On the basis of § 5 (1), § 7 (2) and § § 79 and 80 of the Federal Act on Performance in the Federal Law Gazans Part III, section 54-1 of the Federal Act, the Federal Government decrees: Unofficial table of contents

§ 1 General requirements authorities

Pursuant to § 5 (1) and (79) sentence 1 of the Federal Power Act, the authorities of the general administration are at the county level, unless otherwise specified in § 2. Unofficial table of contents

§ 2 Special requirements authorities

(1) Request authorities shall be responsible for the use of
1.
Seagoing vessels-with the exception of sea-fishing vessels-and accessories
the directorates of water and shipping;
2.
Sea fishing vessels and accessories
the State Fisheries Offices;
as far as vehicles of the Great High-Sea Fisheries are concerned,
the highest national authorities responsible for fisheries;
3.
Inland waterway vessels for which technical approval is required for transport on federal waterways, including accessories, except for ships used exclusively in port operations,
the directorates of water and shipping;
4.
Aircraft and accessories
with a maximum mass of up to 5,7 tonnes
the highest national authorities responsible for aviation, in Baden-Württemberg, Bavaria, Hesse, Lower Saxony and Rhineland-Pfalzdie higher transport authorities responsible for aviation;
With a maximum mass of 5,7 tonnes
the Federal Ministry of Transport, Building and Urban Development;
5.
Motor vehicles and their trailers and accessories
the lower transport authorities of the countries;
6.
Trams and overhead buses and accessories
the higher or, where they do not exist, the highest transport authorities of the countries;
7.
Private railway wagons and accessories for public transport
the Federal Railway Agency;
8.
Housing
the municipal authorities.
In the case of ships and aircraft abroad, the diplomatic and consular representations of the Federal Republic of Germany are also responsible for the requirements of the requirements authorities. The requirement under international law of the consent of the Government of the host country for the exercise of this power remains unaffected. (2) For requirements pursuant to Section 2 (1) No. 7 of the Federal Act of Performance, the competent authority shall be responsible for:
1.
Facilities of road construction
the higher or, where these do not exist, the highest road construction authorities of the countries, in North Rhine-Westphalia the landscape associations;
2.
Installations in federal waterways, with the exception of the parts of the Elbe River waterway, which are managed by the State of Hamburg,
the directorates of water and shipping;
3.
other waterworks
the higher or, where they do not exist, the top water authorities of the countries;
4.
National ports
the directorates of water and shipping;
5.
other ports
the port authorities of the countries, in Baden-Württemberg, Hesse and Lower Saxony, the port authorities, Bavaria and North Rhine-Westphalia, the authorities of the general administration at the district level, the Rheinland-Pfalzdie higher transport authorities;
6.
Airports
the top national authorities responsible for aeronautics;
7.
Aerodros (other than No 6)
the top national authorities responsible for aviation, in Baden-Württemberg, Bavaria, Lower Saxony and Rhineland-Pfalzdie, the higher transport authorities responsible for aviation.
To the extent that the requirements relate to installations intended for military purposes, points 2, 4 and 5 shall be the responsibility of the higher administrative authorities. (3) The competent authorities referred to in paragraph 1 shall be responsible for the competent authority of the competent authorities. (4) The authority of the authorities referred to in paragraph 2 also extends to the public authorities referred to in paragraph 2 of this Article. § 3 Local competence

(1) Local authority is the requirement authority in whose district the subject-matter of the requirement or the subject-matter to which the benefit relates is located or in whose district the performance is to be performed. If the service can be provided in the commercial establishment of a person liable to the service, the requirement authority in whose district the branch is located shall also be responsible. (2) The requirement for motor vehicles and their Trailers which are authorised within the scope of this Regulation shall be the competent authority of the competent authority in whose district the register is to be registered by the vehicle. § 4 Local competence in ships

(1) Where the requirement concerns ships, the competent authority shall be the competent authority in whose district the home port or place of origin of the vessel is located. If a ship does not have a home port or place of hometown within the scope of this Regulation, the competent authority shall be the competent authority in whose district the ship is located. (2) The district of a water and shipping directorate within the meaning of this Regulation shall comprise the federal waterways of its administrative area and the waters associated with it. § 5 Replacement

As long as request authorities are not in a position to exercise their powers on actual grounds, they may be exercised by the superordinate authorities of the same administrative branch. The powers of the request authorities may be exercised by the immediately downstream authorities of the same administrative branch, subject to the conditions set out in the first sentence, where this is necessary to avert an imminent danger; and the parent authorities cannot act in good time. § 6 Demand-holders

Requirements in accordance with Section 7 (2) of the Federal Performance Act
1.
the Federal Government, including the requirements of the allied armed forces and the international military headquarters in the scope of the Federal Power Act,
2.
the countries,
3.
municipalities and municipal associations,
4.
the institutions of social assistance,
5.
the special purpose associations which serve the public supply of electricity, gas, water or sewage disposal or hospitals.

§ 7 Demand needs for maneuvers or other exercises

Requirements for maneuvers or other exercises of troops or associations and units of civil protection (§ 66 para. 1, § 80 of the German Federal Act of Performance) are
1.
the Federal Government, including the manoeuvres (exercises) of the allied armed forces,
2.
the countries,
3.
the municipalities and municipal associations.

§ 8 Competence in city states

(1) In the Land of Bremen, competent requirements authorities are
1.
in the municipality of Bremen
the Senate;
2.
in the municipality of Bremerhaven
the magistrate.
(2) In the Land of Hamburg are responsible
1.
in the cases of § § 1 and 2 para. 1 no. 8
the district offices;
2.
for ships which do not fulfil the conditions laid down in Article 2 (1) (3),
the competent authority responsible for the safety of transport;
3.
for installations on federal waterways, to the extent that they are managed by the Land of Hamburg,
the competent authority responsible for the execution of water installations in the waters of the I. order;
4.
in the cases of § 2
Paragraph 1, point 2
those for fisheries,
(1) (4) and (2), first sentence, no. 6 and 7
who are in the aviation sector,
Paragraph 1 (5) and (6)
which are in favour of transport safety,
Paragraph 2, first sentence, No. 1
for road construction,
Paragraph 2, first sentence, No. 3 and (2), second sentence, in conjunction with the first sentence of paragraph 2
which, in the case of the waters of I., order for the construction of hydraulic systems,
Paragraph 2, first sentence, point 5 and paragraph 2, second sentence, in conjunction with the first sentence of paragraph 4 and 5
which are responsible for the port supervision

Section 9 Entry into force

(1) This Regulation shall enter into force on the first day of the calendar month following the termination of the announcement. (2) Unofficial table of contents
