The Regulation was referred to as Article 1 (d). § 1 Scope

(1) This Regulation shall apply to the provision of new, simple pressure vessels on the market. (2) Simple pressure vessels within the meaning of this Regulation shall be welded containers produced as standard,
1.
which are exposed to an internal overpressure of more than 0.5 bar,
2.
which are intended for the intake of air or nitrogen,
3.
that are not exposed to any flames,
4.
whose pressure-bearing parts and connections are made either from unalloyed quality steel or from unalloyed aluminium or from non-alloyed aluminium alloys,
5.
that either
a)
by a cylindrical portion of round cross-section closed by outwardly curved or flat bottoms, the axis of rotation of these bottoms corresponding to that of the cylindrical part, or
b)
by two arched bottoms with the same rotation axis
shall be formed,
6.
the maximum operating pressure of which shall not exceed 30 bar, and where the product of this pressure and the capacity of the container (pressure-content product PS x V) is not more than 10 000 bar x l,
7.
whose lowest operating temperature is not lower than -50 degrees C and
8.
The maximum operating temperature of containers made of steel is not above 300 ° C and in the case of containers of aluminium or aluminium alloys it is not above 100 ° C.
(3) This Regulation shall not apply to:
1.
containers manufactured exclusively for use in nuclear technology and in which damage may result from the release of radioactive substances;
2.
containers intended solely for the purpose of equipping or driving watercraft or aircraft;
3.
Fire extinguishers.

§ 2 Security requirements

(1) Simple pressure vessels, the pressure-content product of which is PS x V more than 50 bar x l, may only be made available on the market if it is listed in Annex I to Directive 2009 /105/EC of the European Parliament and of the Council of 16 September 2009 via simple pressure vessels (OJ L 327, 12), the safety of users or third parties, as well as domestic animals and goods, does not comply with the essential safety requirements specified and, if properly installed and maintained, and in the case of a proper operation, do not comply with the requirements of the (2) Simple pressure vessels whose pressure-content product, PS x V, is not more than 50 bar x l, may be made available only on the market if they meet the requirements of a Member State of the European Communities or any other Contracting State of the Agreement on the European Economic Area in accordance with generally accepted rules of technology. § 3 Conditions for the provision on the market

(1) A container referred to in Article 2 (1) may only be made available on the market if it is provided with the information referred to in point 1 of Annex II to Directive 2009 /105/EC and the CE marking in accordance with Article 4 (1) and (2) sentence 1, by which the Manufacturer, or his authorized representative established in the Community or in another State Party to the Agreement on the European Economic Area, certifies that the requirements set out in paragraphs 3 and 4 are met and that he has fulfilled his obligations under paragraphs 3 and 4. in relation to the notified body. (2) The simple pressure vessel is located in the lower part of the container. The CE marking also confirms that the simple pressure vessel is also in conformity with the provisions of the other relevant legislation. However, if, in accordance with one or more of these laws, the manufacturer is free to choose the applicable rules during a transitional period, the CE marking shall, in this case, only confirm that the simple pressure vessel shall comply with the requirements laid down by the Manufacturer's legislation is in accordance with the first sentence. In such cases, all numbers of the Community directives on which it applies, as published in the Official Journal of the European Communities, must be listed in the operating instructions provided for in Article 5 of this Regulation. (3) The simple pressure vessel shall conform to the design for which an approved body has certified, after carrying out an EC type-examination in accordance with Article 10 of this Directive, that the type of container is designed to comply with the provisions of this Directive. Policy. The Federal Ministry of Labour and Social Affairs of the Federal Republic of Germany, the Federal Ministry of Labour and Social Affairs, may, in accordance with the harmonized European standards, be replaced by the procedure set out in the first sentence of the first sentence. (4) The simple pressure vessel shall be subject to an EC-examination in accordance with the provisions of Annex II to this Directive. (4) The simple pressure vessel shall be subject to an EC verification, in accordance with Article 11 of Directive 2009 /105/EC, if its pressure-content product is PS x V more than 3 000 bar x l. Where the pressure content product PS x V is not more than 3 000 bar x l, the EC declaration of conformity in accordance with the provisions of Article 12 of Directive 2009 /105/EC may be carried out instead of the EC verification in accordance with the first sentence. (5) A referred to in Article 2 (2) of Directive 2009 /105/EC Container may only be made available on the market if, in accordance with Article 4 (1), it is provided with the information listed in point 1 of Annex II to Directive 2009 /105/EC and does not bear the CE marking. § 4 CE marking

(1) The information referred to in Annex II (1) of Directive 2009 /105/EC and, in the case of § 3 (1), also the CE marking must be visible, legible and permanently affixed to the container or to a label which is not from the container. (2) The CE marking shall consist of the letters "CE" in accordance with Annex II to Directive 2009 /105/EC. The CE marking indicates the identification number of the notified body referred to in Article 9 (1) of Directive 2009 /105/EC of the notified body responsible for the EC verification or surveillance. (3) No markings may be affixed to the container , which could mislead third parties with regard to the meaning and typeface of the CE marking. Any other marking may be affixed to the container or to the label if it does not adversely affect the visibility and legibility of the CE marking. (4) The market surveillance authorities shall assume that the containers which have been identified shall be: The CE marking shall comply with the requirements of this Regulation. § 5 Operating Instructions

A container referred to in Article 2 (1) may only be made available on the market if it is accompanied by an instruction manual drawn up by the manufacturer in accordance with point 2 of Annex II to Directive 2009 /105/EC in the German language. Unofficial table of contents
