Pursuant to Section 4 (1) No. 1 of the Law on Technical Work Funds of 24 June 1968 (BGBl. 717), after consultation of the Committee on Technical Work Funds, shall be arranged in agreement with the Federal Minister for Economic Affairs and with the approval of the Federal Council: Unofficial table of contents

§ 1

This Regulation lays down the nature of electrical equipment for use at a rated voltage of between 50 and 1000 V for alternating current and between 75 and 1,500 V for direct current, in so far as it is a technical equipment or uses or parts of the goods to be used. It shall not apply to:
1.
electrical equipment for use in an explosive atmosphere,
2.
electro-radiological and electro-medical equipment,
3.
electrical parts of passenger and load elevators,
4.
electricity meter,
5.
Budgetary plug-in devices,
6.
Electrical power supply devices for electric fences,
7.
Special electrical equipment intended for use on ships, in aeroplanes or in railways and complying with the safety requirements of international bodies to which the Member States of the European Community .
Furthermore, it does not apply to radio interference suppression of electrical operating equipment. Unofficial table of contents

§ 2

(1) New electrical equipment may only be made available on the market if:
1.
they are manufactured in accordance with the level of safety technology provided in the European Community,
2.
they do not endanger the safety of humans, livestock and the maintenance of property values when properly installed and maintained and used as intended. The state of security technology, which is relevant for electrical equipment, is , taking into account the network supply system for which they are intended.
(2) The electrical equipment must, in particular, be appropriate for the following safety principles:
1.
The essential characteristics, of which the knowledge and observance of such features are dependent on the intended use, shall be indicated on the electrical equipment or, if this is not possible, on a given notice.
2.
The manufacturer ' s mark or mark shall be clearly affixed to the electrical equipment or, where this is not possible, to the packaging.
3.
The electrical equipment and its components must be such that they can be securely and properly connected or connected.
4.
Whereas, in order to protect against hazards which may arise from electrical equipment, provision should be made for technical measures to ensure that the use and proper maintenance of such equipment are intended to be used in accordance with the
a)
people and livestock are adequately protected from the risks of injury or other damage which may be caused by direct or indirect contact;
b)
there are no temperatures, arcs or radiations from which hazards can arise;
c)
the protection of human beings, farm animals and property against non-electrical hazards arising from the experience of electrical equipment;
d)
the insulation is appropriate to the intended use.
5.
Whereas, in order to protect against hazards which may arise from external effects on electrical equipment, provision should be made for technical measures to ensure that the electrical equipment is used in accordance with the intended use and proper use of the equipment; Entertainment
a)
to withstand the mechanical stresses which are intended to ensure that human beings, livestock or goods are not endangered;
b)
to withstand, under the conditions of the environment, the non-mechanical effects to such an extent that people, farm animals or property are not endangered;
c)
in the case of overloading, do not endanger people, livestock or things.

§ 3

(1) Electrical equipment may only be made available on the market if, in accordance with paragraph 2, it is marked with the CE marking in accordance with Article 7 of the Product Safety Act, by which the manufacturer or his/her in the Community or in a certifies that the security requirements laid down in § 2 and the conformity assessment procedures referred to in Annex IV to Directive 2006 /95/EC of the European Economic Area (EEA) are fulfilled by the other Contracting State of the Agreement on the European Economic Area. European Parliament and of the Council of 12 December 2006 on the approximation of Legislation of the Member States relating to electrical equipment for use within certain voltage limits (OJ L 327, 30.4.2004 EU No 10). (2) The CE marking must be affixed to any electrical equipment or, should this not be possible, on the packaging or on the instructions for use or on the guarantee note, legibly and permanently. Its minimum height is 5 millimetres. (3) The electrical equipment is also subject to other legislation which prescribates the CE marking, and the CE marking also confirms that the electrical equipment is also used for the electrical equipment. the provisions of these other relevant legislation. However, if, in accordance with one or more of these laws, the manufacturer is free to choose the applicable rules during a transitional period, the CE marking shall only confirm that the electrical equipment shall be used by the manufacturer to: Manufacturer's legislation is in accordance with the first sentence. In such cases, documents, references or instructions shall be accompanied by the operating means, in which all the numbers of the Community directives on which the manufacturer applies are based, as published in the (4) The manufacturer or his authorised representative established in the Community or in any other Contracting State of the Agreement on the European Economic Area shall have the following documents for the competent authorities shall be held:
1.
a declaration of conformity in accordance with Annex III B to Directive 2006 /95/EC and
2.
the technical documentation referred to in Annex IV (3) of Directive 2006 /95/EC.

§ 4

Contrary to the provisions of Section 39 (1) (7) (a) of the Product Safety Act, those who intentionally or negligently act
1.
provides an electrical equipment on the market in accordance with the first sentence of Article 3 (1); or
2.
the documents referred to in Article 3 (4) shall not be available there.
