§ 1 Reference Size

The reference quantity (§ 18 of the Fourth Book of the Social Code) amounts to DM 1,750 per month in the area referred to in Article 3 of the 'Einigungscontracges' (German Social Code) as of 1 July 1991. Unofficial table of contents

§ 2 Contribution rate limit

As from 1 July 1991, the ceiling of the contribution ceiling shall be 3,400 DM per month in the area referred to in Article 3 of the agreement. Unofficial table of contents

§ 3 Principle for the adjustment of pensions

Pensions from the pension scheme, including pensions from the voluntary supplementary pension scheme, as well as pensions from the accident insurance scheme and the war damage pensions, are included in § 19 of the Pensions Act for reference periods. as from 1 July 1991, in accordance with Articles 4 to 6 of this Regulation. This does not apply to the benefits referred to in § 9 of the Pensions Act as well as benefits in accordance with § § 9 to 11 of the pension scheme of the Deutsche Reichsbahn and services in accordance with § § 9 to 11 of the German Post's pension scheme. § 4 Pensions from pension insurance

Pensions from the pension insurance scheme are adjusted by increasing the amount of the adaptable amount resulting from the month of July 1991 by 15 per cent. Unofficial table of contents

§ 5 Pensions from accident insurance

The pension from the accident insurance scheme for accidents at work and occupational diseases, which occurred before 1 July 1991, shall be calculated on the basis of a calculation basis increased by 15 per hundred. This does not apply to child surcharges relating to accident pensions. Unofficial table of contents

§ 6 War Damage Pensions

War damage pensions are adjusted by increasing the amount of adaptable amount resulting from the month of July 1991 by 15 of the hundred. By way of derogation from the first sentence, the regulation on the calculation of income to the war damage pension (Section 7 (2) sentence 1 of the Pensions Act) shall be applied to the adjusted pension. § 7 Effects on social surcharge

The increases in amounts pursuant to § § 4 and 5 shall not be deducted from the social supplement. Unofficial table of contents

§ 8 Pensions with supplementary pensions

(1) Adjustment amounts in accordance with § § 4 and 5 shall be credited to similar supplementary pensions in the amount of the amount by which they, together with the previous payment amounts of the pension and the like additional supply, shall be deducted from the amount referred to in paragraph 2. the limit values shall be exceeded. (2) The limit values shall be for
1. Insured 1,500 DM,
2. Widows or widows 900 DM,
3. Full orphans 600 DM,
4. Half orphans 450 DM.

§ 9 Pensions with special care

(1) Pensions which were not to be adjusted for the purpose of providing special care shall be aligned in accordance with the provisions of the First and Second Section of the Pensions Act and shall be made in accordance with the provisions of the first and second sections of the Pensions Act. (2) In the case of reference periods of 1 July 1990 to 30 June 1991, the beneficiaries shall be repaid an increase in the amount referred to in paragraph 1. The repayment of an increase in the amount referred to in paragraph 1 shall not be paid to the extent that the beneficiaries have received a social supplement. Unofficial table of contents

Section 10 Calculation of pension rights arising from the pension insurance scheme from 1 July 1991 to 31 December 1991

Pension rights arising from the period from 1 July 1991 to 31 December 1991 shall be determined in accordance with the rules which have otherwise been determined and shall be determined in accordance with the conditions laid down in the first paragraph.
