§ 1 Legal form of the Foundation

Under the name "Museumsstiftung Post und Telekommunikation" (Museum Foundation Post and Telecommunications) a legal foundation under public law will be established in Bonn. The Foundation shall be established with the entry into force of this Act. Unofficial table of contents

§ 2 Purpose of the Foundation

(1) The purpose of the Foundation is to develop, collect and present the entire development of communication and related banking, goods and passenger transport in the postal and telecommunications sector. (2) This includes in particular: the task,
1.
to preserve, maintain, supplement and open up to the public the objects of collection entrusted to it;
2.
to obtain a meaningful connection of this collection,
3.
to ensure the evaluation of the collection for the interests of the general public in education and science as well as in the overall context of economic history,
4.
to cultivate cooperation with associations active in the post-history sector, and
5.
cooperate with museums and foundations of the same goal nationally and internationally.

§ 3 Foundation assets

(1) The Foundation is, according to § § 13 and 14 of the Postal Conversion Act, all assets of the special assets of the Deutsche Bundespost, including limited rights, which are the German Federal Mail to be personally granted to the museum system (collection items, postage stamp archives and other property). At the same time, the property rights are subject to the liabilities and claims related to them. (2) The foundation is entitled to accept third-party grants. (3) Insofar as this does not endanger the Foundation's purpose. The Foundation shall be entitled to dispose of property in the context of proper administration or to submit it in a special manner. § 4 Funding

(1) The Foundation shall be financed by:
1.
revenue from entry fees, interest, rents and other proceeds and proceeds,
2.
Grants for joint stock companies resulting from the subsonic assets of the Deutsche Bundespost
3.
Third party grants.
(2) The amount of the grant of the post-successor companies shall be fixed annually in advance by the Board of Trustees. In the absence of any other arrangement, the post-successor companies shall bear the proportion of their share in the proportion of their participation in the board of trustees. § 5 Institutions

§ 6 Statute

The Foundation has a statute that is decided by the Board of Trustees by a majority of two-thirds of the members and which requires the approval of the Federal Ministry of Finance. The same shall apply to amendments to the Articles of Association. Unofficial table of contents

§ 7 Kuratorium

(1) The Board of Trustees shall consist of at least eleven members. It consists of three representatives of the federal government, Deutsche Post AG and Deutsche Telekom AG, as well as two representatives from the technical and general museum industry. Deutsche Postbank AG is entitled to send a representative. Another member may be appointed by the Federal Council. The members of the Board of Trustees are appointed by the Federal Ministry of Finance for a period of five years. The representatives of the companies will be appointed on a proposal from the respective company, the representatives of the museum system will be appointed on a proposal of the German Museumsbund e.V. A repeat order is allowed. (2) For each of the members, a deputy is to be ordered. (3) The members or their substitutes shall receive compensation for travel expenses and an appropriate allowance for expenses, which the Federal Ministry of Finance shall fix. (4) In order to promote the Foundation's purpose, the following may apply: also representatives of other companies or private persons will be admitted to the board of trustees. The request is subject to approval by the Federal Ministry of Finance. The authorisation shall be granted at the discretion of the person. The board of trustees is to be heard before. (5) If a member of the board of trustees or his representative prematurely fails, an appointment of the successor may be effected only for the remainder of the time for which the member or the representative had been appointed. (6) Board of trustees is quorum if more than half of its members are present. Unless otherwise provided for in this Act, it shall take its decisions by a simple majority of the votes cast. The representative of the Federal Council and the two representatives of the technical and general museum system have only a consultative vote. (7) The Board of Trustees shall adopt its rules of procedure, which require the approval of the Federal Ministry of Finance. (8) In accordance with its Rules of Procedure, the Board of Trustees shall elect the Chairperson and a Vice-Chairman from among its members. (9) The Statute shall be governed by the Statute. Section 8 Tasks of the Board of Trustees

(1) The Board of Trustees shall decide on all fundamental questions which are part of the remit of the Foundation. This includes in particular:
1.
the proposal relating to the appointment of the curator;
2.
the annual setting of the grant to be paid to the Foundation by the companies and individuals represented on the Board of Trustees;
3.
the adoption of the budget;
4.
the approval of the sale or any other charges for the disposal of property in the scope laid down by the Articles of Association;
5.
the decision on the appointment of the museum directors and the determination of their powers,
6.
approval of organisational rules for museums,
7.
the decision to change the location of a collection;
8.
the decision-making on the type and manner of cooperation with associations active in the post-historical context, as well as with other museums and foundations, and
9.
the remission and amendment of the statutes.
(2) The Board of Trustees shall monitor the activity of the curator. It can request information and reports from him at any time, as well as the submission of the files and books. Unofficial table of contents

§ 9 Curator

(1) The full-time curator and his permanent representative shall be appointed by the Federal Ministry of Finance on a proposal of the Board of Trustees. (2) The curator and his permanent representative may not be members of the Board of Trustees or their alternates. (3) In contrast to the curator, the Foundation will be represented by the Chairman of the Board of Trustees. Unofficial table of contents

§ 10 Tasks of the curator

(1) The curator shall execute the decisions of the Board of Trustees and shall carry out the current affairs of the Foundation. The further details, in particular the division of tasks between the curator and the museum directors, are governed by the statutes. § 11 Staff

(1) Without prejudice to the right to employ employees and workers, the Foundation shall be granted the right to have civil servants. (2) The Federal Ministry of Finance shall regulate the transfer of employees of the Federal Ministry of Finance and after Consultation of the post-successor companies also the transfer of the employees of the post-successor companies to the foundation with regard to the applicable civil servants ' legal, disciplinary, labour law and personnel representation law Provisions. § 12 Budget, Auditing

(1) The provisions applicable to the Federal Administration shall apply to the budget, treasury and accounting system as well as to the accounting of the Foundation. (2) The Foundation shall have a right in good time before the start of each financial year. § 14 Service seal

§ 15 Tax, Fee and Tax Liberation
