§ 1 Definition

(1) flavourings within the meaning of this Regulation shall be products referred to in Article 3 (2) (a) of Regulation (EC) No 1334/2008 of the European Parliament and of the Council of 16 December 2008 on flavourings and certain food ingredients with Flavouring properties for use in and on foods and amending Council Regulation (EEC) No 1601/91, Regulations (EC) No 2232/96 and (EC) No 110/2008 and Directive 2000 /13/EC (OJ L 327, 30.12.2008, p. 34, L 105, 27.4.2010, p. 115). (2) As flavourings for the purposes of this Regulation, products shall not apply in accordance with Article 2 (2) of Regulation (EC) No 1334/2008. Unofficial table of contents

§ 2 Prohibitions and Restrictions

Ready-to-eat foods containing quinine may only be placed on the market for commercial purposes if the content thereof does not exceed the maximum quantities fixed in Appendix 4. Unofficial table of contents

§ 3 Additives

(1) additives are authorised
1.
the flavouring substances listed in Annex 5 (1) (a) for the production of flavourings intended for use in the foodstuffs listed in Appendix 6 and their ingredients,
2.
the flavouring substance listed in Annex 5 (1) (b) for the production of lacrits,
3.
the flavouring substances listed in Annex 5 (1) (c) for the production of spirit drinks and soft drinks,
4.
the substances listed in Appendix 5 (2) to influence the taste of flavourings, the amino acids listed there and their salts, and glutamic acid, monosodium glutamate and monocaliumglutamate, in addition to the production of reaction flavourings.

(2) The content of these additives shall not exceed the maximum levels fixed in Annex 5. The content of glutamic acid and glutamate may not exceed 10,000 milligrams per kilogram, calculated as glutamic acid, in the ready-to-eat foodstuff. (3) For smoking foods in general, except for the smoking of water, aqueous solutions, edible oils, other liquids and nitrite pickling salts, freshly developed smoke from natural wood and twigs, heather and coniferous seeds, also with the use of spices, is authorised. § 4 Notices of natural origin

Flavourings intended for supply to consumers within the meaning of Article 3 (4) of the Food and Feed Code, and in which the term "natural" is used in their sales denomination, may only be used in commercial terms in the If the term 'natural' is used in accordance with Article 17 (2) in conjunction with Article 16 of Regulation (EC) No 1334/2008. § 5 Transport ban

Flavourings and non-alcoholic soft drinks containing quinine or its salts may only be placed on the market for commercial purposes if they are indicated by the indication "chininhaltig". The first sentence shall not apply to non-alcoholic soft drinks to be labelled in accordance with the provisions of the Food Labelling Regulation. Unofficial table of contents

§ 6 Crime offences and administrative offences

(1) According to § 58 (1) (18), (4) to (6) of the Food and Feed Code, it shall be punished who intentionally or negligently

In the case of foodstuffs referred to in paragraph 2 above, it places the
(2) In accordance with Article 59 (1) (21) (a) of the Food and Feed Code, it shall be punished who, in the commercial production of foodstuffs intended to be placed on the market, shall be punished by the penalties provided for in Article 3 (3) (a) of the Directive. (3a) In accordance with Article 59 (3) (2) (a) of the Food and Feed Code, it shall be punished who, in breach of Article 14 (1), first sentence, in conjunction with Article 16 of Regulation (EC) No 1334/2008 of the European Parliament and of the Council of 16 December 2008 on flavourings and certain food ingredients with flavouring properties for use in and on foods, and amending Council Regulation (EEC) No 1601/91, Regulations (EC) No 2232/96 and (EC) No 110/2008 and the Directive 2000 /13/EC 34) puts flavourings on the market in which the term 'natural' is not used properly. (4) In accordance with Article 59 (3) (1) of the Food and Feed Code, it shall be punished who, contrary to Article 4. Paragraph 2 of Regulation (EC) No 2065/2003 of the European Parliament and of the Council of 10 November 2003 on smoke flavourings intended for actual or intended use in or on foods (OJ L 284, 31.10.2003, p. EU No 1), a smoke flavouring or a food in or on which a smoke flavouring is present shall be placed on the market. (5) Anyone who is negligent in committing a act referred to in paragraph 2, 3, 3a or paragraph 4 shall act in accordance with section 60 (1) of the food and (6) Contrary to Article 60 (4) (2) (a) of the Food and Feed Code, who intentionally or negligently contrasts with the first sentence of Article 14 (1) in connection with the Article 15 (1) or, contrary to Article 17 (1) of Regulation (EC) No 1334/2008, flavourings in the transport which is not marked or not in the prescribed manner. § 7 Transitional provision

(1) Until 27 January 2006, flavourings and other foodstuffs may be labelled or placed on the market after the provisions in force until 25 January 2005 and continue to be placed on the market until the stocks have been dismantled. (2) Until on the expiry date of 14 August 2008, flavourings and other foodstuffs may be labelled or placed on the market after the provisions in force until 14 February 2008 and continue to be placed on the market until the stocks are dismantled .
