Type 5 Legal treatment of decommissioned land

Areas subject to the conditions laid down in Council Regulation (EEC) No 1094/88 of 25 April 1988 amending Regulations (EEC) No 797/85 and No 1760/87 as regards the closure of arable land and the extensification and conversion of production (OJ L 327, 31.12.1988, p. EC No 28), continue to be considered as agricultural land; the legislation applicable to agriculture in other areas of law, in particular in the area of civil law, is subject to the Land traffic law, land lease traffic law, building law, nature conservation law and statistics continue to apply to these areas. The right to use these areas at the end of the period of closure of the same type and to the same extent as at the time the application is submitted shall remain. The first half-sentence shall not apply to the social security legislation. In addition, the first and second sentences do not apply if the areas have been forested or redesigned in such a way that they can subsequently be used for agricultural or forestry use only with a disproportionate effort.
