First section
Release from the pharmacy obligation

§ 1 

(1) The following medicinal products within the meaning of Article 2 (1) or (2) (1) of the Medicines Act, which are intended to serve for the disposal or alleviation of diseases, suffering, bodily harm or pathological ailments, shall be used for the following medicinal products: Free circulation outside pharmacies:
1.
Substances and preparations of substances and medicinal products within the meaning of Article 2 (2) (1) of the Medicinal Products Act, referred to in Appendix 1a to this Regulation, for the purpose of determining this Annex; the substances and preparations of substances may or may not be subject to one another or to other substances or substances; or Preparations of substances are only mixed, to the extent that this is expressly permitted in the plant.
2.
Distillates, other than dry distillates, of mixtures of Plants, parts of plants, essential oils, camphor, menthol, balsamine or resins as ready-to-use medicinal products, unless they are made up of a prescription or of the plants referred to in Appendix 1b to this Regulation, their parts or Components are obtained and
3.
Plants and parts of plants in the form of dragees, capsules or tablets as ready-to-use medicinal products under the addition of medicinal products which are not more effective Substances or preparations of substances if they are made up of at most four of the plants and parts of plants referred to in Appendix 1c to this Regulation, and the diameter of the dragey or tablet is at least 3 millimetres .
(2) Furthermore, soluble tea infusion powders are released for transport outside the pharmacy as aqueous complete trains in the form of ready-to-use medicinal products, which are made of
1.
one of the plants or their parts referred to in Appendix 1d to this Regulation are manufactured or
2.
Mixtures of not more than seven of the plants or their parts referred to in Annexes 1d and 1e to this Regulation, and exclusively for the purpose of: Use as "Hustentee", "chest tea", "cough and breast tea", "Magentee", "intestinal tea", "stomach and bowel tea", "sedative tea" or "urinating tea".
The addition of medicinally non-active substances, or Preparations of substances are permitted. The ethereal oils of the initial drugs lost in the production may be replaced by type and quantity. Non-official table of contents

§ 2

(1) Medicinal products within the meaning of § 2 (1) or (2) (1) of the German Medicines Act are used as ready-to-use medicinal products for the traffic outside the pharmacies is also released if they are intended solely for the purpose:
1.
Cough or hoarseness, provided that they contain no substances or preparations other than those referred to in Annex 2a to this Regulation in respect of medicinal products which are active in medicinal products, and provided that they are used in pharmaceutical forms for the purpose of shall be placed on the market,
2.
to be used as a seductive, provided that it does not contain any active substance other than that contained in Appendix 2b to this Annex. Regulation of substances or preparations mentioned above,
3.
in the case of chicken eyes or cornea, provided that they are not active in the active substance Substances or preparations other than those referred to in Annex 2c to this Regulation.
(2) The medicinal products referred to in paragraph 1 may also be added to substances or preparations of substances which are not active in the medicinal product. Non-official table of contents

§ 3

§ § 1 and 2 do not apply to medicines used for injection or infusion, rectal, vaginal or intrauterine use, for intramammary use in animals, as wound sticks, as implants and as aerosols up to an average particle size of no more than 5 mym for direct use on or in the body . § 4

For traffic outside of pharmacies, medicinal products within the meaning of § 2 (1) or 2 (2) number are released. 1 of the Medicines Act, which is
1.
exclusively for use in ornamental fish, ornamental or songbirds, Pigeons, terrariesas, small-naves, ferrets or non-food rabbits are intended and
2.
for the respective application at the animal species in question referred to in point 1 shall not be subject to the obligation to presenter under Article 48 (1) of the Medicinal Products Act.

§ 5

The release of the medicinal products referred to in § § 1, 2 and 4 for the circulation outside the pharmacies is not excluded by the fact that they are intended, in part, for purposes other than for disposal. or alleviation of disease, suffering, bodily harm or pathological ailments. § 6

The release of the medicinal products referred to in § § 1, 2 and 4 for traffic outside of the pharmacies is, as far as possible, in of this Regulation shall be excluded if, in part or exclusively, they are intended for disposal or alleviation or if they are intended in part for the prevention of the diseases or suffering referred to in Annex 3. name="BJNR021050988BJNG000800300 " />

§ 7 

(1) The medicinal products referred to in § 44 (2) of the Medicines Act are excluded from the traffic outside of pharmacies if
1.
they are the substances or preparations of substances referred to in Appendix 4 to this Regulation,
2.
they are the plants referred to in Appendix 1b to this Regulation, their parts, preparations thereof or pressing juices,
3.
to them the substances or preparations mentioned in the numbers 1 or 2 are added to them,
4.
in part or exclusively for the disposal, alleviation or prevention of the diseases or ailments referred to in Appendix 3.
(2) The medicinal products referred to in § 44 (2) of the Medicinal Products Act, which are partial or are intended exclusively for the disposal, alleviation or prevention of the diseases or ailments referred to in Appendix 3 (paragraph 1 (4)), but shall be released for transport outside pharmacies:
1.
Spare waters against those listed in Appendix 3 under Section A, No. 3, and 5 (d) and (e) Diseases and sufferings,
2.
Heilerden, Bademoore, other Peloids and preparations for the manufacture of baths, insofar as they are not in small packages in the retail sector. Transport,
3.
the medicine referred to in § 44 (2) no. 5 of the Medicinal Products Act.

§ 8

(1) The medicines referred to in § 44 (1) of the Medicines Act are excluded from the traffic outside of pharmacies if
1.
they are the substances or preparations of substances mentioned in Appendix 4 to this Regulation ,
2.
they are the plants referred to in Appendix 1b to this Regulation, their parts, preparations thereof or compacts,
3.
to them the substances or preparations mentioned in the numbers 1 or 2 are added to them,
4.
in part or exclusively for the prevention of the diseases or ailments referred to in Appendix 3.
(2) Paragraph 1 (4) does not apply to medicinal products intended for the prevention of diseases of the ornamental fish, ornamental or songbirds, pigeons, Terrarientiary, small-needle, ferret or non-food rabbits are intended for use in the production of food. Non-official table of contents

§ 9

The medicinal products referred to in § 44 of the Medicines Act are also subject to traffic outside pharmacies. excluded if they are chemical compounds that, according to medical science findings, have an
antibiotic,
blood clotting retarder,
histamine adverse,
hormonal,
parasympathicomimetic (cholingian) or
parasympathicolytic,
sympathicomimetic (adrenergic) or sympathicolytic

Medicines, which are on the 31. The second regulation amending the regulation on pharmacy and free-selling medicinal products will be subject to the provisions of the second Regulation amending the regulation on pharmacies, until 1 January 2007, and until 1 January 2007.
