), protective clothing shall not be deposited in due time or shall not be cleaned or disinfected in time, or shall not be carried out in good time,
9.
, contrary to § 5 (5) or § 6 (3), second half-sentence, a pig spends or removes a pig,
10.
, contrary to Article 5 (6), a pig, a fruit, a piglet or a rebirth is not stored, or is not stored correctly,
11.
Article 5 (7) removes the subject-matter referred to therein,
12.
, without authorisation pursuant to § 6, point 3, sentence 1, before the second half-sentence or the first sentence of paragraph 5, a pig spends or removes a pig,
13.
shall cover a pig without authorisation pursuant to Article 6 (4) sentence 1,
14.
, contrary to § 6, point 4, sentence 2, seeds,
15.
Contrary to Article 6 (5), second sentence, a fruit, piglet or rebirth shall not be disposed of, not properly or in a timely manner,
16.
Contrary to § 6, point 13, a dog or cat is not kept away or
17.
, contrary to § 12 (3) Dung or liquid waste disposal.

Section I
Aujeszky ' s disease of free swine population (basic examination)
1.
An inventory shall be deemed to be free of Aujeszky's disease if:
a)
all the pigs of the population are free from clinical signs pointing to Aujeszky ' s disease and
b)
a serological examination
aa)
in the case of breeding stocks in all sows, deckable jars, all donors and at least five-month-old junk donors,
bb)
in the case of mixed stocks, in all breeding sows, deckable jars, all breeding animals, all other donors at least five months old, and in fattening pigs, in accordance with the sampling key referred to in Section II, point 4,
cc)
in the case of flocks in the pigs, in accordance with the sampling key referred to in point II (2),
dd)
in the case of fattening stocks in pigs, in accordance with the sampling key referred to in point II (4)
has been carried out with a negative result against the glycoprotein I gene (gl-glycoprotein) of the Aujeszky ' s disease virus, or
c)
all the pigs in the stock are free from Aujeszky ' s disease and, depending on the type of pig farming, a sample examination in accordance with section II, No 2, 3 or 4, with negative results against the glycoprotein I gene (gl-glycoprotein) of the Aujeszky ' s disease virus has been carried out.

The serological examination referred to in point 1 (b) shall be carried out in an examination procedure. In the case of ferot-carrying sows, the examination of the sow can be replaced by the examination of a healthy, up to three-week-old piglet of its litter; in this case, the investigation period extends to up to nine months. During the examination period, only pigs free from Aujeszky ' s disease may be placed in the herd.
4.
The pigs of the stock may not have contact with pigs outside the stock that are not free from Aujeszky's disease. This also applies to the participation of the pigs of the stock in markets, animal shows or similar events as well as for their transport.
5.
The sows of the herd may only be covered by a saponified boar or by an eber from a stock free from Aujeszky ' s disease, or an eber of the stock may only sow its own stock or sows from one of the of Aujeszky's disease free stock. If artificial insemination is to be carried out, only sperm can be used by Ebern of an insemination station that is free from Aujeszky's disease.
6.
The provisions of points 1 to 5 shall be deemed to be fulfilled in the case of pig herds which have been recognised as having been legally recognised in Aujeszky ' s disease before the date of entry into force of this Regulation.

Section II
Maintenance of the status of a pig population free of Aujeszky ' s disease (check-ups)

The status of a stock as free of Aujeszky's disease will be maintained if the following requirements are met:
1.
All pigs are free from clinical manifestations indicating Aujeszky's disease.
2.
At a distance of six months, blood serological control tests with negative results on antibodies against the gI glycoprotein of the Aujeszky ' s disease virus must have been carried out in the case of breeding sows and ebers. The competent authority may, depending on the epidemiological situation, shorten the distance for the inspection to three months or extend it up to a maximum of twelve months. The blood serological examination referred to in sentence 1 must be carried out in an examination procedure. The examination shall be carried out according to the following key:

Number of breeding sows and -ebernumbers of animals to be examined
1 to 20 animals all animals
21 to 25 animals 20 animals
26 to 100 animals 25 animals
101 and more animals 30 animals
In this case, other breeding sows and ebers from different bays or stables are to be investigated as far as possible. In the case of ferot-carrying sows, the examination of the sow can be replaced by the examination of at least one healthy, up to three-week-old piglet of its litter; in small stocks (up to 10 breeding sows and eber), the examination of the sows can be also be replaced by the examination of other rebreeding animals. In the case of check-ups, the number of sows to be investigated may be taken into account for breeding sows and ebers, or of coverable jungsauen, or of Jundonors on Aujeszky ' s disease, for other reasons in the Investigation period.
3.
Point 2 shall apply to breeding pigs in breeding establishments and insemination stations.
4.
In mixed herds or in fattening stocks, the fattening pigs shall be tested serologically with negative results for antibodies against the gl-glycoprotein of the Aujeszky ' s disease virus according to the following key:

Number of fattening pigs per herd of fattening pigs per stock
all animals, but
1 to 10 Mastschweine maximum 8 animals
11 to 20 Mastschweine 10 animals
21 to 30 Mastschweine 11 animals
31 to 60 Mastschweine 12 animals
61 to 200 Mastschweine 13 animals
201 and more fattening pigs 14 animals
The number of animals to be examined may be taken into account for studies of fattening pigs carried out for other reasons during the investigation period. The blood samples can also be taken at the slaughterhouse. With regard to the examination interval, the first and second sentences of paragraph 2 shall apply accordingly.
5.
In the event that individual Reagents are determined in the case of an investigation according to point 2, 3 or 4, the status shall be based on the removal of the suspicion according to § 14 (3).
6.
Only pigs from a pig population free of Aujeszky ' s disease may be placed in the herd.
7.
Section I (4) and (5) shall apply accordingly.

Appendix 2 (to § 2)
Investigations to maintain the status of the area of Germany as free from Aujeszky's disease

1.
In breeding flocks, sample tests are carried out annually in order to identify with a probability of 95 of the hundred and an assumed rate (prevalence threshold) of 0.2 from the hundred infested stocks (control investigations). The following key shall be used to carry out an examination in the stocks subject to the sampling procedure:
Number of breeding sows per stock number of breeding sows to be investigated per inventory for each inspection
1-20 breeding sows all animals
21-25 breeding sows 20 animals
26-100 breeding sows 25 animals
101 and more breeding sows 30 animals
In this case, it is possible to examine, as far as possible, breeding sows from different bays or stables and from these, preferably breeding sows with disturbed general conditions, fertility problems or stillbirths. In the case of ferot-carrying sows, the examination of the sow can be replaced by the examination of at least one healthy, up to three-week-old piglets of its litter; in stocks up to 10 breeding sows, the examination of the sows can also be carried out by the Examination of other rearing animals is replaced. The number of sows to be examined may be taken into account for investigations of breeding sows or of deckable jungsauen, or of Jundonors of the stock on Aujeszky's disease, which are carried out for other reasons during the investigation period.
2.
Number 1 shall apply to breeding pigs in breeding establishments and insemination stations.
3.
In mixed stocks or fattening stocks, sampling is carried out annually in order to detect a probability of 95 of the hundred and a prevalence threshold of 0.2 of the hundred infested herds. The sampling shall be carried out according to the following key:

In this case, in each case fattening pigs from different bays or stables and from these, preferably fattening pigs with a disturbed general location, are to be examined. The number of fattening pigs to be examined may be taken into account for the examination of fattening pigs in the population of Aujeszky ' s disease, which are to be carried out for other reasons during the investigation period. Blood sampling may also be carried out at the slaughterhouse. Number 1 shall apply to breeding pigs in mixed herds.
