Based on Section 27 (3) of the Vocational Training Act, 23. March 2005 (BGBl. 931), the Federal Ministry of Consumer Protection, Food and Agriculture, in agreement with the Federal Ministry of Education and Research, after hearing the main committee of the Federal Institute for Vocational Education and Training: Non-official table of contents
§ 1 Minimum requirements for establishment and economic condition
(1) The training centre must be to take into account the requirements set out in Article 27 (1) of the Vocational Training Act, which, according to the nature and extent of production and services, and according to its management condition, provides the conditions for the Apprentices in the Regulation on Vocational Training for the Speciality of Agricultural Service of 23. July 2009 (BGBl. 2157), in the relevant version, skills, knowledge and skills (professional capacity to act) can be taught. Continuous guidance must be guaranteed.(2) The training centre must be managed as a main agricultural enterprise, as an independent agricultural unit, as an agricultural service undertaking or as an institution of the public sector, and shall, in accordance with the provisions of the principles of business management. The economic results must be recorded in accordance with the accounts.(3) The buildings, construction equipment and technical equipment of the training centre must be in accordance with the requirements to be met in relation to the training objectives and must be in a proper state.(4) Training centres which themselves do not have the necessary set-up and composition of crops and services to carry out the training shall only be able to train if they demonstrate that the Agricultural works and services can be carried out in the scope necessary for training and the necessary diversity of contract partners.(5) It is necessary to ensure that the necessary equipment, in particular the equipment, machinery and technical equipment, is available for training and is in a proper state. The necessary technical and constructional facilities for their maintenance as well as for maintenance and repair work must be provided.(6) An impression of the Regulation on vocational training for the skilled agricultural service as well as of the examination regulations and the training plan must be interpreted in the training place at a suitable location for inspection or handed out to the trainee. The apprentices are to be provided with professional literature that is conducive to the training of companies. To the extent that collective agreements are applicable to the training establishment, they must be interpreted in the training centre for the purpose of inspection.(7) The training centre must ensure that the provisions of the Youth Employment Protection Act, the Accident Prevention Regulations, the Labour Regulations and other provisions concerning the protection of trainees are complied with. . It must have appropriate social spaces and sanitary facilities. In the case of the application in accordance with Article 27 (3) of the Vocational Training Act, a certificate of safety must be issued by the competent professional association on compliance with the accident prevention regulations, which are not older than one year. If apprentices are admitted to the domestic community, accommodation must be provided, which is available in time and equipped with the same equipment.(8) A training centre shall be unsuitable if an insolvency or settlement procedure has been opened on the property of the holder or the proprietor. § 2 Exceptions
A training facility where the required professional skills, knowledge and Skills which cannot be fully imparted shall be deemed to be appropriate if it is ensured that they are carried out by training outside the training centre in another recognised training centre or in the form of a higher level of training. § 3 Entry into force
This regulation occurs on the 1. August 2005, in force.
