First section
Release from the pharmacy obligation

§ 1

(1) The following medicinal products within the meaning of Article 2 (1) or (2) (1) of the Medicinal Products Act, intended to serve for the disposal or alleviation of diseases, suffering, bodily injury or pathological ailments, shall be used for transport purposes. outside of pharmacies:
1.
Substances and preparations of substances and medicinal products within the meaning of Article 2 (2) (1) of the Medicinal Products Act, referred to in Appendix 1a to this Regulation, on the basis of the detailed description of this Annex; substances and preparations of substances may only be mixed with one another or with other substances or preparations of substances, to the extent that this is expressly permitted in the installation.
2.
Distillates, other than dry distillates, of mixtures of plants, parts of plants, essential oils, camphor, menthol, balsames or resins, as ready-to-use medicinal products, unless they are obtained from prescription or those used in Appendix 1b to the Regulation referred to in Regulation (EC) No
3.
Plants and parts of plants in the form of dragees, capsules or tablets as ready-to-use medicinal products, with the addition of non-active substances or preparations of substances, if they are not more than four of the substances referred to in Annex 1c to this Regulation. Plants and parts of plants are produced and the diameter of the Drageekerns or the tablet is at least 3 millimetres.
(2) In addition, for transport outside pharmacies, soluble tea infusion powders are released as aqueous complete trains in the form of ready-to-use medicinal products, which are
1.
one of the plants or parts thereof referred to in Appendix 1d to this Regulation, or
2.
Mixtures of not more than seven of the plants or their parts referred to in Annexes 1d and 1e to this Regulation and exclusively for use as "cough tea", "breast tea", "cough and breast tea", "magientee", "bowel tea", "stomach" and bowel tea "," sedative tea "or" diuretic tea " shall be placed on the market.
The addition of substances or preparations of substances which are not active in medicinal products shall be permitted. The ethereal oils of the initial drugs lost in the production may be replaced by type and quantity. Unofficial table of contents

§ 2

(1) Medicinal products within the meaning of Section 2 (1) or (2) (1) of the Medicines Act are also released for use in the form of ready-to-use medicinal products for transport outside of pharmacies, if they are intended solely for the purpose of:
1.
in the case of cough or hoarseness, provided that they contain no substances or preparations other than those referred to in Annex 2a to this Regulation, and provided that they are used in pharmaceutical forms for the purpose of lutching shall be placed on the market,
2.
if they contain no other substances or preparations other than those referred to in Appendix 2b to this Regulation, to be used as a seductive agent,
3.
in the case of chicken eyes or cornea, provided that they contain no other substances or preparations other than those referred to in Annex 2c to this Regulation in respect of medicinal products.
(2) The medicinal products referred to in paragraph 1 may also be added to substances or preparations containing substances which are not active in the field of medicine. Unofficial table of contents

§ 3

§ § 1 and 2 shall not apply to medicinal products intended for injection or infusion, for rectal, vaginal or intrauterine use, for intramammary use in animals, as wound sticks, as implants and as aerosols up to a medium Particle size of not more than 5 mym for direct use on or in the body. § 4

Medicinal products within the meaning of Article 2 (1) or (2) (1) of the Medicines Act are released for circulation outside the pharmacies.
1.
are intended solely for use in ornamental fish, ornamental or songbirds, pigeons, terrarids, small-naves, ferrets or non-food-producing rabbits; and
2.
shall not be subject to the obligation to presenter in accordance with Section 48 (1) of the Medicinal Products Act for the purposes of the respective application in the case of the species in question.

§ 5

The release of the medicinal products referred to in § § 1, 2 and 4 for transport outside pharmacies shall not be excluded by the fact that they are intended, in part, for purposes other than disposal or alleviation of diseases, Suffering, body damage or pathological ailments. § 6

The release of the medicinal products referred to in § § 1, 2 and 4 for transport outside pharmacies shall be excluded, unless otherwise provided in this Regulation, if they are partially or exclusively intended for disposal or alleviation or relief. if they are intended in part for the prevention of the diseases or ailments referred to in Appendix 3.

Second section
Inclusion in the pharmacy requirement

§ 7

(1) The medicinal products referred to in § 44 (2) of the Medicines Act are excluded from the traffic outside the pharmacies if:
1.
they are the substances or preparations of substances referred to in Appendix 4 to this Regulation,
2.
the plants referred to in Appendix 1b to this Regulation, the parts thereof, preparations thereof or compacts,
3.
they are added to the substances or preparations of substances referred to in points 1 or 2,
4.
they are intended in part or exclusively for the elimination, alleviation or prevention of the diseases or ailments referred to in Appendix 3.
(2) The medicinal products referred to in § 44 (2) of the Medicinal Products Act, which are intended in part or exclusively for the elimination, alleviation or prevention of the diseases or ailments referred to in Appendix 3 (paragraph 1 (4)), are, however, for: the traffic outside of the pharmacies is released:
1.
Curative waters against the diseases and ailments listed in Appendix 3 of Section A (3) and (5) (d) and (e);
2.
Healers, bath-demos, other peloids and preparations for the production of baths, in so far as they are not placed on the market in small packages in the retail trade,
3.
the medicinal products referred to in Article 44 (2) (5) of the Medicinal Products Act.

§ 8

(1) The medicinal products referred to in § 44 (1) of the Medicines Act are excluded from the traffic outside the pharmacies if:
1.
they are the substances or preparations of substances referred to in Appendix 4 to this Regulation,
2.
the plants referred to in Appendix 1b to this Regulation, the parts thereof, preparations thereof or compacts,
3.
they are added to the substances or preparations of substances referred to in points 1 or 2,
4.
be partially or exclusively intended for the prevention of the diseases or ailments referred to in Appendix 3.
(2) Paragraph 1 (4) shall not apply to medicinal products intended for the prevention of diseases of ornamental fish, ornamental or sonic birds, pigeons, terrarium animals, small-nagers, ferrets or rabbits which are not used for the production of foodstuffs. Unofficial table of contents

§ 9

The medicinal products referred to in § 44 of the Medicines Act are also excluded from the market outside pharmacies if they are chemical compounds which, according to the findings of medical science, are
antibiotic,
blood clotting retarders,
Histamine adverse,
hormone-like,
parasympathicomimetical (cholinergic) or
parasympathicolytic,
sympathicomimetical (adrenergic) or sympathicolytic

§ 10

§ 11

Medicinal products which are on the market on 31 January 2007 and which will be subject to the second Regulation amending the Regulation on pharmacies and medicinal products which are subject to pharmacies, may not be released until 1 May 2007 by continue to be placed on the market by pharmaceutical companies and thereafter by wholesalers and retailers.
