This Act is designed to implement Directive 2010 /40/EU of the European Parliament and of the Council of 7 July 2010 on the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other transport modes 1. OJ L 207, 6.8.2010, p. 1).

§ 1 Scope

This law applies to Intelligent Transport Systems in the field of road transport and their interfaces to other modes of transport. This law does not apply to Intelligent Transport Systems, which are used by public security or defence. Unofficial table of contents

§ 2 Definitions

For the purposes of this law, the term "
1.
"Intelligent transport systems" means systems in which information and communication technologies are used in road transport and at interfaces with other modes of transport;
2.
"Application of Intelligent Transport Systems" means a technical system, a method or a device for the use of intelligent transport systems;
3.
"Service of Intelligent Transport Systems" means the provision of an application of Intelligent Transport Systems within a given organisational and technical framework;
4.
"interface" means a device between systems that serve the connection and communication between them;
5.
"continuity of services" means the ability to provide seamless services across the Union in transport networks;
6.
"road data" means data relating to characteristics of road infrastructure, including fixed traffic signs or their regulated security features;
7.
"traffic data" means data and real-time data relating to the road traffic situation;
8.
"travel data" means data such as timetables and fares of public transport as the necessary basis for the provision of travel information before and during the journey to facilitate the planning, booking and adaptation of the journey;
9.
"Specifications" means rules which define the requirements for Intelligent Transport Systems.

§ 3 Principles for the introduction of Intelligent Transport Systems

In the introduction of applications and services Intelligent transport systems must be implemented by the competent authorities as required by the European Commission in accordance with Article 6 of Directive 2010 /40/EU of the European Parliament and of the Council of 7 July 2010 on Framework for the deployment of Intelligent Transport Systems in road transport and for interfaces with other modes of transport (OJ C 327, 28.4.2002, p 1), taking into account the principles set out in Annex II to Directive 2010 /40/EU, as amended in each case. Personal data may only be collected, processed or used, insofar as this is expressly permitted or arranged by a federal legislation. Unofficial table of contents

§ 4 Priority areas

Intelligent transport systems may be introduced as a priority for the following purposes:
1.
optimal use of road, traffic and travel data;
2.
Continuity of services Intelligent transport systems in the areas of transport and freight management;
3.
Applications of Intelligent Transport Systems for road safety;
4.
Connection between vehicle and transport infrastructure.

§ 5 Authorisation of the Rules of Procedure

The Federal Ministry of Transport and Digital Infrastructure is authorized, taking into account the provisions of Article 10 of Directive 2010 /40/EU by means of a legal regulation with the consent of the Federal Council, the requirements for Intelligent Transport Systems in the To regulate areas according to § 4, taking into account the requirements of Article 5 in conjunction with Annex II of Directive 2010 /40/EU. § 6 Entry into force

This Act shall enter into force on the day following the date of delivery.
