§ 1 Delimitation of the damage in the use of property and property

§ 3 Displacement of self-employment

(1) A displacement of self-employment is provided if the pursuit of this activity has been rendered impossible by the pursuit of this activity by means of national-socialist measures of violence. § 4 Restrictions in the exercise of self-employment

(1) Restrictions in the exercise of self-employment shall be any hindranial to this activity by means of national-socialist violence. § 3 (1) sentence 2 shall apply. § 5 Multiple self-employed activities

§ 6 Other-wide procurement of funds

§ 7 Actual requirements for the loan

The person who has been persecuted shall be entitled to a loan if it is probable that he will enable him to successfully resume or fully develop the former or to take up equivalent self-employment in the same way. § 8 Amount of the loan

§ 9 Impossibility of securing

If it is not possible to secure the loan, it can also be provided without securing the loan if, according to the personal and professional aptitude of the persecuted person and his employment prospects, the repayment of the loan does not appear to be substantially at risk. Section 11 Loans for the surviving spouse and the children

(1) The spouse within the meaning of Section 73 (1) of the BEG shall be treated as equal

persons whose connection with the persecuted person has been granted the legal effects of a legal marriage pursuant to the Federal Law on the Recognition of free marriage of racial and political persecutors or on the basis of legislation of the Länder;
2.
the woman whose marriage was subsequently concluded with the persecuted person by an order on the basis of the Federal Act concerning the legal effects of the expulsion of a subsequent marriage.
(2) Children within the meaning of Section 73 (1) of the BEG are the children of marriage and the children treated in accordance with the rules of civil law. (3) A number of persons entitled to resume the former gainful activity of the persecuted person (4) A loan under Section 73 of the BEG shall not be granted if the beneficiary is entitled to receive a loan in accordance with § § 69, 72 and 90 BEG. § 12 Time limitation of the capital compensation

(1) A resumption of the former or equivalent activity in full pursuant to Article 75 (1) sentence 1 of the BEG shall be deemed to have been given if the persecuted person has resumed gainful employment in the territory of the State in which he/she has been in the territory of the State in which he/she is has been in employment before the injury in his/her professional career, and has sustained at least income at the same level as before the beginning of the injury in the professional career. Section 13 Calculation of capital compensation

Section 14 Classification into a comparable civil servant group

(1) The economic position of the person being persecuted shall be determined on the basis of his average income in the last three years prior to the beginning of the persecution. § 17 Consideration of the other labour income in accordance with § 77 BEG

The compensation of capital pursuant to section 76 (1), (3) and (4) of the BEG shall be reduced only in so far as the amount calculated in accordance with Article 76 (1) BEG, together with the income obtained by other utilization of the labour force, shall be subject to the achievable remuneration of a comparable federal civil servants (§ 15). In so doing, the income achieved since 1 July 1948 and the compensation of capital for the entire period of compensation must be compared with the remuneration of a comparable federal official who can be reached during that period. Section 21 Conditions for the right of pension entitlement

(1) A condition for the right to vote in accordance with § 82 of the BEG is that the person persecuted at the time of the decision does not pursue his or her former or equivalent activity to the full or gainful employment which is sufficient for him or her to be employed. It provides a basis for life and does not allow it to be granted access to such an activity. § 12 shall apply. (2) The current benefits, including benefits from the statutory pension insurance, which the persecuted person is subject to, shall be considered as a supply from an earlier activity within the meaning of Section 82 (3) of the BEG. Section 22 Calculation of pension

Section 22b Payment of the pension

§ 26 Display obligation

(1) The person entitled shall be obliged to notify the competent compensation authority without delay of the facts which lead to an end of the pension payment or to a reduction of the pension pursuant to Sections 85, 85a and 86 of the BEG. Section 27 Change of circumstances

The amounts of pensions up to 1 300 Deutsche Mark, resulting from the first sentence, shall be increased by a further 4% on 1 January 1985. Pension amounts from 1 301 Deutsche Mark monthly will be increased by 3.6% from 1 January 1985, but at least by one the monthly amount of 52 Deutsche Mark is increased, the maximum amount of 2 317 Deutsche Mark may not be exceeded. The amounts of the pensions in force since 1 January 1985 shall be increased by a further 3% from 1 January 1986, the maximum amount of which shall not exceed 2 390 Deutsche Mark. The amounts of the pensions in force since 1 January 1986 shall be increased by 3.3% from 1 January 1987, the maximum amount of which shall not exceed 2 471 Deutsche Mark. The amounts of the pensions in force since 1 January 1987 shall be increased by 2.3% from 1 March 1988, by a further 1.4% from 1 January 1989 and by a further 4.2% from 1 January 1990, the maximum amount in force in each case being not exceeded in accordance with Section 33a may. The pension amounts in force since 1 January 1990 will be increased by a further 5.8% from 1 March 1991, with the maximum amount of 2 780 Deutsche Mark not being exceeded. The amounts of the pensions in force since 1 March 1991 shall be increased by a further 7.5% from 1 May 1992, the maximum amount of 2 913 Deutsche Mark being not allowed to be exceeded. The pension amounts in force since 1 May 1992 shall be increased by a further 1,5% from 1 May 1993, the maximum amount of 3 019 Deutsche Mark being not allowed to be exceeded. The pension amounts up to and including DM 1 650, which have been in force since 1 May 1993, will be 1. The maximum amount of DM 3 080 may not be exceeded by a further 2% from 1 January 1995 onwards, from 1 651 DM upwards from 1 January 1995. The current pension amounts will be increased by a further 3.2% from 1 April 1995, with the maximum amount of 3 178 Deutsche Mark not being allowed to exceed. The amounts of the pensions in force since 1 April 1995 shall be increased by a further 1.9% from 1 March 1997, the maximum amount of which shall not exceed 3 230 Deutsche Mark. § 35b Pension for the surviving spouse in the case of § § 98, 86 (4) and 6 (BEG)

In the cases of § § 12, 17, 21, 29, 32 and 37 (3), the official foreign currency exchange rate shall be used in the evaluation of the income obtained abroad. If, in the case of the conversion of the income on the basis of the official exchange rate for the benefit of the person persecuted, a deviation of at least 10 from the hundred compared to the conversion of the income after the purchasing power of the foreign currency is obtained, the Purchasing power is appropriately taken into account.
