§ 1 Permitted tee-off payment agreements
In contracts of works which have as their object the establishment or conversion of a house or a comparable structure on a property and at the same time contain the obligation of the entreprenchman to give the purchaser ownership of the property. in accordance with § 3 (2) of the Makler-und BauCarrier Ordinance, the orderer may be obliged to perform the payment of a surcharge in accordance with § 3 (2) of the Makler-und BauCarrier Ordinance under the conditions set out in § 3 (1). Under the conditions laid down in § 7 of the Makler-und BauCarrier-Ordinance, the purchaser may also be obliged to pay the payment of the surcharge by way of derogation from the provisions of § 3 (1) and (2). Section 632a (3) of the Civil Code shall apply.

§ 2 Concerned Contracts
This Regulation shall also apply to contracts concluded between 1 May 2000 and 29 May 2001. This shall not apply in so far as a final judgment has been handed down between the Contracting Parties or a settlement has been concluded which has become binding.

§ 2a Transitional regulation
In its version of 1 January 2009, the Regulation shall apply only to debt which has been incurred since that date.

§ 3 Entry into force
This Regulation shall enter into force on the day after the date of delivery.
