On the basis of § 7 (1) and (2) in conjunction with paragraph 4 of the Employees ' Posting Act of 20 April 2009 (BGBl. 799), the Federal Ministry of Labour and Social Affairs decrees, after the employers, employees and employees falling within the scope of the Regulation, the parties to the collective agreement in accordance with the first sentence of Article 1 of this Regulation, and the parties to collective agreements in the sector, with at least some of the same technical scope of application, have given the opportunity to comment in writing: Unofficial table of contents

§ 1 Cwining working conditions

The legal provisions of the collective agreement laid down in Appendix 1 to this Regulation for the regulation of minimum wages in construction in the territory of the Federal Republic of Germany (TV minimum wage) of 3 May 2013, concluded between the Central Association of the Deutsche Baugewerbes e.V., Kronenstraße 55-58, 10117 Berlin, and the Hauptverband der Deutschen Bauindustrie e.V., Kurfürstenstraße 129, 10785 Berlin, on the one hand, as well as the Industriegewerkschaft Bauen-Agrar-Umwelt, Olof-Palme-Straße 19, 60439 Frankfurt, Germany on the Main, on the other hand, find all employers who are not tied to him, and Employees and workers who fall within the scope of their application, valid on 1 January 2014, if the holding or the self-employed business department is predominantly in construction services within the meaning of Section 101 (2) of the Third Book Social Code. The legal provisions of the collective agreement also apply to employment relationships between an employer established abroad and its employees and employees who are employed within the scope of the regulation. Where a temporary agency worker or a temporary agency worker is employed by a borrower with activities falling within the scope of this Regulation, the distributor shall, in accordance with Article 8 (3) of the Workers ' Posting Act, at least: to provide the working conditions prescribed by this Regulation. § 2 Application exceptions

(1) This Regulation shall not extend to establishments and to independent operating departments located in the territory of the country which are subject to one of the technical fields of application of the mantle or framework agreements in force on 1 January 2003, printed in Annex 2. the wood and plastics processing industry, the sawing industry and other woodworking, the stone and earth industry, the mortar industry, the transport concrete industry, the chemical or plastics processing industry or the metal and steel industry, Electrical industry. Paragraph 1 shall apply only in conjunction with paragraph 2. (2) The provisions of paragraph 1 shall apply to establishments and to independent operating departments located in the territory of the country.

a)

as long as it is directly or indirectly a member of the main association of the wood and plastics processing industry and related industries e.V., the Association of German Sawmill Associations, the Social Policy Working Group Stones and Erden e.V., the Federation of the German Mörtelindustrie e.V., the Federation of the German Transport Concrete Industry e.V., the Bundesemployers ' Association for Chemistry e.V., the associations of the plastics processing industry, or one in the Annex 3, the Confederation of Employers ' Association of the Employers ' associations of the metal and electrical industry e.V. (total metal) or one of its member associations. If the membership has been acquired by 1 July 1999 (effective date), it shall be presumed to be irrefutable that the conditions set out in paragraph 1 are met;

b)

if it

aa)

have been found to have been established as the establishment of a holding pursuant to paragraph 1 (regular operation), which had already been a member of one of the associations referred to in point (a) before the date on which the operation was carried out,

bb)

carry out mainly those activities which fall within the technical scope of the collective agreements referred to in paragraph 1; and

cc)

the membership of one of the associations referred to in point (a) has been acquired.

If these holdings are demonstrably active for three quarters of their working hours for the regular operation, it is presumed that they are covered by one of the technical scope of the collective agreements referred to in paragraph 1;

c)

if they are not themselves a member of one of the associations referred to in point (a),

aa)

have been found to have been established as a branch of a parent company, which was already directly or indirectly a member of one of the associations referred to in point (a) before the date of the reference date,

bb)

fall within the scope of the collective agreements referred to in paragraph 1, and

cc)

at least three quarters of the working time for their regular operations.

The exception referred to in paragraph 1 shall apply to establishments and independent operating departments located in the territory of the country which have already been carrying out prefabricated works for one year, if they are directly or indirectly a member of one of the following: (4) This Regulation does not cover establishments and independent operating departments with registered offices in Germany,

1.

one of the framework contracts for industrial workers in the painting and varnishing trades in the Federal Republic of Germany, respectively in the Saarland or their declaration of general liability, and are predominantly engaged in activities which are subject to the technical scope of the framework contract for the industrial workers in the painting and varnishing craft in the Federal Republic of Germany Germany, as amended on 6 April 2005, the framework contract for the industrial workers of the painters and varnishing craft in the Saarland, as amended on 6 December 2005 (Appendix 4);

2.

the whole or in part construction works, structural parts or individual elements of masonry, concrete, reinforced concrete, iron, steel or other construction materials, abort, dismantle, blow, concrete, cut, cut, drill, press, as far as it is directly or indirectly a member of the German Abrupting Association e.V., in the Fachverband Betonbohren und -sägen Deutschland e.V. or in the Abbruchverband Nord e.V.;

3.

who are directly or indirectly members of the Bundesverband Garten-, Landschafts-und Sportplatzbau e.V. (Bundesverband Garten-, Landschafts-und Sportplatzbau e.V.), are covered by the Federal Framework Agreement for Industrial Workers in the Garden, Landscape and Sports Placemable Construction of 20 December 1995, and mainly perform the following activities:

a)

Manufacture and maintenance of outdoor facilities in the areas of private and public housing (house gardens, settlement green, rooftop and terrace gardens and similar), public buildings (schools, hospitals, administrative buildings, barracks) and similar), of municipal green spaces (urban open spaces, green spaces, parks, cemeteries and similar) and of transport accompanying greens (roads, railways, waterways, airfields and similar) as well as of building foundations in the outer and inner areas,

b)

Manufacture and maintenance of sports and playgrounds, outdoor facilities in swimming pools, leisure facilities and the like, of landscape gardening structures in the landscape with living and non-living building materials, as well as of Vegetation-related construction measures for landscape conservation and environmental protection, as well as agricultural, land-extraction and recultivation works,

if at least 20 per cent of the total working time of the company is executed annually in the company or in the self-employed operating department;

4.

who, as contractors in agriculture and forestry, mainly drainate agricultural land, provided that they are provided by the Federal Framework Agreement on the employment of employees of the agricultural and forestry wage companies in the Federal Republic of Germany of 10 January 2003;

5.

who are directly or indirectly members of the Bundesverband Metall-Vereinigung Deutscher Metallhandwerke, the Zentralverband Sanitär-Heating-Klima (Central Association of Sanitarian-Heating-Climate) or the Central Association of German Electrical and Information Technology (Zentralverband der Deutschen Elektro-und Informationstechnisches Handwerke), from a the contractual or framework agreements of these associations or their member associations are covered and are predominantly engaged in activities carried out in the professional scope of a contract of mantle or framework of these associations in force on 1 January 2003, or of their Member Associations (Appendix 4), if the Collective agreement, of which the holding is recorded, is more specific in relation to the framework and social insurance contracts of the construction industry.

(5) This Regulation does not cover undertakings and independent operating departments of employers established abroad if they predominantly carry out activities which are listed in the preceding paragraphs or subject-specific fields of application; in so far as these activities are subject to a subdivision of the relevant technical scope. § 3 Entry into force, external force

Professional scopes

The technical fields of validity of collective agreements, which shall apply in accordance with section 2 (4) (1), (5) and (6), shall be printed below. The holdings referred to in this Annex shall also be self-employed. Painter and varnishing craft

1.

All holdings of the painters and varnishing trades. These are enterprises and independent operating departments, the painters, varnishes, tenderers, white binders, signs for painting, vehicles and metal varnishes, scaffold construction, entrostments and iron paint, thermal insulation composite systems, concrete protection, Perform surface finish, asbestos coating, roadway marking and floor coating and lining work. With concrete protection and surface restoration work are not meant work to eliminate statically significant concrete damage; with asbestos coatings are not meant works that take place in connection with other asbestos remediation work. The floor coating and lining works do not include laying floor coverings in combination with other structural services as well as screed, tile, plate, mosaic set and laying and terrazzo work.

If, in establishments referred to in paragraph 1, other works are carried out in separate departments, these departments shall not be covered by this collective agreement if a specific collective agreement covers them within its scope.

4.

Companies in the construction industry are not covered. This shall not apply to establishments and/or self-employed operating departments which carry out work within the meaning of paragraphs 5 to 7 and which are covered by this collective agreement under the conditions laid down therein.
