§ 1 Purpose and scope

This law serves
1.
the implementation of Regulation (EU) No 1306/2013 of the European Parliament and of the Council of 17. Regulation (EEC) No 352/78, (EC) No 165/94, (EC) No 2799/98, (EC) No 814/2000, (EC) No 1290/2005 and (EC) No 485/2008 of the European Parliament and of the Council of 19 December 2013 on the financing, management and control system of the common agricultural policy Council (OJ L 327, 549) as amended and the acts adopted by the European Union for its implementation, to the extent that it provides for the publication of information on
a)
the recipients of payments from the European Agricultural Guarantee Fund (EAGF) or the European Agricultural Fund for Rural Development (EAFRD) (EAFRD),
b)
the amounts that each recipient has received, and
c)
Type and description of the respectively financed measure,

the implementation of Regulation (EU) No 508/2014 of the European Parliament and of the Council of 15 June 2014. May 2014 on the European Maritime and Fisheries Fund and repealing Regulations (EC) No 2328/2003, (EC) No 861/2006, (EC) No 1198/2006 and (EC) No 791/2007 of the European Parliament and of Regulation (EU) No 1255/2011 of the European Parliament and Council Regulation (EC) No 1), as amended and the acts adopted by the European Union for its implementation, to the extent that it involves tasks of the managing authority in connection with the provision of information within the meaning of Article 119 in the context of Article 119 of the Treaty. § 2 Publication

(1) The Payment of funds from the European Agricultural Guarantee Fund, the European Agricultural Fund for Rural Development, and, to the extent that these funds are paid by the countries concerned, the For the competent authorities of the countries concerned, and in the case of the European Fisheries Fund, the competent administrative authority shall publish the information after

Article 111 Paragraph 1, in conjunction with Article 112 of Regulation (EU) No 1306/2013, in conjunction with Articles 57 to 62 of Commission Implementing Regulation (EU) No 908/2014 of 6 June 2014. With detailed rules for the implementation of Regulation (EU) No 1306/2013 of the European Parliament and of the Council as regards the paying agencies and other bodies, the financial management, the clearance of accounts and the provisions for Checks, safeguards and transparency (OJ C 327, 28.4.2002, 59) and
2.
Article 119, in conjunction with Annex V to Regulation (EU) No 508/2014
, in the applicable versions, by way of Direct entry on a common Internet site operated by the Federal Agency for Agriculture and Food (Bundesanstalt) in accordance with the second subparagraph of Article 111 (1) of Regulation (EU) No 1306/2013, in conjunction with Article 59 of the Implementing Regulation (EU) No 908/2014 and, in the case of the European Maritime and Fisheries Fund, in accordance with Article 119 in conjunction with Annex V to Regulation (EU) No 508/2014. The first sentence shall apply in the case of a municipality or a municipal association only if the congregation or the municipal association has been assigned the tasks under this law by national law.(2) Each published body shall bear the responsibility for data protection in respect of the information it publishes, in particular for the legality of its collection, the admissibility of the publication and the accuracy of the information. Affected parties may assert their data protection rights in any of the publishers from which they have received payments. This body shall forward the request for clarification of the responsibilities to the competent body.(3) In consultation with the Federal Office for Information Security (Bundesamt für Sicherheit in der Informationstechnik, Bundesanstalt für Sicherheit in der Informationstechnik, Bundesanstalt für Sicherheit in der Informationstechnik, Bundesanstalt für Sicherheit in der Informationstechnik), the Bundesanstalt creates a security concept for the website, which in particular is required by the Federal shall include technical and organisational measures. § 2a Data usage

(1) Any person who has the data referred to in § 2 paragraph 1 from the website of the Federal Institute for Agriculture and food, the data may be used only for the purpose of providing the public with information on the beneficiaries of payments from the European agricultural and fisheries funds in accordance with the first sentence of paragraph 2.(2) The data referred to in paragraph 1 shall not be allowed to

longer than two years after the date of its first publication on the Internet site for the purpose referred to in paragraph 1 , as far as data on payments from the Agricultural Funds are concerned,
2.
used or disclosed for purposes of advertising or address trading ,
3.
will be used for a recipient of payments subject to the publication of the publication.
The data referred to in paragraph 1 shall be deleted by the users referred to in paragraph 1 not later than two years after the date of their first publication on the website of the Bundesanstalt für Landwirtschaft und Ernährung (Federal Agency for Agriculture and Food). § 3 Regulation authorisations

(1) The Federal Ministry of Food and Agriculture meets in agreement with the Federal Ministry of Finance, with the consent of the Bundesrat, with the consent of the Federal Council, detailed provisions on the procedure or technical and organisational measures for the publication of information on the Internet, in particular over
1.
the content and structure of the website,
2.
the input, rectification, blocking and deletion of information,
3.
the view into the web page,
4.
to publish information on beneficiaries of aid payments below the threshold value determined in accordance with Article 112 of Regulation (EU) No 1306/2013,
5.
Data protection and data security, ensuring that the publications remain intact, complete and up-to-date, and can be assigned at any time to their origin.
(2) By way of derogation from paragraph 1, it may be up to 31. The legal regulation referred to in paragraph 1 shall be adopted without the consent of the Federal Council. The legal regulation shall not enter into force no later than six months after its entry into force. Your period of validity can only be extended with the approval of the Federal Council. § 3a BußMoney Provisions

(1) Contrary to the law, who intentionally or negligently

contrary to § 2a paragraph 1 data, or
2.
contrary to § 2a, paragraph 2, sentence 2, not complete or not erased in time.
(2) The administrative offence can be punished with a fine of up to three hundred thousand euros.(3) The Federal Agency for Agriculture and Food is the managing authority within the meaning of Section 36 (1) (1) of the Law on Administrative Offences. Non-official table of contents

§ 4 Announcement of legal regulations

This law will enter into force on the day after the announcement.
