Pursuant to Section 11 (2) of the Act on the electromagnetic compatibility of devices of 18 September 1998 (BGBl. 2882), as amended by the Law of 7 May 2002 (BGBl I). 1529), in conjunction with the second section of the Administrative Cost Act of 23 June 1970 (BGBl. 821), the Federal Ministry of Economics and Technology, in agreement with the Federal Ministry of Finance, is responsible for: Unofficial table of contents

§ 1 Advisory duty

(1) To be responsible for the expenses incurred by the Federal Network Agency for Electricity, Gas, Telecommunications, Post and Railways by the activities referred to in § 8 (1) to (6) of the Act on the electromagnetic compatibility of equipment , each holder of a frequency allocation shall be responsible. The awards granted up to 1 August 1996 shall be deemed to be allocations under Section 47 of the Telecommunications Act to the extent that they contain provisions relating to the use of frequencies. The second sentence shall also apply to other administrative acts in so far as they include a licence for the use of frequencies. (2) The holders of frequency allocations shall be grouped into user groups. The contribution to this Regulation shall be carried out by user groups in accordance with column 3 of the Annex to this Regulation. Within the user groups, the contribution shall be allocated according to the reference units referred to in column 4 of the Appendix to this Regulation. (3) The contribution shall begin with the month of the allocation of the information for the operation of the broadcasting system or of the system. § 2 Contributions of contributions

(1) From the payment of the contributions are exempt:
1.
the Federal Republic of Germany and the federal direct legal persons under public law whose expenditure is wholly or partly based on statutory obligations arising from the budget of the Federal Republic of Germany,
2.
the countries and legal persons governed by public law which are administered in accordance with the budgets of a country for the account of a country; and
3.
the municipalities and municipal associations, provided that the allocated frequencies are not used by their economic enterprises.
(2) No contributions shall be levied for the use of frequencies reserved for public authorities and organisations with security duties. (3) The contribution exemption shall not apply to the extent that the persons referred to in paragraph 1 have the right to make contributions to third parties. § 3 Definition of EMV annual contributions for the years 1999, 2000, 2001 and 2002

(1) The EMV contributions for the years 1999, 2000, 2001 and 2002 shall be set at the annual contributions per unit of reference listed in column 5 of the Appendix. § 4 Due date

The contribution shall be due with the announcement of the contribution modest, if not the Authority, at a later date. § 16 of the Administrative Costing Act shall apply accordingly. Unofficial table of contents

§ 5 Late surcharge

Section 7 Repayment of contributions

For periods within a calendar year for which there was no obligation to contribute according to § 1, paid contributions shall be refunded with one twelfth of the annual fee per calendar month or charged with the next contribution payment. Unofficial table of contents

§ 8 Entry into force, external force
