§ 1 Scope

This Regulation shall apply to the establishment, nature and operation of equipment for the burial of fireworks. Unofficial table of contents

§ 2 Definition

For the purposes of this Regulation:
1.
Exhaust gases: the carrier gases with the solid, liquid or gaseous emissions;
2.
Altanlagen: installations which have been set up or approved before the entry into force of this Regulation;
3.
Facilities for burial (installations): all technical equipment used for the cremation of human corpses;
4.
Emissions: air pollution originating from the plant, expressed as mass concentration in units nanograms per cubic metre (ng/cbm) or milligrams per cubic metre (mg/cbm), based on the volume of exhaust gas in the normal state (273 K, 1013 hPa) after deduction of the moisture content of water vapour; they refer to a volume content of oxygen in the exhaust gas of 11 of the hundred, in the case of electrically operated plants to a volume content of oxygen in the exhaust gas of 15 of the hundred.

§ 3 Feuerung

(1) Insofar as the plants are equipped with burners, they may only be operated with gases from the public gas supply, liquefied petroleum gas, hydrogen or heating oil EL. § 4 Emission limits

Installations may only be constructed and operated in such a way that:
1.
the emissions of carbon monoxide mean an hourly average value of 50 mg per cubic metre of exhaust gas,
2.
the emissions of total dust and organic substances, calculated as hourly average values and in accordance with the procedure laid down in Annex 1, the following emission limit values
a)
Total dust 10 mg/cbm,
b)
organic substances, expressed as total carbon, 20 mg/cbm, and
3.
the emissions from the dioxins and furans referred to in Annex 2, expressed as a sum value and calculated as the mean value over the sampling period, in accordance with the procedure laid down in Annex 2, the emission limit value of 0.1 ng/cbm

§ 5 Conditions of discharge for exhaust gases

Exhaust gases are to be diverted into the free air flow via one or more chimneys in such a way that the height of the outlet opening for the exhaust gases
1.
the highest edge of the roof ridge of the plant is at least 3 meters above the top and
2.
is at least 10 metres above the corridor.
In the case of a roof inclination of less than 20 degrees, the height of the outlet opening shall be based on a fictitious roof ridge, the height of which shall be calculated on the basis of a roof inclination of 20 degrees. Unofficial table of contents

§ 6 Display

The operator of an installation shall notify the competent authority not later than one month prior to its entry into service. Unofficial table of contents

§ 7 Continuous Measurements

(1) The installations shall be equipped with measuring equipment which shall:
1.
the volume content of oxygen in the exhaust gas,
2.
the mass concentration of carbon monoxide in the exhaust gas; and
3.
the minimum temperature in accordance with § 3 (2)
continuously measure and register. The installations may be operated only by means of suitable and functional measuring equipment. (2) The installations shall be equipped with measuring instruments to monitor the functioning of the dust extractive devices, which shall be equipped with a smoke-gas density continuously. The installations may be operated only by means of suitable and functional flue gas sealing devices which make it possible to draw conclusions on the constant compliance with the emission limit value for total dust according to Article 4 (2) (a). (3) The operator shall have the proper installation of the measuring equipment for the continuous monitoring of carbon monoxide, by means of a body designated by the competent supreme authority or by the authority designated under national law for calibrations; Allow oxygen, flue gas density and temperature to be certified as well as the Calibrate measuring devices before commissioning and, in each case at the latest after the end of a year, have to be tested for functionality. The operator shall have the calibration repeated no later than five years after the last calibration. The operator shall submit the certificate of proper installation, the reports on the outcome of the calibration and the verification of the functioning of the competent authority within three months of its implementation. § 8 Assessment and reports of continuous measurements

(1) During the operation of the plant, the mean value for the carbon monoxide measurement shall be the mean value for each successive hour. (2) The operator shall draw up or draw up a measurement report on the evaluation of the continuous measurements. and to be submitted to the competent authority within three months of the end of each calendar year. The operator must keep the records for five years. (3) The limit value for carbon monoxide is complied with if no hourly average value in accordance with section 7 (1) no. 2 in connection with paragraph 1 exceeds the limit value in accordance with § 4 No. 1. § 9 Individual measurements

The operator of a plant established after the entry into force of this Regulation shall have compliance with the requirements for total dust, total carbon and dioxins and furans in accordance with § 4 at the earliest three months and no later than six months after the entry into service. to be examined in accordance with Section 29b (2) in conjunction with Article 26 of the Federal Immission Protection Act, in accordance with the conditions laid down in Annex 1 and Annex 2. Section 10 Assessment and reports of individual measurements

(1) A measurement report shall be drawn up on the measurements in accordance with § 9 and shall be submitted to the competent authority within three months after the measurement has been carried out. The measurement report shall contain information on the measurement planning, the result, the measuring methods used and the operating conditions which are of importance for the assessment of the measurement results. The operator must keep the reports for five years. (2) The emission limit values shall be deemed to be complied with if no result of a single measurement of the hourly average value is the respective emission limit value according to § 4 no. 2 or the mean value over the Sampling time in accordance with § 4 no. 3. Section 11 Transitional regime

Altanlagen shall comply with the requirements of this Regulation at the latest after three years after the entry into force of this Regulation. Unofficial table of contents

§ 12 Approval of exceptions

The competent authority may, at the request of the operator, grant derogations from the provisions of this Regulation where, taking into account the specific circumstances of the individual case,
1.
the individual requirements of the Regulation cannot be fulfilled, or can only be met with disproportionately high expenditure,
2.
harmful environmental impacts are not to be feared, and
3.
whereas, moreover, the measures relating to emission limitation corresponding to the state of the art are applied;
(2) An exception to § 5 shall be considered, in particular, when matters relating to the protection of monuments are affected. (3) The competent authority may grant the exemption under conditions, subject to conditions, or temporary ones. Unofficial table of contents

§ 13 Further requirements

The authority of the competent authority to make other or more extensive arrangements on the basis of the Federal Immission Control Act shall remain unaffected. Unofficial table of contents

§ 14 Administrative Offences

Contrary to the provisions of Section 62 (1) (7) of the Federal Immission Protection Act, who intentionally or negligently is acting in accordance with the provisions of the German Federal Immission Act (
1.
shall set up or operate an installation in accordance with § 4,
2.
Contrary to § 5 sentence 1, the exhaust gas shall not be diverted or shall not be derived in the prescribed manner
3.
Contrary to § 6, an advertisement is not reimbursed, not correct or not timely,
4.
operate in accordance with Article 7 (1) or (2) of the Annex,
5.
, contrary to § 7 (3) sentence 1 or 2, a measuring device shall not be calibrated or not calibrated in time or shall not be checked in time or the calibration cannot be repeated or shall not be repeated in time, or
6.
Contrary to § 9 sentence 1 or 2, compliance with the requirements is not, not correct, not checked in the prescribed manner or not in time, or an examination is not, not correct, not in the prescribed manner or not in time can be repeated.

Annex 1 Determination of the mass concentration of total dust and total carbon in accordance with § 4 N ° 2

1.
In order to determine the mass concentration of total dust and total carbon in accordance with § 4, point 2, the sampling time shall be one hour; the sampling shall take place from the beginning of the cremation.
2.
Samples are to be drawn during five successive cremation operations.

4.
The measurement of the organic substances, indicated as total carbon, is carried out according to the FID method. The calibration of the device is carried out with propane or butane. Annex 2 Determination of the mass concentration of dioxins and furans according to § 4 N ° 3

1.
In order to determine the mass concentration of dioxins and furans in accordance with § 4, point 3, the sampling time shall be at least six hours.
2.
The sampling takes place from the beginning of a cremation.
