§ 1 Equipment in need of approval

(1) The establishment and operation of the installations listed in Annex 1 shall be subject to authorisation in so far as the circumstances are likely to be expected to operate in the same place for a period longer than during the twelve months following which the plant is put into service. For the installations referred to in point 8 of Annex 1, with the exception of installations for treatment at the place of origin, the first sentence shall also apply to the extent that they are to be operated in the same place less than during the twelve months following the entry into service. For the installations referred to in points 2.10.2, 7.4, 7.5, 7.25, 7.28, 9.1, 9.3 and 9.11 of Annex 1, the first sentence shall apply only in so far as they are used for commercial purposes or are used in the context of economic undertakings. Where the requirements for approval of the installations listed in Annex 1 depend on the achievement or exceeding of a specified performance limit or plant size, it shall be based on the legal and actual possible operating range of the installations covered by the same (2) The approval requirement shall extend to all of the designated operators.

Plant parts and process steps necessary for operation, and
2.
Subsidiary facilities which are related to the parts and process steps referred to in point 1 in a spatial and operational context and which may be of importance for:
a)
the emergence of harmful environmental impacts,
b)
the provision of protection against adverse environmental effects, or
c)
the emergence of other hazards, significant disadvantages or significant nuisances.
(3) The conditions set out in Annex 1 shall also be met if a number of installations of the same type are closely related to the spatial and operational context (joint installation) and together the relevant performance limits or plant sizes can be reached or exceeded. A close spatial and operational relationship shall be provided when the installations are

be on the same premises,
2.
are connected to common operating facilities, and
3.
for a comparable technical purpose.
(4) If part of a plant belongs to parts or subsidiary facilities which would have to be approved separately, only a permit is required. § 2 assignment to the types of procedure

(1) The authorisation procedure shall be carried out in accordance with

§ 10 of the Federal Immission Protection Act for
a)
Installations marked in column c of Annex 1 to the letter G,
b)
Installations composed of installations marked in column c of Annex 1 with the letter G and the letter V,
c)
Installations marked with the letter V in column c of Annex 1 and for which an environmental impact assessment is to be carried out in accordance with sections 3a to 3f of the Environmental Impact Assessment Act,
2.
§ 19 of the Federal Immission Protection Act in the simplified procedure for installations marked in column c of Annex 1 with the letter V.
To the extent that the assignment to the approval procedures depends on the performance limit or plant size, § 1 paragraph 1 sentence 4 shall apply.
