§ 1 Scope

This arrangement regulates the implementation of the
1.
the fixing and regulation of pensions (including accident insurance);
2.
of the Supply Compensation Act and the Federal Supply Division Act,
3.
the burden of supply load,
4.
supply matters under the law governing the legal situation of persons covered by Article 131 of the Basic Law (hereinafter referred to as G 131),
5.
other tasks related to the tasks referred to in points 1 to 4,
6.
the decision on contradictions and the representation of the person concerned in the case of claims arising out of the areas referred to in points 1 to 5.

Section 2 Substantive responsibility for the fixing of pensions

The responsibility of the supreme service authority for the fixing of pensions (including accident insurance) to beneficiaries of supply, the supply of which is
1.
an official or judicial relationship with the federal government,
2.
a treaty with the federal government,
3.
a public service relationship as
a)
President of the Federal Republic of Germany,
b)
Member of the Federal Government,
c)
Parliamentary Under-Secretary of State or Parliamentary Under-Secretary of State,
d)
President or Vice-President or Vice-President of the Federal Constitutional Court,
e)
Federal Commissioner or Federal Commissioner for Data Protection,
f)
Defense officer or military officer of the German Bundestag,
g)
Federal officer or Federal Commissioner for the documents of the State Security Service of the German Democratic Republic, or
4.
a service contract in which a supply in the appropriate application of the civil service law with a charge equal to the respective salary of a Federal official or a Federal official of grade B 9 is regulated upwards,
, shall be transferred, in accordance with the provisions of Appendix 1, to the Service Centre for the supply of the General Customs Directorate pursuant to Appendix 2 (hereinafter referred to as the Service Centre), unless otherwise specified in this Regulation. Unofficial table of contents

Section 3 Local competence for the fixing of pensions

(1) The service centre in whose area of responsibility is the main residence of the person entitled to supply shall be responsible. The service centre is responsible for the decision pursuant to Section 49 (2) of the German Civil Service Act and the granting of a pension provision in accordance with § 49 (10) of the Civil Service Act, in the area of which the principal residence of the official is or of the official. § 4 Sachliche Responsibility for the Supply Balance and the Implementation of the Federal Supply Law

The Service Centre shall be responsible for the
1.
Provision of information to the family courts in accordance with Section 220 of the Law on the Procedure in Family Matters and in the Matters of Voluntary Jurisdiction
a)
Officials, in so far as the first fixing of pensions is the responsibility of the service centres,
b)
Retired civil servants and former officials and officials, in so far as the further fixing of pensions is the responsibility of the service centres,
2.
Determination of the capital amount according to § 58 of the Staff Regulations of Officials for
a)
Officials, in so far as the first fixing of pensions is the responsibility of the service centres,
b)
Retired civil servants, in so far as the further fixing of pensions is the responsibility of the service centres,
3.
Reimbursement of expenses incurred by the insurance institutions pursuant to Section 225 (1), first sentence, of the Sixth Book of the Social Code, on the basis of pension entitlements established by the decision of the Family Court, to the detriment of
a)
Officials, in so far as the first fixing of pensions is the responsibility of the service centres,
b)
previous officials and temporary deceased civil servants or deceased former officials, in so far as the first or further fixing of the pensions would have been the responsibility of the service centres if the officials would have retired, or if the service centers are responsible for their survivors,
c)
Retired civil servants and retired civil servants and retired civil servants in the meantime, in so far as the first or further fixing of the pensions is the responsibility or the responsibility of the service centres, or if the the service center for whose survivors is responsible,
4.

§ 5 Local responsibility for the compensation of supply and the implementation of the Federal Supply Division Act

Section 6 Participation in the procedure in supply compensatory matters

Section 7 Substantive responsibility for the sharing of the supply burden

The Service Centre shall be responsible for the
1.
Implementation of the Law on the State Contract of 16 December 2009 and 26 January 2010 on the distribution of supply burdens in the case of cross-country and cross-national dienther changes (Supply-load-sharing-state contract) of 5 September 2010 (BGBl. 1288), in particular for:
a)
Calculation, documentation and payment of the severance payments in accordance with § 4 of the State Contract for Supply Relief Contracts as well as the current reimbursements pursuant to § 10 of the State Contract of Supply Relief Contracts (Lending),
b)
Examination of the documentation of the severance and notification of the amount of severance to be requested to the receiving body of the service pursuant to § 4 of the State Treaty of Supply and Retirement Provision (Lending),
2.
Implementation of the supply-load sharing according to § 107b of the German Civil Service Act (civil service law) in the case of internal service-service changes, in particular for the reimbursement and enforcement of supply loads, while maintaining the in the BMF jurisdiction-Supply of 27 January 2000 (BGBl. 1213), as last amended by the order of 23 May 2008 (BGBl. 973), the procedure and the rules of jurisdiction laid down in this Regulation,
3.

Section 8 Local responsibility for the sharing of the supply load

§ 11 Other tasks in connection with the tasks according to § § 1 to 10

§ 16 Other regulations

(2) The Federal Chancellery shall be reserved for the members of the Federal Intelligence Service:
1.
the first fixing of pensions,
2.
Decisions pursuant to Section 49 (2), second sentence, of the Staff Services Act on the recognition of permanent service periods in accordance with § § 10 to 12 of the Staff Regulations Act,
3.
to require the appointment of an authorised person in the cases of Article 49 (6) of the Civil Service Act,
4.
the granting of a supply information pursuant to § 49 (10) of the Civil Service Act.
(3) The Federal Ministry of Defence or the body designated by it shall have the following responsibilities:
1.
the determination of the periods of establishment of the supply and of a pension provision as a period of service in accordance with § § 6, 8, 9, 12a, 12b and 13 (2) of the Civil Service Act as well as in accordance with § 3 of the the transitional Regulation on the provision of civil servants and the transitional authorities;
2.
the decision on the taking into account of periods in accordance with Articles 10 to 12 and 67 of the Civil Service Act as a period of service which is capable of rest;
3.
the decision pursuant to Section 45 (3), second sentence, of the Civil Service Act concerning the recognition of service accidents, including revenue accruals, in accordance with § § 31 and 31a of the German Civil Service Act and the decision as to whether the injured person is the caused an accident,
4.
the approval of accident insurance services in accordance with § § 32 to 35 of the Staff Regulations of Officials,
5.
the decision on the existence of the conditions for the granting of accident prevention services in accordance with Articles 36 to 39 and 41 of the Staff Regulations on pensions,
6.
the arrangement of a medical examination in accordance with § 35 (3) sentence 2 of the Staff Regulations for the Protection of Accident Insurance and in accordance with § 38 (6) sentence 2 of the Civil Service Act for the investigation of the degree of reduction of the Employability,
7.
the decision on the granting of compensation in accordance with Section 43 of the German Civil Service Law and on the compensation for damages pursuant to Section 43a of the German Civil Service Act and its implementation,
8.
the decision on the failure to provide casuals pursuant to Article 44 (2), first sentence, of the Staff Regulations Act,
9.
the processing of non-formal appeals (for example, petitions, professional supervision complaints, service supervision complaints), to the extent that specific matters are affected,
10.
the assertion of statutory claims for damages in accordance with § 76 of the Federal Civil Service Act (Bundesbeamtengesetz) on the Dienstherrn.
(4) The Service Centres are not authorised to take decisions which have a fundamental meaning beyond the individual case and which, according to the wording of the provisions, can only be taken by the supreme service authorities. These rules also affect decisions relating to:
1.
accident prevention for officials on leave under Section 31 (5) of the Staff Regulations on pensions,
2.
the existence of a service of conduct associated with a particular risk of life in accordance with § 37 (1) sentence 1 or the existence of an attack pursuant to Article 37 (2) of the Staff Regulations of Officials,
3.
the existence of the peculiary circumstances in accordance with Section 43 (3) of the Staff Regulations of Officials,
4.
Compensation in special cases according to § 43a of the Staff Regulations of Officials,
5.
the withdrawal of the supply in accordance with section 62 (3) of the Staff Regulations.
