§ 1 Order as Federal Statistics

In accordance with this law, the following agricultural statistics are carried out as federal statistics:
1.
land use survey,
2.
the collection of livestock,
3.
the structural surveys in agricultural and forestry holdings,
4.
the harvest survey;
5.
poultry statistics,
6.
the slaughter and slaughter weight statistics;
7.
the milk statistics,
8.
fisheries and aquaculture statistics,
9.
the wine statistics,
10.
the timber statistics,
11.
the fertilizer statistics.

Section 1
Land use survey

§ 3 Survey units

Survey units of the area survey are the municipalities and areas in general defamation. Unofficial table of contents

(1) The area survey is generally carried out annually at the reporting date of 31 December of the previous year. (2) The survey characteristics are the ground areas according to the type of actual use. Unofficial table of contents

§ 6 Survey units

Survey units of the ground-use main survey are:
1.
the establishments referred to in Article 91 (1a) (1),
2.
in Bavaria: area of at least five hectares of agricultural area used in common use.

§ 7 Survey type, periodicity, survey period, characteristics

(1) The land use main survey is carried out in the period from January to May:
1.
in general in the years 2010 and 2016, where characteristics are collected about the use of the land;
2.
in the case of a maximum of 80 000 units of survey each year, except for the years in which the survey is carried out in accordance with point 1; the characteristics, with the exception of intermediate crop cultivation, shall be those of the survey referred to in point 1.
(2) The survey referred to in paragraph 1 (2) shall not be carried out in the Länder of Berlin, Bremen and Hamburg. (3) The survey referred to in paragraph 1 shall form an integral part of the agricultural structure survey in the years 2010, 2013 and 2016. Unofficial table of contents

§ 8 Survey characteristics and reporting time

(1) The survey characteristics of the land use main survey are the use of land according to the main uses of use and the purpose of use, species of crops, plant groups, plant species and forms of culture, including by breeding method, as well as the intermediate crop cultivation according to the The reference period for the survey characteristics referred to in paragraph 1, with the exception of intermediate crop cultivation, shall be the current calendar year. § 9 Survey units

Collection units of the ornamental plant survey are the holdings in accordance with Article 91 (1), the areas on which flowers or ornamental plants or their respective young plants are grown, at least 0.3 hectares in the open land or at least 0.1 hectare under high walkable protective coverings. § 10 Survey type, periodicity, survey period

The ornamentals survey is generally carried out in 2012, in 2017, and then every four years in the period from July to October. Unofficial table of contents

Section 11 Survey characteristics and reporting time

(1) Characteristics of the ornamentals ' survey are:
1.
in the cultivation of flowers and ornamental plants:
a)
the base area by planting groups in the open country and under high accessible protective coverings,
b)
the heated floor area under high walkable protective covers,
c)
the number of potted plants produced by plant groups, plant species and intended uses,
d)
in the case of cut flowers and ornamental plants, on the other hand, the area under cultivation by plant species in the open land and under high accessible protective coverings,
2.
in the cultivation of young plants: the base area in the open country and under high walkable protective covers.
(2) The reporting date for the survey characteristics referred to in paragraph 1 (1) (a) and (2) shall be the date of the first request for information. The reporting period for the survey characteristics referred to in paragraph 1 (1) (b) to (d) shall be the months of July of the previous year to June of the current year.

Subsection 5
Vegetable survey

Section 11a Survey units

Survey units of the vegetable survey are the holdings according to § 91 (1)
1.
with land of at least 0.5 hectare in the open land or at least 0.1 hectares under high accessible protective covers on which vegetables or strawberries or their respective young plants are grown,
2.
with production areas for food mushrooms of at least 0.1 hectare.

§ 11b Survey type, periodicity, survey period

(1) The vegetable survey shall be carried out:
1.
in the case of holdings according to § 11a (1)
a)
generally every four years, starting in 2012,
b)
each year, with the exception of the years in which the survey referred to in point (a) is carried out, a sample of at most 6 000 holdings, starting in 2013;
by way of derogation, the survey characteristics for the harvest in years with a general survey shall be determined for a maximum of 6 000 holdings;
2.
in the case of holdings in accordance with Section 11a (2), generally annually, beginning with the reference year 2012.
(2) The survey referred to in paragraph 1 (1) shall not be carried out in the Länder of Berlin and Bremen. (3) The survey period for the establishments referred to in Article 11a (1) shall be the months of June to December. In order to obtain a preliminary result for asparagus and strawberries, a preliminary survey will be carried out between June and September. The main survey is carried out in the period from October to December. (4) The survey period for holdings in accordance with Section 11a (2) is the months of January and February of the following year. Unofficial table of contents

§ 11c Survey characteristics and reporting time

(1) The survey characteristics of the vegetable survey are:
1.
in the case of holdings according to § 11a (1)
a)
for the cultivation of vegetables and strawberries:
aa)
the area under cultivation and harvest by plant groups, plant species, forms of crop and species of cover, asparagus and strawberries, in addition to the level of yield;
bb)
in years with a general survey of vegetables, the base area,
b)
for the cultivation of young plants: the ground area in the open country and under high walkable protective covers,
2.
in the case of holdings in accordance with Section 11a (2): the area of production, the area under cultivation and the quantity of crop according to the types of edible mushrooms;
3.
for all plant species: an indication of the ecological mode of operation in the respective reference year.
(2) The reporting period for the survey characteristics referred to in paragraph 1 (1) (a) (aa) shall be the current calendar year. The reporting period for the survey characteristics referred to in paragraph 1 (2) shall be the previous calendar year. The reporting date for the survey characteristics referred to in paragraph 1 (1) (a) (bb) and (b) shall be the date of the first invitation to provide information.

Subsection 6
Tree School Survey

§ 12 Survey units

Survey units of the tree nursery survey (nurseries) are the holdings according to § 91 (1) with nurseries of at least 0.5 hectares; not included are planting gardens in forest farms. Unofficial table of contents

§ 13 Survey type, periodicity, survey period, characteristics

The tree school survey is generally carried out in 2004, 2008, 2012, 2017 and then every four years in the period from July to August. Characteristics relating to the use of the nursery areas are collected. Unofficial table of contents

Section 14 Survey characteristics and reporting date

(1) The survey characteristics of the tree survey are the total area of the nursery and the area of planting and propagation characteristics as well as the stocks of forest plants by number and type. (2) The date of reference shall be the date of the first request. Exchange of information.

Subsection 7
BaumobstanbauSurvey

§ 15 Survey units

Survey units of the construction mobstane survey are the holdings according to § 91 (1), whose construction mob areas are at least 0.5 hectare. Unofficial table of contents

Section 17 Survey characteristics and reporting date

(1) The survey characteristics of the construction mobstane survey are:
1.
the total area of the construction of the mob,
2.
the fruit trees, the planting points and the number of trees, in each case on the basis of the surface area and the intended use of the fruit, as well as for table apples and table pears,
3.
an indication of the ecological economy.
(2) The reporting date is the date of the first invitation to provide information.

Subsection 8
StrauchbeerSurvey

§ 17a Survey units

Survey units of the StrauchbeerenerSurvey are the holdings according to § 91 (1) with shrub berry areas of at least 0.5 hectares in the open land or at least 0.1 hectare under high walkable protective covers. Unofficial table of contents

§ 17b Survey type, periodicity, survey period

The StrauchbeerenerSurvey is carried out annually, starting in 2012, from September to December. In the countries of Berlin and Bremen, the survey is not carried out. Unofficial table of contents

§ 17c Survey characteristics and reporting time

(1) The survey characteristics of the StrauchbeerenerSurvey are
1.
annual
a)
the area under cultivation and harvest by plant species in the open land and under high accessible protective coverings, the forms of culture, the black elder additionally the type of use and, in the case of the sea buckthorn, the level of yield capacity,
b)
an indication of the ecological economy,
2.
in addition, every three years, starting in 2012, the harvest use.
(2) The reporting period for the survey characteristics referred to in paragraph 1 (1) (a) and (2) shall be the current calendar year. The reporting date for the survey characteristics referred to in paragraph 1 (1) (b) shall be the date of the first invitation to provide information.

Section 2
Survey on livestock

§ 18 Survey units

(1) Survey units of the survey on livestock holdings are the holdings referred to in Article 91 (1a) (1) with animal stocks which, for each species, are at least equal to those referred to in (b), (c) or (d). (2) The surveys shall cover the Stocks of bovine animals, swine and sheep which are in direct possession of the holder or head of the holder at the time of the reporting, irrespective of the property or other legal grounds of possession. § 19 Survey type, periodicity, reporting date, characteristics

(1) The survey on livestock shall be carried out each year:
1.
at the reporting date of 3 May, a maximum of 60 000 units of collection, with characteristics relating to the stocks of bovine animals and swine;
2.
at the reporting date of 3 November, with a maximum of 60 000 units, with characteristics relating to the stocks of bovine animals, swine and sheep being collected.
(2) By way of derogation from paragraph 1:
1.
The survey is not carried out in the countries of Berlin, Bremen and Hamburg.
2.
if the characteristics of the stocks of bovine animals are levied in accordance with Article 20a, the survey shall be carried out at the time of the reporting in the case of not more than 20 000 units of collection with pigs and not more than 5 000 units of survey with sheep.

Section 20 Survey characteristics

The survey features of the livestock survey are:
1.
in the case of stocks of bovine animals and sheep: the number, age, sex and purpose of use of the animals,
2.
in the case of stocks of pigs: the number of animals by live weight and use, in the case of breeding pigs, in addition to the sex and, in the case of breeding, the pregnancy.

Section 20a Special provisions for the collection of bovine herds

(1) The survey characteristics for stocks of bovine animals throughout the country shall be considered to be data collected by administrative bodies on the basis of non-statistical laws, regulations or administrative provisions or otherwise incurred in such places (administrative data), or, taking into account the additional survey feature referred to in paragraph 2 (3), they may be identified in sufficient quality using such data, the collection of bovine herds shall be limited to: shall be carried out using such data to the extent that the data provided by the (2) § § 18 to 20 shall apply in this case with the following measures:
1.
Survey units are the holdings of cattle keepers according to § 26 of the Animal Transport Ordinance of 6 July 2007 (BGBl. 1274, 1967), as amended by Article 3 of the Regulation of 25 April 2008 (BGBl I). 764), in the current version.
2.
The survey is generally carried out in all countries at the reporting time of 3 May and 3 November.
3.
In addition to the survey characteristics in accordance with § 20, the survey characteristic is the breed of animals.

Structural surveys in agricultural and forestry holdings

Subsection 1
General provision

Section 24 Individual surveys and periodicity

(1) The structural surveys shall comprise the following individual surveys:
1.
Agricultural structure survey (§ 26),
2.
Agricultural census:
a)
Main survey (§ 29),
b)
Survey on agricultural production methods (§ 32).
(2) The agricultural structure survey is carried out in 2010, 2013 and 2016. (3) The main survey of the agricultural census is carried out together with the agricultural structure survey in the first half of 2010. (4) For spatial presentation Statistical results may be used to allocate the data from the surveys referred to in paragraph 1 to territorial units which are at right angles, usually square, and at least 100 hectares, in relation to a given projection of the map.

Subsection 2
Agricultural Structure Survey

Section 25 Survey units

Farm structure survey units are the holdings according to Article 91 (1a). Unofficial table of contents

Section 26 Survey type and survey programme

(1) The agricultural structure survey is carried out in general in 2010, in the years 2013 and 2016 as a sample of not more than 80 000 units of survey. (2) By way of derogation from paragraph 1, the survey shall be carried out in accordance with the following conditions:
1.
the survey characteristics referred to in Article 27 (1) (1) to (3), (5), (6), (12) and (17) in 2016 in general,
2.
the survey characteristic referred to in Article 27 (1) (16) (d) in 2010 was collected in the sample referred to in paragraph 1;
3.
the survey characteristics referred to in Article 27 (1) (7) were not collected in 2010;
4.
the survey characteristic referred to in Article 27 (1) (12) was not collected in 2013;
5.
the survey characteristics in accordance with § 27 (1) in the Länder of Berlin, Bremen and Hamburg also in the years 2013 and 2016 generally raised.
(3) Survey units which do not meet any of the conditions set out in Article 91 (1a) (1) shall be included in the survey only for the years 2010 and 2016. They shall only collect the information in accordance with Section 27 (1) (1) and (2) and Section 27 (1) (3) on the main uses, including areas with fast-growing tree species. Section 27 Survey characteristics and reporting time

(1) The survey characteristics of the agricultural structure survey are:
1.
the operating seat, indicating the location coordinates,
2.
the legal status of the holder,
3.
the survey characteristics of the ground-use main survey (Article 8 (1)),
4.
Irrigation:
a)
the irrigable area,
b)
the irrigated area,
c)
the irrigation procedures;
d)
the origin of the water used,
5.
on the stocks
a)
of bovine, ovine and caprine animals: the number, the age, the sex and the purpose of use of the animals,
b)
Pigs: the number of animals in accordance with the categories set out in Section III of Annex III to Regulation (EC) No 1166/2008 of the European Parliament and of the Council of 19 November 2008 on farm structure surveys and the survey on Agricultural production methods and repealing Council Regulation (EEC) No 571/88 (OJ L 73, 27.1.1988, p. EU No 14), as amended,
c)
in poultry: the number of animals and holding places in accordance with the nature and the purpose of use,
d)
-the number of animals,
6.
on organic farming: the land used for agricultural purposes, the areas under cultivation, the areas under cultivation by species of crops, crops, plant groups, plant species and the purpose of use, as well as the number of places to be used in organic farming. the type and purpose of use of animal-related animals;

on the socio-economic conditions of the holder: the estimated ratio (largest/small) between the non-operating income and the income from the holding; in the case of married or registered partnerships or in the case of married couples, non-life-like or life-partnership-like community, the indication shall relate jointly to each of the two partners,

Turnover from other gainful activities as agriculture which is directly related to the holding: the nature of the activity and the percentage of turnover of these activities in the total turnover of the holding,
15.
the direct reference to rural development aid in accordance with section VI of Annex III to Regulation (EC) No 1166/2008,
16.
on the ownership and leasing of the utilised agricultural area:
a)
the size of its own self-managed area,
b)
the size of the areas covered by subject groups and the land obtained free of charge for the management of the land,
c)
the lease fees for courtyards and individual plots not covered by family members, relatives or waste, in the case of farms according to the size of the area concerned, and in the case of individual land, in addition to the type of use,
d)
the lease fees agreed over the last two years for individual land not covered by family members, relatives or persons who have been weakened according to the nature of the use and size of the areas concerned,
17.
the form of sales tax,
18.
on soil cultivation and soil conservation:
a)
the soil cultivation methods on the arable land by area,
b)
the land cover in winter according to the type of cover and the surface area,
c)
the size of the farmland without a change of fruit,
19.
the areas used in the environmental interest;
20.
on economic fertilizers:
a)
the quantity applied by type of fertilizer and by crop, in the case of arable land, in addition to the cultivated and uncultivated land;
b)
for liquid economic fertilisers, the quantity of fertiliser applied, in the form of fertilizer and culture species, and in the case of arable land, in addition to the cultivated and unadjusted area;
c)
for unplaced areas, the time span between application and incorporation by application technology and fertilizer,
d)
the quantity of fertilizer consumed by the holding,
e)
the quantity of fertilizer used in the operation, which has been put on the market.
(1a) Additional survey characteristics of the agricultural structure survey in 2016 in the survey units as set out in the second sentence are:
1.
the operating revenue: the origin according to the type of products and services and the share of the total operating revenue,
2.

the survey characteristics referred to in paragraph 1 (16) (c) and (d): the current lease year;
8.
the survey characteristics referred to in paragraph 1 (18) (b): the months October 2015 to February 2016,
9.
the survey characteristic referred to in paragraph 1 (18) (c): a period of 36 months ending on the date of the first invitation to provide information;
10.
the survey characteristics referred to in paragraph 1 (20) and the survey characteristics referred to in paragraph 1a (1), and the survey characteristic of energy consumption by energy source referred to in paragraph 1a (2): the calendar year preceding the survey period.
The reporting date for the survey characteristics referred to in paragraph 1 (5) shall be 1 March of the survey year. 2.
in the case of a survey of not more than 80 000 holdings, together with the main survey of the agricultural census for the other survey characteristics referred to in paragraph 2.
(2) Survey characteristics are:
1.
the soil cultivation methods on the arable land by area,
2.
on soil conservation:
a)
the land cover in winter according to the type and the area,
b)
the size of the farmland without a change of fruit,
3.
the preservation and the creation of landscape elements,
4.
on irrigation in the open country:
a)
the average irrigated area as a whole,
b)
the irrigated area by crop species, plant groups, plant species and use,
c)
the irrigation procedures and the origin of the water used,
d)
the amount of water consumed,
5.
the number of stables by posture and use of the animals for cattle, pigs and chickens;
6.
for grazing: the number of bovine animals, even by use, and the sheep according to the length of the pasture, as well as the size and possessions of the pasture;
7.
the application and application of fertilisers by type of fertilizer, origin, area of application, incorporation and the share of the economic fertilizer delivered or sold,
8.
the storage of economic fertilizers by type of fertilizer, type of warehouse, storage capacity and type of cover.
(3) The reporting period for the survey characteristics referred to in paragraph 2 (1) and (7) shall be the last twelve months before the date of the first request for information. Section 46 Harvest and operational reporting

(1) The harvest and operating reporting is carried out every year, except in the countries of Berlin and Bremen, in the months of April to December. It includes:
1.
in the case of field crops, grassland, construction and vines: estimates of the expected and final natural alert of the current year;
2.
in the case of individual cereals and potatoes, except in the Land of Hamburg: estimates of total quantities of cereals and stocks,
3.
in the case of field crops, except in the Land of Hamburg: estimates of the areas of the previous harvest, the sowing areas and the hibernated areas,
4.
for vines: the elevation of the most's weight and the goodness of the moth,
5.
at Baumobst: estimates of crop use,
6.
an indication of the organic farming methods of the holdings.

Section 68a Survey units

Collection units of aquaculture statistics shall be the holdings which aquaculture within the meaning of Article 2 (1) (b) of Regulation (EC) No 762/2008 of the European Parliament and of the Council of 9 July 2008 on the submission of Statistics on aquaculture by the Member States and repealing Council Regulation (EC) No 788/96 (OJ L 136, 31.3.1996, p. 1), as amended, in the current version. on the quantity of aquaculture production: the weight of the aquatic organisms produced by biological and rearing form, farming methods, geographical area and allocation to saltwater or freshwater and the proportion of ecologically produced the amount of total production,
b)
the number or weight of the annual feed to aquaculture on the basis of catches by biological nature,
c)
the number or weight of produced spawns and young animals produced in brood and rearing plants by biological means,
d)

Section 91 Survey units

(1) Where reference is made to this provision, holdings are agricultural holdings within the meaning of Article 2 (a) of Regulation (EC) No 1166 /2008. (1a) Survey units are, to the extent that nothing else is intended:

a)
five hectares of agricultural land,
b)
ten bovine animals,
c)
50 pigs or ten breeding sows,

20 sheep,
e)
20 goats,
f)
1 000 holding places for poultry,
g)
0.5 hectare of hops area,
h)
0,5 hectares of tobacco,
i)
a hectare of permanent cures in the open country,
j)
each 0.5 hectare of vineyards, nursery or orchard,
k)
0.5 hectare of vegetable or strawberry area in the open country,
l)
0,3 hectare of flowers or ornamental plants in the open country,
m)
0.1 hectare of area under high walkable protective coverings or
n)
0.1 hectare of production area for food mushrooms,
2.
Holdings with at least 10 hectares of forest area or area with fast-growing tree species.
(2) Unless otherwise specified, establishments which satisfy at least one condition referred to in paragraph 1a shall indicate all the characteristics of the surveys in question. (3) Unless otherwise specified, an establishment within the meaning of this Act shall be subject to the following conditions: technical-economic unit with a single management system. Section 92 auxiliary characteristics

§ 93 Information to be provided

(1) For the surveys of agricultural statistics in accordance with § 1, the obligation to provide information is to the extent that nothing else is determined in paragraph 3. Section 94 Implementation of federal statistics

Section 94a Regulation empowerment

the identification number in the statistical register,
10.
the date of inclusion in the operating register;
11.

(8) The authorities responsible under national law for compensation in the event of animal loss pursuant to Article 20 (1), first sentence, of the Animal Health Act shall transmit the statistical offices of the countries for survey units in accordance with Article 91 (1a) (1) (b) to (1) (b) to (f) annually, on request, the information on the auxiliary and survey characteristics referred to in the first sentence of paragraph 2, first and second sentence, and the number of animals referred to in point 11, where they are present. Section 97a Determination of the population

Section 98 Transmission, use and publication of individual information
