§ 1 Purpose

§ 2 Composition

(1) The Commission is made up of three members. The members of the Commission must have special scientific knowledge in the field of preparation and implementation of research activities in polar regions or in relevant fields of environmental protection. § 3 Independence

§ 4 vocation of members

(1) The members of the Commission and their alternates shall be appointed by the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety, in agreement with the Federal Foreign Office and the Federal Ministry of Education and Research for a period of three years. One-off revocation is possible.(2) The activity in the Commission shall be voluntary.(3) The members of the Commission and its alternates may at any time declare their departure from the Commission to the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety. § 5 Task

§ 6 Participation of other persons and entities

(1) The Federal Ministries referred to in § 4 will be responsible for the meetings of the Commission invited. Session records and outcome protocols shall be forwarded to them. Their representatives shall be given the floor on request.(2) The Federal Environment Agency shall be informed of a meeting to be held. It has the right to send representatives to the meetings of the Commission. The provisions of the second sentence of paragraph 1 shall apply mutatily.(3) In order to carry out its tasks, the Commission may entrust individual Members and their alternates with the performance of certain tasks. In exceptional cases, which are of fundamental importance and which cannot be resolved on the basis of their own assessment, the Commission may hear external experts, consult experts or arrange investigations by third parties.(4) The Commission shall provide the applicant with the opportunity to submit comments on the occasion of the request. § 7 Chairman and Rules of Procedure

(1) Members of the Commission elect from among their members a member of the Executive Board and his alternate member for a period of three years. § 8 Sessions

(1) The sessions of the Commission are not public.(2) Members shall be entitled to vote, in the event of their prevention or in the event of concern, the respective alternates.(3) If a Member is prevented from participating, it shall immediately inform its alternate member and the Chairman of the Commission. § 9 Decision-making

(1) The Commission is quorum if all members are entitled to vote within the meaning of Section 8 (2) or represented by voting deputy members.(2) Decisions concerning the assessments referred to in § 5 shall be taken as consensual as possible.(3) The Commission's decision-making may be brought about by written procedure. § 10 Cooperation with the Federal Environment

(Umweltbundesamt) (1) The Federal Environment Agency (Umweltbundesamt) states that pursuant to Section 6 (4) of the The Environmental Protection Protocol Implementing Act requires the Commission to be responsible for the documentation submitted by the applicant pursuant to Section 7 (1) or Section 8 (3) (11) of the Environmental Protection Protocol Implementing Act, which are required to be assessed without delay.(2) The Federal Environment Agency shall grant the Commission access to all other documents submitted by the applicant.(3) The Commission's assessments of research activities with at least likely minor or temporary effects on the protection goods referred to in Article 3 (4) of the Environmental Protection Protocol Implementing Act are the Federal Environment Agency shall be forwarded to the Commission within one month of receipt of the dossier. § 11 Activity report

§ 13 Entry into force
